The re-aligned stream appears to have been installed according to the plans submitted to the environmental agencies which were approved by the NC Division of Water Resources and the US Army Corps of Engineers. Approval from the agencies required written authorization and mitigation for the loss of streams and buffer. The approved re-alignment stops approximately 70 ft west of the property owner’s eastside property line. We discussed the question presented by the land owner which was, “ Is it was possible to remove the natural vegetation and extend the riprap on the remaining natural stream to the eastside property line”? My answer would have to be NO. Since the remaining seventy feet is a natural stream with a naturally vegetated bank, there is no justifiable need to remove the vegetation and replace it with riprap. To do so, would reduce the functionality and environmental effectiveness of the streambank and riparian area. It would also result in impacts to the regulated adjacent 50 ft buffer which also cannot be justified. NCDOT has already obtained a permit for the impacts necessary for the widening of Skeet Club Road and was required to mitigate and compensate for environmental impacts. Additional environmental impacts would require modifying the permit and additional mitigation for unjustifiable impacts that I strongly believe the environmental agencies would object to and deny.
