Klimek, Director Division of Water Quality August 23, 2006 Subject: Issuance of NPDES Permit NC0001121 Danaher Sensors and Controls 2100 West Broad Street Bladen County The Division of Water Quality (the Division) hereby issues the attached NPDES permit for the subject facility. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994, or as subsequently amended. Changes to Your Previous Permit. Based on your Discharge Monitoring Reports (DMRs) and the newly developed permitting strategies for the Cape Fear River, the Division has made the following decisions regarding your previous permit: Categorical Permit Limits — updated permit limits considering Metal Finishing Point Source Category §40CFR Part 433, and applied new limits at Final Outfall 004 Cyanide — revised limits [according to 40CFR §433.13(b)]. Total Residual Chlorine (TRC) — Added permit limit of 28 µg/L., as required by the newly adopted statewide stream standard for chlorine. Monitoring is required only if you use chlorine at your facility. Corrections to Your Draft Permit. After further review, the Division has removed Total Nitrogen and Total Phosphorus (TN/TP) monitoring. The Division revisited your renewal application noting that you do not discharge sanitary sewer with your effluent. It follows then, that your effluent has no component of biochemical oxygen demand (BOD). Therefore, TN/TP monitoring will not be necessary and have been removed from the final permit. Concerning Total Toxic Organics (TTO) Reporting and Certification. The Division has reviewed your "certification" statement on the signature page of your monthly Discharge Monitoring Reports (DMRs). Your statement is inconsistent with wording provided in §40CFR 433.11(e), as footnoted in your permit [see permit section A. (4.)]. Please correct this wording on all future DMRs. N. C. Dynapar Corporation is hereby authorized to: 1. continue to operate an existing wastewater treatment facility with design flow of 0.17 MGD for process -contact wastewater (Outfall 001) consisting of • chromium and cyanide batch treatment tanks, • acid -alkaline holding tank, • clarifier, • plate and frame press, and; 2. continue to operate once -through, non process -contact cooling water facilities (Outfall 002), and; 3. continue to operate a 0.152 MGD groundwater -remediation -related wastewater treatment system including a packed -tower air stripper (Outfall 003), and; 4. continue to combine wastewaters from internal Outfalls 001, 002 and 003 at a final wastewater Outfall 004; all outfalls and facilities located at Danaher Industrial Controls, 2100 West Broad Street, north of Elizabethtown in Bladen County, and; 5. continue to discharge from the above -listed facilities, at the locations specified on the attached map, finally into the Cape Fear River, a Class C stream in the Cape Fear River Basin. Effluent temperature shall not cause the receiving -stream temperature to increase more than 2.8 °C, and in no case, cause the ambient receiving -stream temperature to exceed 32.0 °C. 2. Total Toxic Organics comprises the summation of all quantifiable values greater than 0.01 milligrams per liter from the list of toxic organics in §40 CFR 433.11(e). In lieu of monitoring for Total Toxic Organics, the Permittee may submit the following Certification Statement: "Based on my inquiry of the person or persons directly responsible for managing compliance with the permit limitation for Total Toxic Organics, I certify, to the best of my knowledge and belief, no dumping of concentrated toxic organics into the wastewater has occurred since the filing of the last discharge monitoring report." 3. Acute Toxicity (Fathead Minnow 24-hour). No Significant Mortality at an effluent concentration of 90% with testing in March, June, September and December [see A. (6.)]. The Permittee shall discharge from this final outfall, no floating solids or foam visible in other than trace amounts. A. (5.) BIOCIDE --SPECIAL CONDITION The Permittee shall add no chromium, zinc or copper to the treatment system except as pre -approved BIOCIDE additive compounds. The Permittee shall obtain approval from the Division's Aquatic Toxicology Unit prior to using any biocide. The Permittee shall request the Division's approval of any biocide a minimum of 90 days in advance of planned usage. ACUTE TOXICITY PASS/FAIL — SPECIAL CONDITION (Quarterly) The Permittee shall conduct acute toxicity tests on a quarterly basis using protocols defined in the North Carolina Procedure Document entitled "Pass/Fail Methodology For Determining Acute Toxicity In A Single Effluent Concentration" (Revised -July, 1992 or subsequent versions). The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24-hour static test. The effluent concentration at which there may be at no time significant acute mortality is 90% (defined as treatment two in the procedure document). Effluent samples for self-monitoring purposes must be obtained during representative effluent discharge below all waste treatment. The tests will be performed during the months of March, June, September and December. