Narrative Description:
The property is located adjacent to Upper Broad Creek at the end of Finch Lane near Bridgeton,
Craven County. This area of the Quail Woods subdivision is currently undeveloped, save a
unimproved and unpaved access road. The adjacent surrounding properties are similarly
undeveloped.
The elevation of the high ground of the parcel is about 5' above the normal water level (nwl).
Vegetation on the parcel mainly consists of native deciduous trees and wetland plant species. There
are Coastal Wetlands on either side of the project area. The 50 -acre parcel has approximately 1,480'
of continuous shoreline combined along Upper Broad Creek. Immediate offshore water depths
adjacent to the parcel range from —2' to —7' normal water level (NWL). The subaqueous substrate is
firm without shell.
There is not a cultural resource in the nearby vicinity of the project area. This waterbody is
approximately 110' across at this location. These joint waters are not classified as a Primary Nursery
Area. Submerged aquatic vegetation is present at this location. This area is closed to shellfish harvest
and is classified as SC; Sw; Nutrient Sensitive Waters. There is not a defined Federal Channel in the
nearby vicinity of this project area. This project area is subject to the Neuse River Riparian Buffer
Rules.
Proposed Development:
The applicant wishes to construct a concrete boat ramp and a 7 -slip docking facility adjacent to Upper
Broad- Creek; near Bridgeton. The proposed development would take place -on -the Quail Woods
subdivision's community property at the end of Finch Lane, Craven County. The proposed
development would serve this private community.
The proposed concrete boat ramp would be 14' wide and a total of 82' long (1,148 ft), including the
approach from Finch Lane. The boat ramp would extend approximately 8' waterward of the normal
water level (nwl) to connect to water depths (-4.8' nwl). On either side of the boat ramp, side -to
docks are being proposed. The west dock would have two designated wet slips and the east dock
would have five designated wet slips. The proposed orientation of the docks would be to extend 10'
waterward of the edge of the Coastal Wetlands, Juncus roemerianus, and then run parallel to the
shoreline in the opposite direction of the boat ramp. The west dock would be 6' wide and 110' long.
The east dock would be 6' wide and 253' long. The seven side -to boat slips would serve vessels up to
25' in length. There are no outer tie pilings proposed. No other marine services would be provided.
Traditional marine construction techniques would be utilized. The high ground would be cut to attain
the necessary slope to support the boat ramp. The boat ramp concrete slab would be formed on high
ground above the nwl and then pushed into place with a dozer after it has cured for a period of 21
days. The dock pilings would be set with a pile driver. No shoreline stabilization is proposed.

Anticipated Impacts:
The proposal will not pose a hazard to navigation. The proposed docking facility will extend 16'
waterward into the 110' wide section of Upper Broad Creek. The proposed boat ramp will impact
119 square feet of submerged aquatic vegetation habitat and 8,061 square feet of high ground.
Traditional marine construction methodology will be utilized during the construction of this
project. Traditional silt fencing will be used for sedimentation and erosion control. Minimal
temporary turbidity impacts are anticipated during construction.
There is not a cultural resource in the nearby vicinity of the project area. This project area is
subject to the Neuse River Riparian Buffer Rules. These waters of Upper Broad Creek are not
classified as a Primary Nursery Area and the presence of submerged aquatic vegetation was
observed. This area is closed to shellfish harvest and is classified as SC; Sw; Nutrient Sensitive
Waters. There is not a defined Federal Channel near the project area.

No waste water treatment facility is being proposed for the boat ramp. On-site subsurface disposal with individual septic
tanks and drain fields are utilized within Quail Woods Subdivision.

Storm water for Quail Woods, Phase 2, Sections 1 through 5 is collected via a series of swales and discharged into swales

The boat ramp will be a part of the Common Area available to the residents of Quail Woods Subdivision. The boat ramp and
dock spaces will provide residents a point of access into Broad Creek for launching and recovering water craft.
c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type
of equipment and where it is to be stored.
The boat ramp will be constructed by installation of a temporary coffer dam and pier will be installed by pile driver. Additional
construction equipment includes one excavator, one dozer, one backhoe, one motor grader and four dump trucks. Erosion
control measures will be installed as the first activity prior to beginning construction. The project will have seeding equipment
to temporarily and permanently install vegetation. Dewatering equipment may be necessary for installation of the boat ramp.
d. List all development activities you propose.
Construction of a boat ramp into Broad Creek that will be a part of the Common Area only available to the residents of Quail
Woods Subdivision. The boat ramp will have a pier access to the water and boat docking space for use during loading and
unloading of watercraft.

