That Minor Variance provided conditional approval for 38 square feet of impact to Zone 2 of the buffer at t h iu/ocation. During our work toaddress condition 5(Diffuse Flow) ofthat Minor Variance, vediscovered impacts to the buffer (Zones 1 and 2) that were not reported in our original application - namely eight plastic drainage pipes which used to carry stormwater from downspouts at the house. These downspouts have now been connected to three on-site rain gardens developed in coordination with Danny Smith of the Raleigh Regional Office of the Division ofWater Resources /norder 1ucomply with Condition 5 of the Minor Variance. These pipes have now been removed from the buffer, soil placed the trenches back to the natural grade, and the areas seeded and mulched 1oprovide stability. Describe the overall project in detail, including the type of equipment to be used: The site consists of a 0.45 acre lot with one residential house located on the property. The lot is located in a residential neighborhood that was developed in the 1970's in the northern side of the City of Raleigh. Figure I depicts the location of the property on the US Geological Survey (USGA) Raleigh West, NC 7.5 minute quadrangle topographic map. Figure 2 shows the location of the site on the applicable Wake County Soil Survey map. The home was constructed using typical residential construction equipment. The activity for which approval is sought is to retain a covered porch as well as brick and wooden support columns for the decks in 38 square feet of Zone 2 of the riparian buffer as allowed by the NC Division of Water Quality in a Minor Variance issued on November 9, 2009 (see attached). In addition, during installation of three rain gardens outside the protected buffer in order to meet condition 5 of the Minor Variance, eight black, plastic drainage pipes were discovered in Zones 1 and 2 of the buffer and have now been physically removed. These impacts were not reported in the original application dated October 26, 2009 and we are seeking after the fact approval for this disturbance. This temporary impact from the drainage pipes has resulted in disturbance to the ground surface in the buffer of 181 square feet (30 square feet in Zone 1 and 151 square feet in Zone 2). If yes, explain and detail according to "help file" instructions. The project consists of a single -family home constructed in 2006. The builder purchased this lot in 2004. The City of Raleigh notified the builder that the stream channel and riparian buffer needed to be included in the site plan for the lot. The builder retained Sullivan Surveying to locate the stream channel on the lot and set survey pins for the house foundations to ensure that the house would not encroach into the buffer. The house was built and scheduled to be sold in 2006. After numerous closing delays, contract disputes, and a change order to the decks, the buyer hired Cawthorne, Moss & Panciera, PC to resurvey the stream channel in 2009. This survey also included the stream channel on the adjacent lot (Lot 168). The new survey showed that the rear deck and screened porch are partially located within Zone 2 of the riparian buffer. Both the deck and the screened porch had concrete patios poured underneath. Figure 3 shows the location of the house, deck, and screened porch in relation to the riparian buffers on-site. The previous consultant met with Amy Chapman on site to review the extenuating circumstances in which the builder attempted to follow the rules but after construction discovered that a small corner of the screened porch was located within Zone 2 of the riparian buffer. The NC Division of Water Quality issued an After-the-fact Minor Variance Authorization on November 9, 2009 (Project Number 2009-1161) with additional conditions. During construction of the three rain gardens built outside the buffer in order to meet Condition 5 (Diffuse Flow), eight black plastic drainage pipes were discovered mostly in Zone 2 of the buffer that carried stormwater from the downspouts of the house. These black plastic pipes have been removed which resulted in 181 square feet of temporary impact to the buffer (30 square feet of temporary impact to Zone 1 and 151 square feet of temporary impact to Zone 2). These areas have been backfilled to the surrounding ground surface with top soil, seeded with grass seed and covered with wheat straw. These downspouts have now been connected to the two rain gardens or will be connected to the remaining rain garden that is soon to be constructed. 6. Future Project Plans 6a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. As described above, the encroachment into the buffer was only discovered during a subsequent survey of the property on the adjacent lot by a prospective buyer. The builder had measured the buffer from the main lot (Lot 164) during construction and located the house to avoid impacts to the buffer. The unanticipated infringement into the buffer resulted from a subsequent survey done on the adjacent lot (Lot 168) after the house was constructed. I b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. The builder has removed the concrete patio from the riparian buffer located underneath the deck and screened porch. Because the deck is in excess of 12 feet in height and the impervious surface that is within the buffer beneath them has been removed from the buffer and as explained in a field meeting the Amy Chapman of the then Division of Water Quality and the previous consultant on October 20, 2009, we understand that these features quality for the deck exemption. As described in Item 4 below in more detail, the builder measured the buffer from the main lot (Lot 164) and made certain that construction was outside the buffer zones. Only a subsequent survey done for a potential buyer from stream located on the adjacent, upslope lot (Lot 168) revealed that the buffer (when measured from the stream on the adjacent lot) had a small part of the screened porch located within Zone 2 of the buffer. The builder's architect prepared a rendition of the changes to the screened porch to remove it completely from the buffer, but the buyer would not agree to the structural changes. Losing a contacted buyer that the builder has already invested so much time and resources in would inflect a significant economic hardship to the builder. The applicant carefully measured the stream buffer on the main lot (Lot 164) before construction and made certain that construction of the house was outside the measured buffer. A subsequent survey done for a potential buyer from the stream located on the adjacent, upslope lot (Lot 168) revealed that the buffer (when measured from the stream on the adjacent lot) had a small part of the screened porch located within Zone 2 of the buffer (38 square feet including the wooden and brick support columns for the deck and porch). During construction of the three rain gardens as required by the Minor Variance issued by the NC Division of Water Quality on November 9, 2009, eight black plastic drainage pipes were discovered and removed from the buffer. The purpose of the gardens is primarily for Neuse river buffer protection and to prevent regular concentrated flows into the buffer area, These rain gardens have been sized to capture runoff from the I inch storm. The entire I inch storm volume will be stored and infiltrated into the rain garden surface and surrounding soils. The rain gardens will collect runoff from the rooftop through a gutter and drain system. A water test was used to confirm the area of roof draining towards each rain garden. One area of the roof appears to drain into the ground and has, no outlet that can be collected. These rain gardens were designed using the latest guidance on Backyard Rain Gardens from NC State University. The gardens have been sited outside of the riparian buffer boundaries on the project site. They are located on a sloping surface, which will require minor excavation and building of a berm to level the garden surface. Due to existing slopes, some minor shifting of the garden locations may be done in the field to provide the best fit. Construction will be overseen by the Project Engineer and inspected prior to final approval. The garden surface will utilize existing soils. Infiltration testing on-site (see attached data) has indicated these soils are suitable to provide the desired drainage rate. As a result, no media or underdrains are proposed as a part of the rain garden plan. After grading, the surfaces will be tilled to maximize infiltration capacity. A berm will be constructed to provide the necessary storage depth for each garden. Planting Typical rain garden species have been selected for the proposed planting for the garden. The plan includes a mixture of herbaceous species that shall be installed according to specifications and at correct center spacing for each species of plant. The rain garden and berm shall be covered with a minimum of 3 inches of triple shredded hardwood mulch at project completion. Conclusions The proposed plan will capture rooftop runoff from this residence and protect an existing riparian buffer area. The designed rain gardens will provide both water quality and flow protection benefits.