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR -1) for the month in which it was performed, using the parameter code TGE6C. Additionally, DWQ Form AT -2 (original) is to be sent to the following address: Attention: NC DENR DWQ / Environmental Sciences Section 1621 Mail Service Center Raleigh, North Carolina 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the Permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should the Permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. The Division evaluates permit limit compliance at final Outfall 004 (discharge to the environment). The Permittee's records show "pass" for quarterly acute toxicity tests (TGE6C), a 24-hour "pass/fail" static test, from March 2002 through June 2005. The Permittee failed the WET test in October 2005, but passed subsequent tests in November and December 2005, and again passed its regular quarterly test in March 2006. PERMITTING STRATEGIES Cape Fear Nutrient Strategy - 2006. Because of increasing concerns about nutrients and oxygen - consuming wastes in the Cape Fear River, the Division renewed this permit in accord with newly established nutrient -monitoring requirements described in the Supplement to NPDES Permitting Strategies for the Cape Fear River Basin, 2006 Permit Renewal (May 10, 2006). Monitoring conditions are therefore, in part, governed by this discharge's location within the Middle Cape Fear portion of this basin (Subbasin 03-06-16), and the Permittee's continuous discharge. Flow at final Outfall 004 is not permit -limited. Therefore, the Division based nutrient monitoring requirements on a minimum <0.050 MGD discharge to the environment at Outfall 004 (reported monthly combined discharge average 0.182 MGD). Therefore, in deference to the 2006 policy, beginning on the permit effective date, the Permittee shall provide 1/Quarter sampling and analysis (no permit limits) for Total Nitrogen (TN) and Total Phosphorus (TP) [See permit section, A. (4.)], even if only to document that there is no significant TN or TP contribution from this discharge to the receiving -stream environment. Metal Finishing Point Source Category, §40CFR Part 433. Previous NPDES permits categorized Dynapar / Danaher Sensors and Controls as a metal finisher with effluent guidelines applicable from §40 CFR 433.13(a) BPT and 433.14(a) BAT, as published July 1, 2003. The Division has applied 433.13(a) BPT as the more stringent, and has also added 433.13(b) applicable to the Permittee's use of cyanide processes for this renewal. Cyanide detection at Outfall 004 is several orders of magnitude lower than the new permit limits, based on DMRs (Appendix B), therefore compliance is not an issue. Categorical guidelines summarizing the parameters of concern are presented in Table 2. Similar to the last permit, the Division has applied permit limits to final Outfall 004 and converted concentration -based limits to mass - based limits to avoid any bias by dilution (see Permit Limits Calculation). Both requests<<eaC''found on page 4 of the application under item 15. The current permit as well as the renewal application reflects that there are 4 outfalls. It should be noted, however, that this facility has only one point of discharge (currently identified as outfall 004) to a receiving stream. This office requests that the renewed permit reflect only one discharge location and that all parameters including flow be associated with it. Another option would be to decrease the frequency of flow monitoring for the other outfalls to weekly instead of continuous. Also, permit information in BIMS currently shows that this facility's permitted flow is 5,000,000 gpd, which obviously needs to be corrected. A review of compliance data from BIMS for the period beginning January 2004 through May 2006 revealed five limit violations for varying parameters. A copy of the violation report from BIMS and the most recent compliance inspection report dated December 8, 2005 is attached. No special conditions, limitations or monitoring are suggested at this time. In keeping with current basin -wide strategy, the Fayetteville Regional Office recommends that this permit be renewed with consideration given to the above requests. Settled sludge is also recovered during the semiannual cleanout of the clarifier. Chrome containing wastewater is treated as follows: 1. Adjust pH to 2.0 using sulfuric acid. 2. Add sodium meta-bisulfite to revert hexavalent chrome to trivalent chrome. 3. Adjust pH to 8.5 using caustic soda. 4. Add Polyfloc AS 1002 polymer. 5. Add Metclear MR 2405 polymer (optional). 6. Allow sludge to settle and pump off. Cyanide containing wastewater is treated as follows: 1. Adjust pH to 13.0 using caustic soda. 2. Add sodium hypochlorite to destroy cyanide. 3. Add sodium meta-bisulfite to destroy residual chlorine. 4. Add Klaraid CDP 1311 polymer. 5. Add Novus CE 2681 polymer. 6. Allow sludge to settle and pump off. Sludge is stored in a 10,000 gallon above ground storage tank that also serves as a thickener. Final dewatering of the sludge is achieved using a JWI recessed chamber filter press. Filtrate from the filter press is returned to the cyanide batch treatment tank. The sludge is considered a RCRA hazardous waste under waste codes F006 and FOOT The most recent TCLP waste analysis conducted on 12/20/2005 indicated no toxic characteristic constituents above their regulatory levels. The dewatered sludge is transferred to cubic yard cardboard storage containers with plastic liners, then moved to a 90 -day storage location.
