TROGDON, III SECRETARY SUBJECT: Nationwide Permit #14 Bridge No. 149 on Union Church Road (SR 2132) over a UT to Church Creek, Class C, Rowan County, NC, WBS Project No.: 17BP.9.R.62 Dear Mr. Lastinger, We are requesting a Nationwide 14 permit for replacement of Bridge No. 149 with a double barrel box culvert on Union Church Road (SR 2132) over a UT to Church Creek, Class C, Rowan County. I have attached a pre-construction notification application, a vicinity, soils, and topographical map with the project area called out, a stormwater management plan, a'No Survey Required' form for Historic Architecture, and a'No Historic Places or Archaeological Sites present or Affected' form for Archeological Resources, and a mitigation acceptance letter from Division of Mitigation Services (DMS). Also attached are the construction plans and the culvert survey report. The project will permanently impact 124 linear feet (61'-culvert, 63'-bank stabilization) and temporarily impact 10 linear feet (install bank stabilization) of a UT to Church Creek. Low stream flow will be isolated into one barrel, with 1' sills, and the culvert will be buried 1' below the stream bed to ensure aquatic passage. The high flow barrel will have 2' sills and floodplain benches constructed at the inlet and outlet of the culvert. The low flow barrel will be backfilled with material that is excavated from the stream or floodplain and may be supplemented with rip rap if needed. The high flow barrel will be backfilled with rip rap or native bed material of appropriate size to the sill elevation in order to expedite the establishment of a natural stream bed. The culvert site will be dewatered during construction in accordance with NCDOT's Best Management Practices. An overhead power line will be installed approximately 15 feet upstream and perpendicular to the inlet. No impacts to Waters of the US are proposed as a result of the utility installation. The USFWS lists Schweinitz's sunflower (Helianthus schweinitzii) as endangered and Northern Long-Eared bat (NLEB-Myotis septentrionalis) as threatened for Rowan County. There is summer roosting habitat in the existing bridge for the NLEB. Anticipated tree clearing impacts for this project are estimated to be 0.20 acres. We determined that the project `May Affect but is Not Likely to Adversely Affect' the NLEB. A NLEB Screening checklist is attached. Thus, for the proposed action, NCDOT has committed to the conservation measures listed below: 1) No alterations of a known hibernaculum's entrance or interior environment if it impairs an essential behavioral pattern, including sheltering Northern long-eared bats (January 1 through December 31); 2) No tree removal within a 0.25 mile radius of a known hibernacula (January 1 through December 31); and 3) No cutting or destroying a known, occupied maternity roost tree, or any other trees within a 150-foot radius from the known, occupied maternity tree during the period from June 1 through and including July 31. NCDOT has determined that the proposed action does not require separate consultation on the grounds that the proposed action is consistent with the final Section 4(d) rule, codified at 50 C.F.R. § 17.40(0) and effective February 16, 2016. Section 7 responsibilities are therefore considered fulfilled. Bald Eagles are protected under the Migratory Bird Treaty Act and the Bald and Golden Eagle Protection Act. A field survey of the project study area was conducted on September 25th, 2014. No species or nests were observed. Therefore, this species will not be impacted as a result of project construction. By copy of this letter, we also request 401 review and approval from the NC Division of Water Resources with one copy of the application package provided to Amy Chapman, Transportation Permitting Unit Supervisor, and Dave Wanucha, DOT Project Coordinator. Please charge the application fee of $240 to WBS Project No. 7BP.9.R.62. By copy of this letter, we also request Marla Chambers, NC Wildlife Resources Commission, to comment directly to the Corps concerning the permit request. The proposed project will remove and replace a structurally deficient bridge and replace it with a double box culvert. Roadway approach work is minimized as much as is practical to reduce the overall project footprint. An off-site detour will be employed to avoid the need for a temporary parallel structure. The proposed culvert slope is 0.80°/a, matching the existing stream bed slope of 0.80%. Native bed material shall be placed between the sills in the culvert to provide a continuous low flow channel. Further justification is provided in the stormwater management plan. Bank stabilization will be minimized to those areas where deemed necessary. 