Attached for review are plans and a CAMA Major Permit Application for the Quail Woods Subdivision
Boat Ramp. The proposed boat ramp will serve as an amenity for property owners of Quail Woods
Subdivision. The ramp will provide land owners a point of access into Broad Creek for launching and
recovering water craft. Dock spaces will provide boat parking during launch and recovery.
The proposed boat ramp area is within the common area and is located at the north end of the site,
containing 362,091 sft. Upon consulting with NCDENR, it was determined a CAMA Major
Development Permit is required for construction of the boat ramp and docking spaces. A scoping meeting
was held at the DENR office in Washington, NC. During the meeting, it was suggested that a Submerged
Aquatic Vegetation Survey be conducted and current water depths be verified. A Submerged Aquatic
Vegetation (SAV) Survey, completed by Land Management Group, Inc. is included with this application.
SAV survey noted no significant impacts. Current water depths were surveyed by Baldwin Design
Consultants, PA and are shown on the Boat Ramp plan sheet.
Proposed uplands areas to be disturbed for boat ramp construction are included within the limits of
construction shown on plans for Quail Woods Subdivision, Phase 2, Sections 1 through 5. A copy of the
erosion control permit is included with this CAMA Major Development Permit Application.
The boat ramp will be installed by installation of a temporary coffer dam and the pier will be installed by
pile driver. Typical construction equipment will be utilized, including dump trucks, excavators, dozers,
motor graders, front end loader, backhoe and pile driver.

this property inspected to determine the extent of Department of the Army (DA) jurisdiction. To be considered final, a
jurisdictional determination must be verified by the Corps. This preliminary determination is not an appealable action
under the Regulatory Program Administrative Appeal Process ( Reference 33 CFR Part 331).
B. Approved Determination
There are Navigable Waters of the United States within the above described property subject to the permit requirements of
Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act. Unless there is a change in the law or
our published regulations, this determination may be relied upon for a period not to exceed five years from the date of this
notification.

suggest you have this delineation surveyed. Upon completion, this survey should be reviewed and verified by the Corps.
Once verified, this survey will provide an accurate depiction of all areas subject to CWA jurisdiction on your property
which, provided there is no change in the law or our published regulations, may be relied upon for a period not to exceed
five years.

Dear Sir:
This office has reviewed the subject erosion and sedimentation control plan. We find the plan to be
acceptable and hereby issue this Letter of Approval with Modifications. The modifications required
for approval are listed on the attached page. This plan approval shall expire three (3) years following
the date of approval, if no land -disturbing activity has been undertaken, as required by 15A NCAC
4B.0129, unless modified by other legislation.
Please be advised that 15A NCAC 4B.0118(a) requires that a copy of the approved erosion and
sedimentation control plan be on file at the job site. Also, you should consider this letter as giving the
Notice required by G.S. 113A-61. l (a) of our right of periodic inspection to ensure compliance with
the approved plan.
North Carolina's Sedimentation Pollution Control Program is performance oriented, requiring
protection of existing natural resources and adjoining properties. If, following the commencement of
this project, it is determined that the erosion and sedimentation control plan is inadequate to meet the
requirements of the Sedimentation Pollution Control Act of 1973 (G.S. 113A-51 through 66), this
office may require revisions to the plan and implementation of the revisions to ensure compliance with
the Act.
Acceptance and approval of this plan is conditioned upon your compliance with Federal and State
water quality laws, regulations and rules. In addition, local city or county ordinances or rules may

waters (Intermittent streams, perennial streams, lakes, ponds and estuaries) in the Neuse River Basin.

