Cumulative wetland impacts are still under 1/3 acre, so wetland mitigation is up to the Corps. If we were approving it, I'd have the following comments: 1. The mitigation plan involves restoration of non-riparian wetlands. Most of the impacts are adjacent to streams, indicating that they are likely riparian. The mitigation plan may not satisfy DWQ's 1:1 restoration or creation requirement for in-kind wetlands, even though there are many acres of riparian preservation. 2. The applicant's request to remove the words "in perpetuity" from the restrictive covenant (page 1, paragraph 2) is a concern. 3. No planting is proposed in the restoration area because it is already wooded. I would recommend planting on the filled ditch, and possibly supplemental planting of desirable species, depending on a more complete description of the current community. 4. Hydrology criteria are good, although the location of the reference well isn't specified (I think I'm missing some maps in my copy of the plan). Thanks for keeping us in the loop further input.