1 b. As defined by the NCDOT, the survey area (Area of Potential Effects [APE]) for archaeology measures approximately 300 feet (91.44 m) from either end of Bridge No. 149. The corridor is approximately 150 feet (45.72 m) wide, extending 75 feet (22.86 m) on each side of SR 2132 from its present centerline. A map review and site file search conducted by NCDOT on 1 December 2014 revealed that no previously recorded archaeological sites have been identified within a mile of the APE. A search of the North Carolina State Historic Preservation Office online database (HPOWEB GIS Service) revealed no previously recorded historic architectural resources within the APE that have the potential to yield intact archaeological deposits. Topographic maps, aerial photography, United States Department of Agriculture (USDA) soil survey maps, and historic maps were examined for information on natural or cultural factors that might have affected site location or preservation. The c. 1910 Rural Delivery Routes map and 1914 Soil Survey map for Rowan County show no bridge or road in the project vicinity. It appears that at this time, the northern portion of Union Church Road ended north of a tributary at what is now William Drive (Figures 3 and 4). By 1930, Union Church Road (listed as an improved gravel road) connected to Stokes Ferry Road to the south. No structures are depicted within the APE on any of these maps. The APE consists of a wooded and clearcut area. Bridge No. 149 and Union Church Road cross an unnamed tributary, which drains east into Church Creek within the Yadkin-Pee Dee River Basin. Map units (soil series) are named for the major soil or soils within the unit, but may have minor inclusions of other soils (NRCS 2013). The soil units mapped within the APE are listed in Table 1. The narrow floodplain within the APE is composed of Chewacla loam, a nearly level, somewhat poorly drained soil series. The majoriry of the APE's side slopes and terraces are made up of Enon fine sandy loam (EnB and EnC). A typical soil profile for this well drained soil series consists of up to 20 centimeters of fine sandy loam over less than 10 centimeters of sandy clay loam. Clay subsoil is rypically encountered at depths around 25 centimeters below surface. Most of the northeastern quadrant is mapped as well drained Mecklenburg loam (MdB). A typical soil profile for this series consists of around 20 centimeters of loam over clay subsoil. Photographs of the project area are shown as Figures 5-9. A systematic visual inspection of the APE was undertaken to search for surface artifacts, above-ground resources, or other signs of cultural activity. Surface visibility was generally poor due to ground cover and existing vegetation; however, surface erosion in the northeastern and southeastern quadrants of the APE provided moderate surface visibility. A visual inspection revealed no surface artifacts or other signs of cultural activity. Evidence of modern dumping (couches, television set, and other modern debris) was observed along an adjacent drainage ditch in the northwestern quadrant. The northeastern and southeastern quadrants consisted of gently sloping, overgrown clearcut areas. Evidence of former timbering activities was observed (tire ruts and trails), and moderate surface erosion was visible. A total of 12 shovel tests were excavated within the APE (three shovel tests within each of the four quadrants of the APE). Shovel testing within the northwestern quadrant (Shovel Test [STs] 95, 96, and 97) revealed up to 20 centimeters of dark yellowish brown sandy loam over reddish yellow or reddish brown clay. Soils in the shovel tests within the southwestern quadrant (STs 98, 99, 100) consisted of 20 centimeters of brown or dark olive brown sandy loam over reddish yellow or reddish brown clay. Shovel testing within the southeastern quadrant (STs 101 and 102) revealed up to 20 centimeters of disturbed dark olive brown or dark brown loam or clay loam and rock over dark reddish brown clay. ST 103, excavated in the northern portion of the southeastern quadrant (near the creek) contained 30 centimeters of dark yellowish brown sandy loam over a light yellowish brown clay. STs 104-106 were excavated in the northeastern quadrant of the APE. Soils in this portion of the APE were eroded; shovel testing revealed reddish yellow clay just below the leaf litter. Shovel tests measured 30 centimeters in diameter and were excavated to sterile subsoil. All soils were excavated by natural levels (soil strata) and screened through a 0.25-inch hardware mesh. No artifacts were recovered from any of the shovel tests. Based on the results of the background research and field investigations, no archaeological resources are located within the APE for Bridge No. 149 in Rowan County. It is recommended that this project be allowed to proceed without concern for impacts to significant cultural resources.