Please be aware that your project will be covered by the enclosed NPDES General Stormwater

1. AS THE DECLARED RESPONSIBLE PARTY, YOUR LEGAL RESPONSIBILITY is
to understand the Act and comply with the following minimum requirements of the Act:
A. In the event of a conflict between the requirements of the Sedimentation Pollution
Control Act, the submitted plan and/or the contract specifications, the more restrictive
requirement shall prevail;
B. The land disturbing activity shall be conducted in accordance with the approved
erosion and sedimentation control plan;
C. The LATEST APPROVED erosion and sediment control plan will be used during
periodic unannounced inspections to determine compliance and a copy of the plan
must be on file at the job site. If it is determined that the implemented plan is
inadequate, this office may require the installation of additional measures and/or that
the plan be revised to comply with state law.
D. All site revisions, including those required by other local, state or federal agencies, .
which affect site layout, drainage patterns, limits of disturbance and/or disturbed
acreage must be submitted to this office for approval a minimum of 15 day prior
implementing the revision;
E. Revisions exceeding the approved scope of this project without this office's prior
approval of the plan showing the changes can be considered a violation. Failure to
comply with any part of the approved plan or with any requirements of this program
could result in appropriate legal action (civil or criminal) against the financially
responsible party. Legal actions could include Stop Work Orders, the assessing of a
civil penalty of up to $5000 for the initial violation and/or a civil penalty of up to
$5000 per day for each day the site is out of compliance.
F. The CERTIFICATE OF PLAN APPROVAL must be posted at the primary
entrance to the job site and remain until the site is permanently stabilized
G. In cases of natural disaster related changes to the proposed land disturbing activity, all
appropriate actions and adequate measure installations may be performed to prevent
sediment damage, prior to submitting and receiving approval of the revised plan. A
revised plan must be submitted for approval as soon as possible, but no later than 15
days after all emergency actions have been performed;

H. Erosion and sediment control measures or devices are to be constructed and/or
installed to safely withstand the runoff resulting from a 10 year storm event (25 year
storm event in High Quality Zones). The 10 year storm event is generally equivalent
to a storm producing 6.5 - 7 inches in 24 hours or at the rate of 6.5 - 7 inches in 1
hour, depending on the location of the project within the region;
I. No earthen material is to be brought on or removed from the project site, until the off-
site borrow and/or disposal sites are identified as part of the erosion control plan. If
an off-site borrow and/or disposal site is to be utilized, submit the name and
identification number (E&SCP# or Mme Permit #), prior to use.
J. A buffer zone, sufficient to restrain visible sedimentation within the 25% of the width
closest to the land disturbance, must be provided and maintained between the land -
disturbing activity and any adjacent property or watercourse.
K. In order to comply with the intent of the Act, the scheduling of the land -disturbing
activities is to be such that both the area of exposure and the time between the land
disturbance and the providing of a ground cover is minimized.
L. Unless a temporary, manufactured, lining material has been specified, a clean straw
mulch must be applied, at the minimum rate of 2 tons/acre, to all seeded areas. The
mulch must cover at least 75% of the seeded area after it is either tacked, with an
acceptable tacking material, or crimped in place.
M. New or affected cut or filled slopes must be at an angle that can be retained by
vegetative cover or other adequate erosion -control devices or structures appropriate,
AND must be provided with a around cover sufficient to restrain erosion within
21 calendar days of completion of any phase (rough or final) of grading
(ANNUAL RYE GRASS IS NOT in the APPROVED seeding specifications NOR
is it an ACCEPTABLE substitute for the providing of a temporary ground cover).
N. A permanent ground cover, sufficient restrain erosion, must be provided within the
shorter of 15 working or 90 calendar days (if in a High Quality Zone, the shorter of
15 working or 60 calendar days) after completion of construction or development on
any portion of the tract (ANNUAL RYE GRASS IS NOT in the APPROVED
seeding specifications NOR is it an ACCEPTABLE substitute for the providing of a
nurse cover for the permanent grass cover).

