Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The surrounding developments are single family residential subdivisions and a proposed Town of Apex Nature Park. Describe the overall project in detail, including the type of equipment to be used: The proposed project is to construct the Evans Road extension which will be a two lane roadway connecting Humie Olive Road to Apex Barbecue Road in Apex, NC. Equipment typical of linear road projects including backhoes, graders, etc. will used. 10. Explain the purpose of the proposed work: The purpose of the proposed Evans Road extension is to build a two lane road that will service the proposed and existing residential developments in the area The Evans Road extension has been part of the Town of Apex's Transportation Plan for some time, designed to meet the traffic needs of the rapidly growing population. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Describe previously approved wetland, stream and buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project, list and describe permits issued for prior segments of the same T.I.P. project, along with construction schedules. On January 30, 2007, S&EC conducted a detailed wetland delineation and Town of Apex buffer evaluation of the subject property. On October 4, 2007 S&EC requested a Jurisdictional Determination (see attached AID SAW-2007-03763). On March 9, 2007 the NC DWQ reviewed the site for an Intermittent/Perennial stream determination (see attached DWQ I/P letter IPRRO 07-04). V. Future Project Plans Are any future permit requests anticipated for this project? If so, describe the anticipated work, and provide justification for the exclusion of this work from the current application. No future permits are known to be required at this time. VI. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. Each impact must be listed separately in the tables below (e.g., culvert installation should be listed separately from riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed impacts, permanent and temporary, must be listed, and must be labeled and clearly identifiable on an accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial) should be shown on a delineation map, whether or not impacts are proposed to these systems. Wetland and stream evaluation and delineation forms should be included as appropriate. Photographs may be included at the applicant's discretion. If this proposed impact is strictly for Page 3 of 9 wetland or stream mitigation, list and describe the impact in Section VIII below. If additional space is needed for listing or description, please attach a separate sheet. 1. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The applicant requested a detailed delineation of streams and wetlands prior to site elan development in order to determine the extent and location of streams and wetlands in the vicinity of the proposed road crossing. The site plan has limited permanent impacts to one road crossing of an important/perennial channel. Streams are not crossed multiple times by roads. The proposed road crossing is necessary in order to connect the existing Evans Road to Apex Barbecue Road. The proposed Evans Road Extension has been part of the Town's Transportation Plan for several years. Currently, the only North/South connector streets through this developed residential area are Richardson Road or Kell. R? oad (SR 1163) which are approximately three and five miles away, respectively. Page 5 of 9 The applicant is also aware of the regional conditions associated with the Nationwide Permit 14. With respect to linear transportation crossings conditions (Regional Conditions section 4.5) the applicant does not anticipate any stream relocations, the proposed box culverts will be buried the appropriate depth below the streambed to allow for aquatic life passage, floodplain culverts are being utilized as this project is within an identified FEMA floodplain and this project only proposes the single road crossing and is not being used in conjunction with a NWP 18 to create an upland area. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at htip://h2o.enr.state.nc.us/ncwetlands/stnnaide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. S&EC believes that additional mitigation, beyond avoidance and minimization, for available resources, precludes the applicant performing any onsite restoration for the unavoidable stream channel impacts; however, the Town of Apex has proposed on-site Page 6 of 9 preservation of 7,189 linear feet of stream channel and 24.63 acres of wetlands in the neighboring _parkland tract. Therefore, the applicant proposes payment into the NC EEP at a 1:1 ratio for unavoidable, permanent impacts to 210 linear feet of important/perennial stream. Mr. Jamie Shern (USACE) stated he was in agreement with this mitigation plan in previous correspondence. Please see the attached EEP acceptance letter. The Wetland and Stream Conservation survey maps are not complete at this time and will be submitted under separate cover. 