EASLEY LYNDO TIPPETT GOVERNOR SECRETARY July 29, 2008 Mr. David Baker, NCDOT Regulatory Project Manager US Army Corps of Engineers 151 Patton Avenue, Room 208 Asheville, NC 28801-5006 Subject: 401 Permit Application Revision/Modification Action ID No. SAW-2008-1212 DWQ Project No. 080619 SR 1793 - Tracy Grove Road - Henderson County State Project No. 14C.045120 (DWQ Minor Permit Fee $240.00) Dear Mr. Baker: The North Carolina Department of Transportation (NCDOT) proposes to widen, grade, drain and pave SR 1793 in Henderson County. The original permit applications dated March 31, 2008, included four permitted sites with pipe extensions totaling 25 linear feet of permanent impacts on perennial and intermittent streams. Due to a grade change at Site #4, Station 130+86, the original length was inadequate. NCDOT proposes to install an additional 15 linear feet of 42-inch CMP to gain sufficient length for the stabilization of the fill slope at the intersection. This fill slope is critical in obtaining sufficient shoulder widths for the installation of guardrail. I have enclosed a revised PCN application (impact table), topographical map and cross- sectional drawing for the culvert installation (Site 4). The new culvert will remain perched, as is the existing culvert. Impacts to Waters of the United States In order to construct the project in accordance with our current secondary road standards, it will be necessary to impact waters of the United States in the French Broad River Basin. Specifically, NCDOT is requesting to add 15 linear feet of culvert in an unnamed tributary to Devil's Fork Creek (DWQ Class: C). Listed below is a revised summary of the proposed impacts. The outfall for the pipe at Sta. 115+11 is at the outfall to the piped ditch. This will minimize the impact to the exposed channel as it presently exists. While the flow is diverted, the pipe in the existing piped ditch will be excavated and replaced.