The Washington Regional Office received a complete Stormwater Management Permit
Application for the Quail Woods Subdivision, Phase 2 project on March 11, 2014. Staff
review of the plans and specifications has determined that the project, as proposed, will
comply with the Stormwater Regulations set forth in Session Law 2008-211. and Title 15A
NCAC 2H.1000. We are forwarding Permit No. SW7140304 dated April 30, 2014, for the
construction of the subject project.
This permit shall .be effective from the date of issuance until. rescinded and shall be subject
to the conditions and limitations as specified therein, and does not supercede any other
agency permit that may be required.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have
the right to request an adjudicatory hearing upon written request within thirty (30) days
following receipt of this permit. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office
of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. Unless
such demands are made this permit shall be final and binding.

FOR THE
construction, operation and maintenance of a 24% low density subdivision in compliance
with the provisions of Session Law 2008-211 and 15A NCAC 2H.1000 (hereafter referred to
as the "stormwater rules') and the approved stormwater management plans and
specifications, and other supporting data as attached and on file with and approved by the
Division of Water Quality and considered a part of this permit.
The Permit shall be effective from the date of issuance until rescinded and shall be subject
to the following specific conditions and limitations:
I. DESIGN STANDARDS
Each of the 80 lots is limited to a maximum square feet of built -upon area as shown
on the attached list, as indicated in the application and as shown on the approved
plans.
2. The overall tract built -upon area percentage for the project must be maintained at
24% per the requirements of Session Law 2008-211 and Section .1005 of the
stormwater rules.
3. The built -upon areas associated with this project shall be located at least 50 feet
landward of all perennial and intermittent surface waters.
4. The only runoff conveyance systems allowed will be vegetated conveyances such as
swales with minimum side slopes of 3:1 (H:1) as defined in the stormwater rules and
approved by the Division.
5. All roof drains must terminate at least 50 foot from the mean high water mark.

11. SCHEDULE OF COMPLIANCE
1. - Swales� and other -vegetated conveyances shall be constructed in their entirety,
vegetated, and be operational for their intended use prior to the construction of any
built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the
swales or other vegetated conveyances will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance necessary to
operate the permitted stormwater management .systems at optimum efficiency to
include:
a. Inspections
b. Sediment removal.
C. Mowing, and re -vegetating of the side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and
specifications.
f. Maintenance of level spreaders and infiltration areas in accordance with
approved plans and O&M documents.
4. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed below:
a. Any revision to any of the items shown on. the approved plans, including the
stormwater management system, design concept, built -upon area, details, etc.
b, Project name change.
c. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, or selling of the project area.
f. Filling in, altering or piping any vegetative conveyance shown on the approved
plan.
5. The permittee shall submit all information requested by the Director or his
representative within the time frame specified in the written information request.
6. No piping shall be allowed except that minimum amount necessary to direct runoff
beneath an impervious surface such as a road and that minimum amount needed
under driveways to provide access to lots.
7. Within 30 days of completion of the project, the permittee must certify in writing that
the project's stormwater controls, and impervious surfaces have been constructed
within substantial intent of the approved plans and specifications. Any deviation from
the approved plans must be noted on the Certification.
8. The permittee is responsible for verifying that the proposed built -upon area does not
exceed the allowable built -upon area. Once the lot transfer is complete, the built -
upon area may not be revised without approval from the Division of Water Quality,
and responsibility for meeting the built -upon area limit is transferred to the individual
property owner, provided that the permittee complies with the requirements of
Section 11.11 and 11.12 of this permit.

