1 have had additional discussions with Mr. Wagoner concerning the details of the sediment and erosion control plan that was submitted. That discussion clarified the thought process for
the plan details, as proposed, and also corrected a couple of misunderstandings on my part due to the combining of two versions of plans on the same copy.
Based on those additional discussions I am approving the plans as submitted by Mr Wagoner.

office. Please advise as to your course of action on this plan and the status of activities relating to the approved restoration plan.

See comments in Bold below. The remediation response from the owner is due to us today!. I'll give it till Monday. By then I will need something in writing as to what the owner is
planning to do to resolve the violation issues and a timeline. If I do not receive something to meet this requirement, I will be forced to proceed with enforcement and require the
restoration on top of that.

Thanks for the update. Steve got word that Mrs. Thomas was applying for an agricultural exemption, which they will probably get. However he is requiring them to submit to our office
(DWQ), an Erosion and Sedimentation Control Plan as part of the overall site remediation plan. He wants to make sure that the ladies do not mistake this agricultural exemption from
Land Quality as an exemption from the remediation requirements from our office. Steve is out in the field so I haven't gotten a chance to go over the list of your recommendations with
him but I should be able to by tomorrow.

Steve,
I am working with Mrs June Thomas and her partners to resolve the violations that have occurred on her property as a result of building a pond and an access road.
A contractor that was hired to do the work and the owners had no idea the work required any permits or approvals.
I need for you to assist in forming the plan of action.
1. The pond dam has a 4" pvc pipe underneath it which was probably a ditch drain installed a long time ago. The pipe is draining the pond and will have to be removed
or sealed if we decide to save the pond. This is the area that looked like a spring at the toe of the dam.l am OK with the removal or sealing of the 4" pipe.
2. The stream was straightened in the area of the pond dam. The toe of the dam is within 10 or 15 feet of the stream Iocation.Can the dam remain in this close proximity
to the stream since it is within the trout water stream buffer? The trout buffer is 25 feet. Our NOV required that the streambanks be reshaped to natural contours and be stabilized
with native vegetation as quickly as possible. While this is a "restoration" plan I will be OK with the dam remaining but with the 4" pipe issue at the foot of the dam and the
requirement to re-vegetated the banks, that would extend to the dam structure itself. After time, larger vegetation could endanger the dam's integrity. Probably the best course
of action would be to move the dam away from the stream but if the stream banks that currently exists are reshaped and re vegetated, that will, work as well.
3. In my opinion a new pipe should be installed properly in the old streambed location and the 48" cmp culvert should be removed from the relocated stream location.
Do you agree with this approach ? Concur. This will require a 404 permit from the Corps and because its a violation site will require 401 certification form DWQ along with the
$240 fee for the 401 certification.
4. After the new pipe is installed the stream should be returned to its old location. 1 think Mother Nature will take care of returning the stream to the old location without any
additional or at least minimal steam alterations.
5. Sediment Should be removed from the stream along with any side castings and sediment adjacent to the stream. concur
6. The streambanks shall be restored to natural contours and seeded with wetland plants and trees. Concur
Please review and give me your input.
We will still require a sediment and erosion control plan for all the disturbed areas regardless of the Agricultural exemption request to Land Quality. This should specifically
address the road, crossing, and pond(dam) areas as well as the disturbed areas in close proximity to the stream. This is a violation site thus this plan will be a requirement of
restoration.

Amanda. fyi - I didn't know he was sending this or I would have updated you when we were on the phone. I don't think it changes anything for you (but if it does and you have a problem,
let us know), we're still requiring a 401 for the pipe, installation of the 2nd pipe, and restoration of the area impacted by the dam. The erosion control plan/devices shouldn't change
anything about the 404/401.

After long discussions with Ms. Thomas and the contractor who will install the E&S measures, we believe that the proposed revisions will provide a more cost effective and
long term solution to the erosion from the road. The sediment traps are very good short term solutions, but we all believe that the stabilized ditches with the turn-outs is a
permanent solution to the runoff from the road.
I have attached a PDF of the proposed changes. I will plot the paper copies and mail them today. You should have them on Thursday.

The USACE will be issuing this under a NW29, the impacts will be less than I acre of wetland and less than 150 feet of stream so the check they sent will be sufficient. I'll correct the
numbers in RIMS when I issue the permit. Let me know if this throws up any other red flags for CO processing, but 1 think this resolves the hold issues and we can accept the application
as is?

This project was put on hold for the wrong fee. This site is a violation site. The permanent final impacts they'll have will be less than 150 feet of stream. The rest of the
project is restoration of a violation. If there were no permanent impacts we would handle this outside of a 401 issuance, just require restoration through the violation
process So it seems unequal to require the higher fee for repairing the violation which is what put them over the 150 feet.
Has this come up before? I know I had another one and we handled it this way but maybe that one was wrong and I just didn't know it?

We have a violation site on a farm in Alleghany County that involves
construction of a road and an offline pond. There is >400 feet of sediment,
road fill in wetland (W50feet long and 10 feet wide), 200ft of stream bank
impact due to fill from a pond, and a 10 foot pipe crossing with a pipe
that's perched > 1 foot. In addition, before the stream goes through the
pipe it ® 100 foot of channel has been relocated as seen in pic 7. The land
owners had previous access to the property via another road that was already
in place. We need to know the Corps stance on the project, so we can take
the appropriate actions within the next week or so. I'll follow up with a

We will be sending it to the landowner (who I assume will be your FRO). Gary is double checking with the county tax office to see who's name the property is in. We will be NOV'ing
them for the following:
I failure to get a NPDES Stormwater permit (since they did not get your permit they did not get ours either)
2. removal of use (sediment)
3, other waste (sediment)
4 they will be required to do restoration and sediment removal,
5. we may go ahead and handle the wetland violations and the improper construction of the crossing w/o 404/ 401 approvals.
I'll have Gary let you know to whom we will be addressing the NOV and we will cc you on the NOV.

