We are requesting for NC Division of Water Quality (NCDWQ) written approval under Section 401, Clean Water Act, 33 USC 1344. This will assist in compliance with the State General Permit for Impacts to Isolated Wetlands and Isolated Waters Permit Number: IWGP100000. We have addressed your included written comments in the following paragraphs. 1. You have indicated that the estimated impervious surface is 28%. Deed notifications or similar mechanisms shall be placed on the lots in the single-family residential portion of the subdivision to assure that this threshold is not exceeded. A signed and notarized original copy of this deed restriction and two copies are required by DWQ. Furthermore, there are portions of your proposed plan indicating future townhomes. It is DWQ policy that areas of concentrated development that are 30% impervious surface area and above must treat stormwater to provide 85% TSS removal and nutrients (in NSW watersheds). Additionally, DWQ would like to remind you that if a compliance inspection reveals an impervious area of 30% or greater, then Atlantic Homes, LLC will be Isolated Wetland Re-Submittal Austin Creek Subdivision September 29, 2005 Page 2 of 2 required to retroactively provide stormwater management facilities on the site. Stormwater facilities at the proposed Phase 1 of Austin Creek Subdivision were designed to accommodate on & off-site stormwater flow. If for any reason, the impervious surfaces exceed the 30% threshold at this subdivision, Atlantic Homes, LLC will retroactively provide stormwater management facilities on the site. This is per your request in the above paragraph. The previously provided 27.96% impervious cover calculation is based on a high estimate for all of the lots. As stated in the General Permit for Isolated Wetlands Section II. (On-Site Stormwater Management): A. Additional site-specific stormwater management requirements may be added to this Permit at DWQ's discretion on a case by case basis for projects that have or are anticipated to have impervious cover of greater than 30 percent for either the entire site or portions of the site that exceed 30% imperviousness. We do not anticipate at this time that the project will exceed impervious cover of 30 percent. If the impervious surfaces in the future townhome areas exceed 30%, then facilities will be designed and constructed to treat stormwater to provide 85% TSS removal and nutrients (in NSW watersheds). We request that deed restrictions not be placed on the proposed single-family lots. It is our intention and promise that we will record in connection with the aforementioned property, restrictive covenants that contain a paragraph indicating that the impervious soils shall be limited to 29%. In addition, we will insure that this restriction is placed on the recorded plat. By taking these steps, every lot will be bound by this requirement. Further, we understand that if a compliance inspection reveals an impervious area of 30% or greater that we will be required to comply with the requirements of Condition 4 in GC 3402.
