JAY ZIMMERMAN Dtrecmr As a result of Hurricane Matthew and subsequent flooding in the vicinity of the H. F. Lee Energy Complex, impacts to the cooling pond, triangle pond, and the inactive ash basin complex have been documented at the facility. In addition, Duke Energy reported a release of ash material and cenospheres from the inactive ash basin complex. The North Carolina Department of Environmental Quality (DEQ) requests that Duke Energy submit a Plan of Action (Plan) to address the release at the inactive ash basin complex and any potential releases at the cooling pond and triangle pond. The Plan shall include: • Estimates on type and amounts of ash or cenospheres released, • Assessments of the impoundments that include damage at the inactive basins complex and loss of material at all impoundments, • A sampling and/or monitoring plan, • A description of past, ongoing, and proposed actions in response to releases, • A list of any State or Federal permits that may be required to complete the Plan, and • A timeline for completion of the assessment. The sampling plan shall include collection and analysis of comparative surface water and soil/sediment samples taken from both within the footprint of the impoundments as well as adjacent areas to facilitate evaluation of the extent of the known release and determine if any other releases have occurred. Please note that in requesting the Plan, DEQ in no way has limited or foreclosed its options with respect to further investigation or potential enforcement of any violations which may have occurred at the H.F.
