REQUIREMENT NOTIFICATION
Dear Mr. Hoak:
On July 25, 2008, the Division of Water Quality (DWQ) issued a 401 Water Quality
Certification to you to fill or otherwise impact 299 linear feet (If) of unnamed tributary to
Mallard Creek in order to construct the Worthington Phase II Apartments in Mecklenburg
County. Please note that Condition 3 of the Water Quality Certification requires you to obtain a
written stormwater management plan approval from this office, or a DWQ delegated Stormwater
Management Program, before any impact or construction of permanent facility could occur.
Please be aware that this condition must be satisfied within sixty (60) days from the date of
issuance of the Water Quality Certification.
Please be advised that failure to abide by this requirement will result in a violation of, and
subsequent revocation, of your certification. Please submit for review, your stormwater
management plan and all supporting documents including applicable BMP Supplement Form(s),
and all items requested in the Required Items Checklist available at
http://h2o.enr.state.nc.us/suibmp forms.htm.
