As we discussed via telephone, I did not realize that you plan to complete construction of the thalweg, install
matting to protect the banks and establish ground cover prior to diverting the water. From our earlier
conversations, I understood that the flow would be diverted as soon as possible to allow repairs to the berm
and that construction of the thalweg and tree planting would be completed later. Riprap protection is
recommended anywhere flow is constricted, but matting may be sufficient based on the width and slope of the
channel.
During our site meetings, we had discussed that it would not be necessary to have the diversion channel
outside the thalweg planted with trees prior to diverting the flow from Stony Creek. Therefore, the Division
finds your plans for stabilization of the diversion channel to be in compliance with your 401 water quality
certification. Please keep us informed of your progress. Mac Haupt and I would like to conduct a site visit soon
after the water is diverted.

Jennifer,
Just so that everyone is clear on the request, the diversion of the drainage into the newly constructed
relocation channel would be permanent and not temporary. With the breach along the existing pit that
occurred during Hurricane Matthew and the subsequent flooding of the pit at Benson, the need to divert the
base flow away from the breach repairs are needed to avoid any further failure from occurring and causing
additional flooding of the pit. We continue to work to make the necessary repairs to the relocation channel, as
sediment is being removed and grade is being re-established, die to the result of over 14" of rainfall received
during this flood event.
I do however, have questions on your request for rip -rap protection at the inlet and outlet of the diversion
channel and culverts at the channel crossing. Concerning the culverts of the channel crossing, the pipes were
buried 1' below grade to provide the required fish passage. If rip -rap is required at each end, wouldn't the
potential for the passage of fish be eliminated with the stone installation? The mining permit, 401, or 404
approvals did not require the installation of riprap at the inlet/outlet protection, as the expected velocity is low,
due to the slope of the channel. I am also hopeful that your request will not trigger a revised 401 and mining
review/approval. On the inlet and outlet concerns of the diversion channel, I don't see that the channel slope
in these areas is any greater than the overall channel. I believe that the matting of these areas should be
sufficient, as we have discussed and have been noted in the stabilization discussions of the thaweg.
I plan to call you this afternoon to discuss this request.

Brian,
On October 18th, the Division received your request to temporarily divert the flow from Stony Creek through
the newly constructed channel around the future pit expansion to repair the berm between Stony Fork and the
existing pit. Your letter indicated that base flow would be diverted once construction is complete and all
disturbed areas have been seeded. A copy of the request, photos, videos and email correspondence regarding
this request are located here. The Division believes this diversion would be acceptable as long as the inlet and
outlet of the diversion channel and culverts for the channel crossing are adequately stabilized with riprap
protection. Please provide details of the riprap stabilization required above for the Division's review and
approval.
