REQUEST FOR MORE INFORMATION-EXPRESS REVIEFV PROGRAM
Dear Mr. Skinner:
On September 12, 2005, the Division of Water Quality (DWQ) received your application for a 401 Water
Quality Certification and Riparian Buffer Authorization through the Express Review Program. Upon
review of your completed application package (additional materials were received on September 16,
2005), DWQ found several issues that require additional information in order to process your application
to impact protected wetland, streams and/or buffers on the subject property. Unless we receive the
additional information requested below, we will have to move toward denial of your application as
required by 15A NCAC 2H .0506 and will place this project on hold as incomplete.
Please provide the following information so that we may continue to review your project:
1. You have indicated that the estimated impervious surface is 28%. Deed notifications or similar
mechanisms shall be placed on the lots in the single-family residential portion of the subdivision to
assure that this threshold is not exceeded. A signed and notarized original copy of this deed
restriction and two copies are required by DWQ. Furthermore, there are portions of your proposed
plan indicating future townhomes. It is DWQ policy that areas of concentrated development that
are 30% impervious surface area and above must treat stormwater to provide 85% TSS removal and
nutrients (in NSW watersheds). Additionally, DWQ would like to remind you that if a compliance
inspection reveals an impervious area of 30% or greater, then Atlantic Homes, LLC will be required
to retroactively provide stormwater management facilities on the site.
Please respond within three (3) days of the date of this letter by sending five (5) sets of this information to
me in },vriting. The Express Review Program is a process that requires all parties to participate in a timely
manner. If the DWQ feels the Express Review Program is the incorrect review program for your project,
then we may have to return your application and have it reviewed through our regular 401 Water Quality
Certification Program.

This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
