Hi Brad,
DCM has received and considered NCDOT's request for a three week relief from the in-water work moratorium on the B-
47226 project on US 70 over North River. After consultation with the other relevant permitting and commenting
agencies, DCM has determined that a one-time relief of three weeks is appropriate at this time. In-water work may
continue on the project until March 7, 2016, at which time all in-water work must stop until after the moratorium end
date of September 30. No additional relief will be granted based on the use of bubble curtains. Please consider this
email as authorization from DCM to proceed with in-water work on the project until March 7, 2016. Although I have
communicated with the USACE and the NCDWR representatives on this topic and believe them to be in general
agreement, you must secure authorization from them directly to alter the moratorium requirements of their permits as
well, as they each list the moratorium as a condition of their respective permits. Please let me know if I may be of any
further assistance with this project.

This is to request an extension of the time allowed for in water work on the above project. An extension
of three weeks would allow significantly more work to be performed during the moratorium. We would
be able to complete Bents 1, 2, 3, 12, 13 and 14. Also if a decision is made soon enough on the
recoating of the sheet pilling, we may also be able to install enough sheeting to construct End Bent 1
and some coping.
One option we would like to suggest for continuing work further into the moratorium would be to utilize
a bubble curtain to minimize the sound and vibrations from the pile driving activities. This solution has
been utilized extensively in California and is also currently being used on the Tappan Zee bridge in New
York. This system has allowed for pile driving to continue during traditional moratorium periods. We
would propose to encapsulate the area with turbidity curtain and then install the bubble curtain system
inside of the turbidity curtain. We feel this would be a great test project and if successful could be of
great benefit to the department in cost and time savings on future projects.
