Replace Bridge No. 21 on SR I501 (Hunting Country Road)
N. Pacolet River, Polk County, North Carolina
WBS Element No. 17BP.14.R.141
Dear Ms. Beckwith:
J.antes H. TxocoOrr, III
SECRETARY
The Noi1h Carolina Department of Transpo4ation (NCDOT) is replacing the subject 3-span
timber deck on steel beam bridge with a 3-span (1 @ 40'L, Ir 55'L, 1 30'L) cored slab
bridge. The bridge will be replaced on location using staged construction. This will require
temporary impacts to the Noth Pacolet River in the form of a impervious dike and pennanent
impacts to the river for rip rap stabilization near the stucture supports. This project was
originally developed under the Low Impact Bridge program.
Please find enclosed a PCN application, preliminary jurisdictional determination form, Section
106 screening forms, maps, plan sheets, photographs, and otlier supporting project information.
Dvarf-flowered heartleaf (Hexasrylis nmiorn), white irisette (Sisyrinclrimn dicholonurnt), and
northern long-eared bat (NLEB, Myotis septenh•ionnlis) are the federally-listed species that have
current records in Polk County.
According to the USFWS, dwarf-flowered heartleaf habitat is typically "acidic soils along bluffs
and adjacent slopes, in boggy areas next to sheams and creek heads, and along the slopes of
nearby hillsides and ravines." Because of stage consh•uction and a 90° degree skew, most
disturbances for the bridge replacement will be within or near tlie existing maintained right-of-
way. These areas are mostly covered with thick herbaceous and slulib vegetation that would not
be ideal for lieatfea£ Dwarf-flowered heartleaf plants were not observed during site visits.
Wlite irisette habitat includes mid-elevation slopes with open dry to mesic oak-hickory forest,
typically on rocky steep terrain with shallow neutral to basic soils. This plant favors disturbed

areas such as road edges. The area near the bridge is poorly suited for white irisette because it is
at a low elevation, not on a slope with appropriate soil conditions, and has deuse undeistory
vegetation. And, this plant was not seen during site visits.
NLEB are known to roost in caves and mines in winter and, in summer, on trees with sloughing
bark or on structures, including concrete bridges Hiat retain heat. The esisting bridge is a low
timber structure tlat should be too cool for bat roosting. During the field scoping and subsequent
site visits, we did not see any evidence that bats were using the bridge for roosting (i.e. staining or
guano). There will be drilling and pile driving associated with the project, but there are no caves
visible nearby and no underground mines within several miles according to USGS data. This
project will require the removal of approsimately 6 trees, but none of the trees appear to be
suitable for bat roosts. Moreover, there are no "red HUCs" for NLEB hibernacula or matemity
roost sites in Polk Cotmty and the nearest "red HUC" is about l0 miles north of the project HUC
in Henderson County.
The project is limited in scope to the replacement of a bridge with a bridge on an existing
roadway alignment. Erosion and sedimentation control measures will be used to minimize
adverse effects of the work on aquatic liabitats. Habitats for listed species are lacking at the
project site and none of these species were observed during field visits. For these reasons and
those discussed above, we recommend tlat a determination of "no effecY' on listed species apply
to this project.
This project was reviewed by NCDOT's Human Environment Unit in 2012 for potential effects to
historical architechire and archaeology. Surveys were not equired (see attaclied forms).
NCDOT best management practices will be used to miniinize and control sedimentation and
erosion. The constvction foreman will review all measures daily to ensure erosion and
sedimentation are being effectively controlled. Poorly functioning devices vill be maintained
quickly.
Impacts to Waters of the United States
North Pacolet River (DWQ Class: C) is shown on the USGS topographic map as a peremiial
stream and has a channel approximately 30' wide witli a sand bed. The North Pacolet River
flows into South Carolina where it eventuallyjoins the Broad River, wlich meets the definition of
a Traditional Navigable Water. For these reasons, we believe North Pacolet River is a Relatively
Pemanent Water and is under tle jurisdiction of the U.S. Army Corps of Engineers.
Replacement of the bridge vitl another bridge will result in impacts to waters of the United
States as listed in the table below:

"pre-construction notification" (PCN), or requests verification for a non-reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and
that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation being required or different special conditions; (3) that
the applicant has the right to request an individual permit rather than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicanYs acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters of the United States, and precludes any challenge to
such jurisdiction in any administrative or judicial compliance or enforcement
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or
to provide an official delineation of jurisdictional waters on the site, the Corps will
provide an approved JD to accomplish that result, as soon as is practicable.
This preliminary JD finds that there "may be" waters of the United States on the
subject project site, and identifies all aquatic features on the site that could be
affected by the proposed activity, based on the following information:

SUMMARY OF CULTURAL RSOURCES REVIW
Brrejdescription of revietiv aclivities, resulls of review, and conclusions: HPOWeb reviewed on 5
September 2012 and yielded no NR, SL, LD, DE, or SS properties fn the Area of Potential Effects (APE).
Polk County current GIS mapping, aerial photography, and tax information indicated a partly wooded APE
with cleared resfdential paroels containing late-twentieth- and early-twenty-first-century buildings (viewed
5 September 2012). Constructed in 1969, Bridge No. 21 is neither included in the NCDOT Historic Bridge
Survey, nor representative of any distinctive engineering or aesthetic type. Google Maps "Street View"
confirmed absence of critical historic structures/landscapes in APE (viewed 5 September 2012).
No architecturai survey is required for the project as currently defined.
BriefExplatation of iv/ry dre mnilab/e inforuatiae proviles a reliable bnsrs for reasonably predrGing
tlrnt tlrere nre no unidenlified hista•ic properries ir !he dPL: APE extends 500 feet from either end of the
existing bridge (SW-NE) and 100 feet to either side of the SR 1501 (Hunting Country Road) centerline
(NW-SE) to encompass proposed mnstruction activities. County GIS/tax materials and other visuals
support the absence of significant architectural resources. No National Register-listed or other critical
properties are located within the APE, including the Federal permit area.
Should any design elements, includfng detour improvements, of the project change, please
notify NCDOT Historic Architecture as additional review may he necessary.