9. Deed restrictions are incorporated into this permit by reference and must be recorded
-with.the Office -of the, Register of Deeds prior to the sale of any lot. Recorded deed
restrictions must include, as a minimum, the following statements related to
stormwater management:
a. The following covenants are intended to ensure ongoing compliance with
State Stomnwater Management Permit Number SW7140304, as issued by the
Division of Water Quality under NCAC 2H.1000.
b. The State of North Carolina is made a beneficiary of these covenants to the
extent necessary to maintain compliance with the Stormwater Management
Permit.
C. These covenants are to run with the land and be binding on all persons and
parties claiming under them.
d. The covenants pertaining to stormwater may not be altered or rescinded
without the express written consent of the State of North Carolina, Division of
Water Quality.
e. Alteration of the drainage as shown on the approved plans may not take place
without the concurrence of the Division of Water Quality.
f. The maximum built -upon area per lot is (see attachment) square feet. This
allotted amount includes any built -upon area constructed within the lot
property boundaries, and that portion of the right-of-way between the front lot
line and the edge of the pavement. Built upon area includes, but is not limited
to, structures, asphalt, concrete, gravel brick, stone, slate, and coquina, but
does not include raised, open wood decking, or the water surface of swimming
ppools.
g. Fillingin or piping of any vegetative conveyances (ditches, swales, etc.)
associated with the development except for average driveway crossings, is
strictly prohibited by any persons.
h. Each lot will maintain a 50 foot wide vegetated buffer between all impervious
areas and surface waters.
L All roof drains shall terminate at least 50 foot from the mean high water mark.
j. If permeable pavement credit is desired, the property owner must submit a
request, with supporting documentation, to the permittee and receive approval
prior to construction of the permeable pavement.
10. The permittee shall submit a copy of the recorded deed restrictions within 30 days of
the date of recording.
11. If the permittee sets up an Architectural Review Committee or Board (ARC or ARB)
to review plans for compliance with the restrictions, the plans reviewed must include
all proposed built -upon area (BUA). Any approvals given by the ARC or ARB do not
relieve the lot owner of the responsibility to maintain compliance with the permitted
BUA limit.
12. Allstormwater conveyances will be located in either dedicated right-of-way (public or
rivate), recorded common areas or recorded drainage easements. The finai plats for

13. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in
the notice, the permittee shall submit a written time schedule to the Director for
modifying the site to meet minimum requirements. The permittee shall provide
copies of revised plans and certification in writing to the Direct o��VIVED-

14. If permeable pavement credit is desired, the permittee must submit a request to
_ modify the permit to incorporate such language, as required_ by the Division of Water
Quality. The- request -to modify must include a soils report identifying the type of soil,
the Seasonal High Water Table -elevation and the infiltration rate. Upon the
successful completion of a permit modification, the individual lot owners that request
to utilize permeable pavements must submit the necessary forms and documentation
to the permittee and receive approval prior to construction of the permeable
pavement.
III. GENERAL CONDITIONS
1. This permit is not transferable to any person or entity except after notice to and
approval by the Director. The Director may require modification or revocation and re -
issuance of the permit to change the name and incorporate such other requirements
as may be necessary. In the event of a name or ownership change, a completed
Name/Ownership Change form, signed by both parties, must be submitted to the
Division of Water Quality accompanied by the supporting documentation as listed on
page 2 of the form. The approval of this request will be considered on its merits, and
may or may not be approved.
2. The permittee is responsible for compliance with all permit conditions until the
Director approves a transfer of ownership. Neither the sale of the project nor the
transfer of common areas to a third party, such as a homeowner's association,
constitutes an approved transfer of the stormwater permit.
3. Failure to abide by the conditions and limitations contained in this permit may subject
the Permittee to an enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statutes 143-215.6A to 143-215.6C.
4. The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit as
allowed by the laws, rules, and regulations contained in Session Law 2008-211, Title
15A of the North Carolina Administrative Code, Subchapter 2H.1000; and North
Carolina General Statute 143-215.1 et. al.
5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including
those as may be required by the Division, such as the construction of additional or
replacement stormwater management systems.
6. The permittee grants permission to DENR Staff to enter the property during normal
business hours, for the purpose of inspecting all components of the stormwater
management facility.
7. The permit issued shall continue in force and effect until revoked or terminated. The
permit may be modified, revoked and reissued or terminated for cause. The filing of a
request for a permit modification, revocation and re -issuance, or termination does not
stay any permit condition.
B. Unless specified elsewhere, permanent seeding requirements for the swales must
follow the guidelines established in the North Carolina Erosion9 _K4&ntrol
Planning and Design Manual.

9. Approved plans and specifications for this project are incorporated by reference and
are enforceable parts of the permit.
10. The issuance of this permit does not preclude the Permittee from complying with any
and all statutes, rules, regulations, or ordinances, which may be imposed by other
government agencies (local, state and federal), which have jurisdiction.
11. The permittee shall notify the Division in writing of any name, ownership or mailing
address changes at least 30 days prior to making such changes.