According to my discussion with the landowners last week, Eddie Bunn is the engineer they have hired to handle the NOV issues. Phil Wagoner is working for the contractor that did the
dirt moving, stream crossing etc without any permits of approvals. The landowners made it clear to me that Mr. Bunn was their representative. I would suggest that any 404/401 visits
include the landowner and the engineer/ consultant working for them. 1 know already that Mr. Bunn thinks the crossing culvert needs to come out and be relocated to the old channel and
be put in correctly at correct grade. Mr Wagoner thinks its fine as it is with a little armoring and some rocks thrown in the downstream side with the perch.
Amy, since you were the one involved with the initial site visit, we (you, me , Sue, Gary) need to discuss to be on the same page. I've already told the landowners and Mr. Bunn our
expectations and I do not want mixed messages.

This office has reviewed both the delineation and reclamation plans and the sediment and erosion control plan as submitted on June 30th,2008. This
correspondence is to approved the plans as submitted. We would request that we be notified once the sediment and erosion control plan is fully implemented
(installed) and an estimated timeline for the implementation of the delineation and reclamation plan.
Once both plans are implemented and completed, please notify Gary Hudson to allow final inspection.

Did you guys receive a sediment and erosion control plan from Eddie Bunn for this site? I assume they did file for the farm exemption and if that has been granted, I'd still like your
thoughts on the sediment and erosion plan as we told them they had to submit that no matter the exemption from LQ.
Eddie sent me three copies of the delineation and reclamation plan but I did not get a copy of the sediment and erosion plan.

review and approval as part of the restoration activities for this violation site.
Placing a rip-rap headwall at the inlet end of the pipe will prevent the new fill from eroding in the event of a storm. Rip-rap on filter fabric is a better solution for this
stream than is a concrete headwall because of the adverse effect that new concrete has on aquatic life downstream. I will get back to you on this issue after I
discuss with my wetland/ stream speciaists.
I will be talking to Amanda Jones at the CORPS in Ashville tomorrow to start the process of the NWP 29 for the culvert and fill in the stream. I will advise you of the
results of that conversation.
Please advise that the landowner should begin the seeding, road culverts, and stream crossing stabilization as soon as practical. This will help to speed up the
process of complying with the statutes.

The date of the letter we sent out calling for a response was dated the 28th of May. We gave them 15 days to respond. If you count it as working days then their response should be due
about the 20th of June,
They have filed win LQ for AG exemption. Bottom line is that they will probably approve thus the violators would not have to obtain a sediment and erosion control plan nor our SW
permit,
I know Eddie Bunn has been on site shooting grades and preparing a plan. I want that plan one way or the other.
1 think its time for a curve ball. 1 think we need to resend the letter and indicate we are aware of their request for an Ag exemption. We should require that a sediment and erosion control
plan be submitted to our office for approval to stabilize the site in the disturbed areas. We would then approve the plan as part of the restoration efforts on the site. (Matt has agreed to
review the plan that is submitted and give us comments as to the acceptable nature of the plan). I want the road and the area on the hillside stabilized!
Lets discuss and get the second letter out quick and give them 15 more days to have the plan submitted along with the other items we had included in the initial letter.

I'm finally attaching these messages to the right project in Alleghany Co.
We have a hole here that really needs patching. One would think that if its a violation site and they had not submitted the exemption request before they started disturbing >1 acre, that
they would or could lose the opportunity for the exemption. This is a site that needs a plan and I think Neil would agree.
If I required them to get a plan as part of the WQ response to the violations and to get the plan approved and to implement the plan, would you be able to handle if it came in the door ??
If an activity needs a plan to be developed and to be implemented correctly, we do not have the expertise that you and your staff do in this area. I could wing it but 1'd be at the mercy of
their consultant or engineer.
Any thoughts?

Hey Steve,
Yes If they claim the agricultural exemption we have to let it go. This would not be the case if we had evidence of building permits, septic tank permits, subdivision plats, etc. The
exemption is sketchy at best, however we have to go by the "intended usage" of the property. Their "intent" at this time may be agriculture, but they could change their "intent" at any
time. The agricultural exemption form is for our records. If we catch them developing the property, we can use the form to potentially show ajudge that they were aware of the
requirements of the Sediment Act.
I hope this clears things up a bit. It is my understanding that they have the form are having it notarized at this time.
Please let me or Neil know if you have any knowledge of further development at the site and we'll take care of getting it in compliance with the Sediment Act.

Why would the road construction, the pond or the stream crossing fit the Ag exemption under 113A-52.01?
At least Forestry has to follow established BMPs to be exempt. Does ag have to follow anything relating to the Sedimentation Pollution Control Act?

The Division has not received the permit application fee that we require in order to process the wetlands/stream 401 permit application. We discussed
during my site visit that there was some confusion about the fee. Mr. Bunn originally sent in the appropriate $240 check, however we thought a higher fee
would be necessary and we returned the check to him requiring a fee of $570. After the site visit I verified that the $240 was the correct fee but since
we sent back the first check, we needed another one to replace it. We need the fee asap in order to process the 401 permit and approve the work to be done
to resolve the violation on your property.
