SUBJECT: NOTICE OF VIOLATION & INTENT TO ASSESS CIVIL PENALTY

Dear Ms. Davis:
This letter is issued as part of the follow-up inspection conducted at the subject facility on October 24, 2016.
The follow up inspection was conducted as a result of the compliance satnpling inspection (CSI),
conducted on June 21, 2016, being issued by this Office as a Notice of Violation (NOV-2016-PC-0208) for
deficiencies noted below. These inspections are conducted to verify that West Stanly WWTP facility is operating
in compliance with the conditions.and limitations specified in NPDES Permit No. NC0043532.
During the first inspection conducted on June 21, 2016 the following violations were found: Large amounts of
solids going over weirs of secondary clarifier, sludge balls floating on clarifier. Two secondary clarifiers not -in
service are being used to hold waste from Enterprise Rendering. Solids were floating on surface of chlorine
contact chamber. A sludge.judge measurement of chlorine contact found 6-7 inches of sludge buildup on bottom
of Chlorine contact chamber. The facility also has compliance issues with receiving wastewater from Enterprise
Rendering .Plant and by-passing the influent sampler.
The follow-up inspection conducted on October 24, 2016 found that the.above noted deficiencies have been
corrected :and the facility appeared to be operated properly at time of inspection. Please'note at the Mooresville
Regional Office has decided to place any possible civil penalties related to this inspection and violation
NOV-2016-PC-0208 in abeyance, provided that the subject facility continues to be'.properly operated. and
maintained.' Please be advised that in accordance witN your. NPDES permit Part II, Section D, 8., unannounced
follow-up compliance inspection may. be conducted at this: facility to ensure ongoing compliance.
