HomeMy WebLinkAbout20080810 Ver 1_WRC Comments_20080609® North Carolina Wildlife Resources Commission June 9, 2008 Ms. Loretta Beckwith U.S. Army Corps of Engineers, Regulatory Branch 151 Patton Avenue, Room 208 Asheville, North Carolina 28801-5006 SUBJECT: Nationwide Permit Application for Mr. John Harrison, Harrison Development Hidden River subdivision, Passmore Branch and UTs Hiwassee River, Clay County DWQ No. 08-0810 Dear Ms. Beckwith and Mr. McMillan: Mr. Charles Morris requested a letter of concurrence from the North Carolina Wildlife Resources Commission (Commission) for a 404 Permit from the U.S. Army Corps of Engineers. The project involves placing about 146 feet of culverts in Passmore Branch and unnamed tributaries to the Hiwassee River in order to develop the 153 acre Hidden River subdivision near Hayesville. I visited the site on June 5, 2008. The culverts at sites 1 and 2 have already been replaced or placed. Comments from the Commission are provided under provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The project should not harm trout. If the project is permitted, then the Commission can concur if: 1. The Nationwide and Final Regional conditions are adhered to. Adherence to Final Regional Condition 1.2 is not necessary to protect trout spawning. 2. Sediment and erosion control measures are used and maintained during construction.
