The plan has been modified to respond to site topographical conditions. The ;plan now preserves a stream that was previously permitted for a stream crossing, and relocates the road crossing to a stream that was previously designated to be preserved - There are no net changes to the total impacts, and there are no changes that would trigger additional stream or wetland mitigation. - The proposed relocated stream crossing will not exceed 150 linear feet: Overall impacts to the tributary will not exceed 150 linear feet know if you have any questions, and for your consideration. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3108, 3290 and 3289. This certification allows you to use Nationwide Permit Numbers 26, 3 and 14 when issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. According to the owner and land planner for this project, preparation of design documents began in 1998. Plans were developed anticipating stormwater detention, however since this project was residential, they did not anticipate stormwater treatment facilities. Except for rare circumstances the NCDWQ was not requiring stormwater treatment facilities in 1998 for residential projects. The developer has made a substantial investment in the planning and engineering of this project, and this could cause a significant hardship in the construction of retaining walls, additional land clearing, and possibly a redesign. We are proposing the following for your consideration. 1) Total impervious surface on the project will not exceed 50%. It is anticipated that maximum impervious area on the project site will be approximately 44%. 2) There will be no direct discharges of stormwater from buildings and parking lots into any surface waters. 3) As indicated on the attached plan, water quality ponds will be provided to treat runoff from the most concentrated area of the development or approximately 50% of the total site, which includes the clubhouse area. According to the owner and land planner for this project, preparation of design documents began in 1998. Plans were developed anticipating stormwater detention, however since this project was residential, they did not anticipate stormwater treatment facilities. Except for rare circumstances the NCDWQ was not requiring stormwater treatment facilities in 1998 for residential projects. The developer has made a substantial investment in the planning and engineering of this project, and this could cause a significant hardship in the construction of retaining walls, additional land clearing, and possibly a redesign. We are proposing the following for your consideration. 1) Total impervious surface on the project will not exceed 50%. It is anticipated that maximum impervious area on the project site will be approximately 44%. 2) There will be no direct discharges of stormwater from buildings and parking lots into any surface waters. 3) As indicated on the attached plan, water quality ponds will be provided to treat runoff from the most concentrated area of the development or approximately 50% of the total site, which includes the clubhouse area. Hyde Park, Page 2 July 13, 2000 4) The discharge from the remaining dry detention basins will be diffused over the surrounding natural and landscaped areas by the use of level spreading devices and plunge pools. The plan indicates the nearest open channel or ditch. Best Management Practices will be employed to minimize impacts to Jurisdictional Waters downstream. Project construction will strictly adhere to an approved Sedimentation and Erosion Control Plan. Impacts from hazardous materials and other toxins to fish and aquatic life such as fuels will be avoided by not permitting staging areas to be located near surface waters. As required by the 401 Water Quality Certification conditions, measures will be taken to prevent "live" or fresh concrete from coming into contact with waters until the concrete has hardened. The project has been plagued sensitively to preserve the perennial, and intermittent streams to the fullest extent feasible. Thera are approximately 11,630 if of important perennial to intermittent streams (including Back Creek): and approximately 8.8 acrss of jurisdictional waters (streams, wetlands, ponds). Due to Sensitive land planning, stream impacts are primarily confined to only those necessary to implement necessary road crossings and to general site grading. Clearly defined construction and grading limits will be implemented to minimize additional impacts as well as to preserve forested buffers to the extent feasible along the Streams. The wetlands in the Back Creek floodplain will not be impacted. All fin material will be unpolluted end appropriate measures to control sedimentation and erosion v411 be employed.
