Dear Klein:
As a member of the "Lower Neuse Basin Association, Inc." (LNBA), your facility and the North
Carolina Department of Environment, Health and Natural Resources (DEHNR) have entered into an
agreement that provides both parties with an effective environmental monitoring tool in the lower
Neuse basin. By this letter, the DEHNR is waiving the instream monitoring requirements as specified
within your individual NPDES permit beginning December 1, 1994 ,and at such time that the LNBA
begins collection and analysis of the water quality monitoring as specified in the Memorandum of
Agreement(MOA) signed by this agency and the LNBA,dated July 26, 1994. The agreement identifies
the stations, parametric coverage and frequency of analysis required of the LNBA in order that the
instream monitoring requirements be waived.
All other terms and conditions in the original permit remain unchanged and in full effect. These
modifications are issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the U.S.Environmental Protection Agency dated
December 6, 1983. Should your'membership in the LNBA be terminated,you shall notify the Division
immediately and the instream monitoring requirements given in your permit prior to December 1,1994 will
be reinstated.
I would like to express my appreciation for the cooperation and participation of all members of the
LNBA in this innovative approach to environmental monitoring. It is expected that the results of the
agreement will effectively contribute to our understanding of the lower Neuse basin environment. We
have designated Ken Eagleson as our primary contact for issues related to the MOA. He can be reached
at (919) 733-9960. We also look forward to the advances that this cooperative agreement will provide
in our management of the lower Neuse and ask that you feel free to contact us should any questions arise
regarding the monitoring efforts or interpretations of the information collected. We will be
maintaining our own series of monitoring stations in the lower Neuse which when added to the

information collected by the LNBA will greatly expand our knowledge of this complicated
environmental system. We thank you again for your participation and look forward to a successful
