This letter rs in respanse ta your letter of December fi, 2016 which provided tho U.�. Fish and Wildlife
Service �Service) with the biological conclusion ofthe hlorth Carolina Department of Transportatian
(NCDOTj that ihe replacement of Bridge No. 34QtQ7 on SR 14I3 aver Devils Cradle Creek in Fran�Clin
County (TIP NQ. B-5330) may affect, but is not likely to adversely affect tbe federally endangered t�w�rf
wedgemusset (Attzcn:idor2ta heteradon). In addiEion, NCDQT has determined tttat the project witl have no
effect vn the f�deraliy endangered Tar River spinymussel (Etliptia steinstansana} and Michaux's sumac
(Rhus nrirhauxir�. The following response is provided in acc�t�r�ce with Section 7 ofthe Endangered
Species Act (ESA) of 1973, as amended {16 U.S.C. 1531-1543).
Based an informatian submitked, a tnussel survey was eonducted at the project site on March 3U, 241 b.
No federally listed mussels were observed durin� the survey, and it was determined that no suitabte
habitat was present for the Tar River spinymussel, Based on the survey resuits and other available
infonnatiQn, the Service concurs with yo�r t�io#ogica! eonelusion that the praject may affect, but is not
tikely to adversely affect the dwarf wedgemussel. We also concur with yaur conclusian that the �roject
will have no effect an the Tar River spiny�ussel.

Accardin� to inforrnation pravided, a plant survey was condueted at the project site on Apri129, 20l 6.
No specimens of Michaux's sumac were observed. Based on the survey results and ather available
information, the Service concurs with your biological conctusion that the praject witl �iave no effect on
Michaux's sumac. The federally threatened northern long-eared bat {Myotis septe�ttrionatis} h�.s been
previously addressed throu�h a programmatic f�rmal Sectian 7 cansultation.
We believe that the requirements af Sectian ?(a)(2} of the ESA have been satisfied, We remind you that
obtigations under Seetion 7 consultatian must be reconsider� �f: (1} new information reveals impacts of
this identified Action that may affect listed species or ecitical ha'�itat in a manner not previously
�ansidered in tl�is review; (2} this xction is subse�{ueatiy modifted in a manner that was nat considered in
this review, or (3) a new species is lis�ed or critical habitAt determined that may be affected by this
identified action. The Service appreciates the oppartunity ta review this project. If you have any
