Dear Mr. Link:
On April 25, 2008, the Division of Water Quality (DWQ) received your application dated March 23,
2008, with additional information received from you on April 29, 2008, to fill or otherwise impact 89
linear feet of intermittent stream and 4,748 square feet of Zone 1 Neuse River basin protected riparian
buffers and 2,804 square feet of Zone 2 Neuse River basin protected riparian buffers to construct the
residential subdivision at the site. On June 2, 2008, and June 6, 2008, the DWQ received additional
information from you, however, the DWQ has determined that your application remains incomplete
and/or provided inaccurate information as discussed below. The DWQ will require additional
information in order to process your application to impact protected wetlands and/or streams on the
subject property. Therefore, unless we receive five copies of the additional information requested below,
we will place this project on hold as incomplete until we receive this additional information. If we do not
receive the requested information, your project will be formally returned as incomplete. Please provide
the following information so that we may continue to review your project.
Additional Information Requested:
1. Please provide a completed Required Items Checklist with all required items attached for every
proposed level spreader.
2. Level spreader A is directing flow toward the roadway fill slope. Please relocate this level
spreader to a more appropriate location per Chapter 8 of the BMP Manual.
Plan Sheet SW601 indicates that the slopes in the filter strip exceed the allowable slope of 8
percent for the use of level spreaders. Please either relocate the level spreaders to a location
where the filter strip slopes are appropriate for level spreaders or provide a BMP or series of
BMPs that removal a minimum of 85 percent TSS and 30 percent TN from the stormwater
generated by this project. For each proposed BMP, please provide a completed BMP Supplement
Form, with all the required items. The BMP Supplement Forms are available at:

4. Please show the locations of all additional stormwater discharge points on the plans. These
discharge points must achieve diffuse flow in accordance with Chapter 8 of the BMP Manual.
For example, it appears that stormwater would discharge to the stream via a conveyance between
lots 14 and 15. It appears likely that there would be at least one other discharge point for
roadway drainage on this project.
Per the requirements of the Neuse Riparian Buffer Rule, all stormwater drainage from this site
must be discharged through a correctly designed level spreader. Level spreader design
requirements are set forth in Chapter 8 of the North Carolina Stormwater BMP Manual, available
at: http://h2o.enr.state. nc. us/su/bmp forms.htm. Please provide one Level Spreader Supplement
Form for each proposed level spreader, available at: http://h2o.enr.state.nc.us/su/bmp forms.htm.
Make sure to include the Required Items checklist and all items listed therein.
Please submit this information within 30 calendar days of the date of this letter. If we do not receive this
requested information within 30. calendar days of the date of this letter, your project will be withdrawn
and you will need to reapply with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
