The area is an emergency need to have the sediment removed, ferries are having difficult passing through the channel and also turning around in the basin. We are looking to start dredging operations this weekend, do you think you could have approval to us by then? This would allow us to not have to shut down the route from Hatteras to Ocracoke. Just for everyone's information we are meeting with the National Park Service to look at adding rip rap at the base spoil site berm. The rip rap was previously approved and we are meeting to discuss installation. The erosion from the berm is causing material to settle into the channel and basin. We will work towards applying for an Individual Permit for this area. I emailed you the Stumpy Point PCN on Wednesday, have you not received it? Years ago, USACE had a permit that mirrored the NCDCM permit in the area. Unfortunately, our regulations only allow us to continue approving maintenance excavation under an individual permit for up to 10 years. We did automatic approvals for as long as we were able. Now, we have to issue new authorizations through NWP 35 whenever you need to do maintenance. That means that we need a permit application and details about each excavation event that you need. (So yes, I need an application form for Southdock and for Stumpy Point) I have to issue a separate NWP 35 for each action, if what you propose meets the terms and conditions for the permit. I know that it is work up front, but you might want to think about requesting a new individual permit for the Southdock area, including the channel. You could ask for a 10 year maintenance clause, and that way, as long as you were working within the permit area and were consistent with any permit conditions, you could work. It would be like the way we used to do things. It's just a thought. I think it would save you time since things seem very dynamic within the basin and channel.
