Dear Mr. Ham:
On November 15, 2016, the Division of Water Resources (DWR) received a Year 4 Monitoring
Report for the LaGrange Phase I Mitigation Bank (Bank) from Greene Environmental Services,
LLC (GES). According to the data submitted with the report, the site appears to be doing well
and on trajectory to meet the success criteria at the end of five years. Stem densities were higher
than 320 stems per acre in both of the monitoring plots. No encroachment within the
conservation easement boundary was noted in the report.
On October 7, 2016, DWR received an amendment to Letter of Credit (LOC) #SB93770 issued
to GES in the amount of $60,000 to cover monitoring and maintenance at the subject site. The
term of this LOC applies through October 25, 2017. Therefore, GES is required to renew the
LOC prior to October 25, 2017 and is required to renew the LOC annually for at least one more
year. Future credit releases will be dependent on both the renewal of this LOC and the annual
monitoring reports. GES has DWR approval to reduce this LOC from $60,000 to $40,000,
which is 60% of the original LOC amount of $100,000.
The Conservation Easement for this Bank is currently held by GES. According to the UMBI for
this Bank, "At the conclusion of Bank activities, the conservation easement may be permanently
transferred to an entity approved by DWR to be held in perpetuity ". Therefore, prior to the
conclusion of the Year 5 monitoring season which will be in the Fall 2017, GES needs to notify
DWR of the long term steward they wish to hold the conservation easement in perpetuity. DWR
approval of the long term steward and the transfer of the easement will be needed prior to
issuance of final credits for this Bank.

According to the UMBI signed on October 3, 2008, the following Project Milestone has been
met, and the corresponding credits shall be released

By copy of this correspondence, DWR confirms that you have satisfied the above requirements
for the above -referenced tract and an additional 10% of your Neuse riparian buffer credits (0.1 x
37,939.7 ft2 = 3,793.97 ft') are now available for sale. Also, an additional 10% of your nitrogen
nutrient offset credits (0.1 x 5,728.01 lb -N = 572.80 lb -N) are now available for sale. Please
update your credit ledgers accordingly.
Please note that nutrient offset credits generated at this site must be used for impacts in
HUC 03020202 of the Neuse River Basin and that Neuse riparian buffer credits must be
used for impacts in the Neuse River Basin according to guidelines in 15A NCAC 02B .0295,
which became effective on November 1, 2015.