2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at (919) 715-0476 to determine availability, and written approval from the NCEEP indicating that they are will to accept payment for the mitigation must be attached to this form. For additional information regarding the application process for the NCEEP, check the NCEEP website at http://h2o.enr.state.nc.us/wrp/index.htm. Although the impervious surface area for the road will exceed 24%. tvpically stormwater devices for linear transportation proiects are not required. This project will also comply with the Town of Apex's Unified Development Ordinance (see attached letter from the Town of Apex). XII. Sewage Disposal (required by DWQ) Clearly detail the ultimate treatment methods and disposition (non-discharge or discharge) of wastewater generated from the proposed project, or available capacity of the subject facility. If no, please provide a short narrative description: We have reviewed the "DRAFT Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetland Programs" document prepared by the NC Division of Water Quality on October 3 2002, version 1.6. While the proposed Evans Road extension is a "road on a new location" which has the potential for growth-stimulating effects, the surrounding area has been built upon or is currently being built upon. It is this "build-out" that has necessitated the construction of this road. Additionally, the proposed Evans Road extension is within the Town of Apex's Extraterritorial Jurisdiction Area (ETJ) and as such is subject to the Uni aed Development Ordinance which has provisions within to prevent the degradation of downstream water quality due to development. We anticipate that you will advise us if a qualitative or quantitative impact analysis is required. XV. Other Circumstances (Optional): It is the applicant's responsibility to submit the application sufficiently in advance of desired construction dates to allow processing time for these permits. Explain the purpose of the proposed work: The purpose of the proposed Evans Road extension is to build a two lane road that will service the proposed and existing residential developments in the area. The Evans Road extension has been part of the Town of Apex's Transportation Plan for some time, designed to meet the traffic needs of the rapidly growing population. IV. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The applicant requested a detailed delineation of streams and wetlands prior to site elan development in order to determine the extent and location of streams and wetlands in the vicinity of the proposed road crossing. The site plan has limited permanent impacts to one road crossing of an important/perennial channel. Streams are not crossed multiple times by roads. The proposed road crossing is necessary in order to connect the existing Evans Road to Apex Barbecue Road. The proposed Evans Road Extension has been part of the Town's Transportation Plan for several years. Currently, the only North/South connector streets through this developed residential area are Richardson Road or Kelly Road (SR 1163) which are approximately three and five miles away Page 5 of 9 The applicant is also aware of the regional conditions associated with the Nationwide Permit 14. With respect to linear transportation crossings conditions (Regional Conditions section 4.5) the applicant does not anticipate any stream relocations, the proposed box culverts will be buried the appropriate depth below the streambed to allow for aquatic life passage, plain culverts are being utilized as this project is within an identified FEMA floodplain and this project only proposes the single road crossing and is not being used in conjunction with a NWP 18 to create an upland area. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at htlp://h2o.enr.state.nc.us/ncwetlands/strmgide.html,. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. S&EC believes that additional mitigation, beyond avoidance and minimization, for permanent impacts to wetlands, should not be required given that permanent impacts to available resources, precludes the applicant performing any onsite restoration for the unavoidable stream channel impacts; however, the Town of Apex has proposed on-site Page 6 of 9 preservation of 7,189 linear feet of stream channel and 24.63 acres of wetlands in the neighboring parkland tract. Therefore the applicant proposes payment into the NC EEP at a 1:1 ratio for unavoidable permanent impacts to 210 linear feet of important/perennial stream. Mr. Jamie Shern (USACE) stated he was in agreement with this mitigation plan in previous correspondence. Please see the attached EEP acceptance letter. The Wetland and Stream Conservation survey maps are not complete at this time and will be submitted under separate cover. 2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP). Please note that this decision does not assure that the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be approved. This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the issued 404 Permit/401 Certification/LAMA permit within this time frame, this acceptance will expire. It is the applicant's responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized work. NORTH CAROLINA 27502 Please accept this letter in response to our conversations regarding the proposed Evans Road extension project that you are securing 404 and 401 Approvals for on behalf of the Town of Apex. As we have recently discussed, the Town of Apex has been considering the proposed Evans Road extension for several years; this proposed road extension has been part of the Town's Transportation Plan for approximately 6 years (Attachment 1). The Evans Road Extension will be located within approximately 160 acres that the Town owns and has set aside as part of a future park. As you are aware and as we have discussed several times, while reviewing the initial layout of the road it was brought to our attention that the proposed location would impact a significant area of wetlands. It was at that time that the Town agreed to the realignment of the proposed road to avoid and minimize wetland impacts to the greatest extent practicable. This decision effectively shifted the original design by 421 feet and reduced the size of the park by approximately 9.1 acres (Attachment 2). In addition, this change necessitated the Town to pay an additional $18,900 in re-design fees. Both of these actions, in our opinion, were the right thing to do to demonstrate avoidance and minimization of the wetland impacts and to help protect our environment. I hope this information is helpful and reinforces our commitment to minimizing the impacts of area development on our environment as we pride ourselves on being sensitive to this where we can.
