A summary of the findings and comments noted during the inspection are provided in the enclosed copy of the inspection report. The Compliance Evaluation. inspection was conducted by Division of Water Resources staff from the Washington Regional Office. The following violation was noted during the inspection: %nspection Area Description of Violation Effluent Pipe After heavy rains occurring the evening of August 8 and morning of August 9, 2016, it was discovered by Weyerhaeuser staff that the soil above and around the outfall pipe had collapsed and created a -sink hole above and around the outlet pipe causing a breach of the pond, bank around the concrete outlet structure allowing for the sediment basin and stormwater :to quickly drain out around structure and through the breach. The sediment basin rapidly drained allowing excessive amounts of stormwater and sediment to drain out of the pond, down the length of the outfall ditch'and into the receiving stream, a UT to Swift Creek. It is was discovered later that the bottom of outlet pipe had rusted out and over time allowed soil to wash away from the pipe. After enough soils had washed away overtime and with the excessive rain weighing the remaining soils down, a sink hole above the pipe occurred, thereby causing the breach in the sediment pond wall. State of North Carolina 'I Environmental Qu-aliiy l Water Resources 2521946-6481 Pond Bank The banks around the sediment pond was found to have an excessive amount of woody 'vegetation. Sediment Accumulation An excessive amount of sediment was visible within the stormwater basin to an extent that r there is a sediment mound within the basin that is equal to the discharge elevation within the outlet structure. Sediment has accumulated within the basin to the extent that proper settling of stormwater contaminants cannot occur. In addition, the issues below must also be addressed: compliance Issue(s).. 1) The breach around the effluent pipe must be repaired. (met) 2) The woody vegetation around the pond must be removed and maintained as a grassed vegetative cover. (met) 3) The sediment within the basin must be removed back down to the pond's original design depth as soon as possible to allow for proper settling to occur. A Notice of Violation/Intent to Issue Civil Penalty is being issued for the noted violation of North Carolina General Statute (G.S.) 143-215.1 and the facility's NPDES Permit. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirementsof any permit issued pursuant to G.S. 143-215.1. If you wish to provide additional information .regarding the noted violation, request technical assistance, or discuss overall compliance please respond in writing within ten (10) business days after receipt of this Notice. A review of your response will be considered along with any information provided on the submitted Discharge Monitoring Report(s). You will then be notified of any civil penalties that may be assessed regarding the violations. Ig no response is received in this Office within the 10 -day period, a civil penalty assessment may be prepared. Remedial actions should have already been taken to correct this problem and prevent further occurrences in the future. The Division of Water Resources may pursue enforcement action for this and any additional violations of State law. If the violations are of a continuing nature, 'not related to operation and/or maintenance problems, and you anticipate remedial construction activities, then you may wish, to consider applying for a Special Order by Consent. After heavy rains of approximately 3 inches had fallen Monday evening and Tuesday morning, Mr. Godwin discovered a collapse or sink hole above and around the outlet pipe leading from the sediment pond to the outfall ditch. The soil collapse around the pipe caused a breach of the pond bank around the concrete outlet structure allowing for the sediment basin to quickly drain out around structure and through the breach. The sediment basin rapidly drained allowing the stored stormwater and sediment to drain out of the -pond, down the outfall ditch and into the receiving stream, a UT to Swift Creek. It is believed that the outlet pipe has a hole or multiple holes and over time has allowed soil around it to wash away from the -pipe below the ground surface. After enough soils had slowly washed away and with the excessive rain weighing the remaining soils down, a sink hole above the pipe occurred, thereby causing the breach in the sediment pond wall. Mr. Godwin has a contrator, Mr. Willie Allen with Tyco Land Developing, onsite and is working to stop the stormwater discharge and repair the breach.
