This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. Description of any planned expansions or upgrades to the treatment facilities. 5. Engineering Alternatives Analysis of wastewater disposal alternatives including a flow justification,the connection to an existing municipal waste treatment facility and non-discharge alternatives. 6. The facility is used as a warehouse and no longer generates or treats industrial wastewater. Less than 2,000 gpd of domestic wastewater are generated at the site, but the facility doesn't discharge on a routine basis. The wastewater treatment system is an extended aeration activated sludge treatment system with a design flow of 0.5 MGD. The treatment system consists of dual lift pumps, lint screen, aeration basin, dual clarifiers, chlorine contact basin, post aeration chamber, and sludge lagoon. Compliance Summary Due to the low volume of wastewater generated, there has been no discharge from the treatment system during this permit cycle. Basin Plan/303(d) The Dan River is impaired for aquatic life due to turbidity and fecal coliform standards violations but it is not yet listed in the 303(d) list. DWQ and Virginia are conducting fecal coliform monitoring in this section of the river. Permit Development The limits in the current permit correspond to limits for domestic treatment plants. The facility is now listed as a major industrial permit. A rating sheet was completed and sent to EPA on April 23, 2007 to re-rate it to a minor facility. Permit modifications: > Monitoring for ammonia nitrogen was added to the permit as required for domestic discharges. The Fieldcrest plant has not produced process wastewater for years and the plant has closed. MGM now owns the plant and uses the building as"warehousing"with some 30 persons working at the site. The domestic waste goes to the 0.5 mgd plant. According to the plants operator the WWTP never has an effluent discharge. MGM talked with the City of Eden about the City owning and operating the system. As of October 16, 2006 nothing has been finalized. If the City has control, a reduced permit flow limit is to be pursued. It is recommended that the permit be issues to the appropriate owner, MGM or the City of Eden.
