PROJECT SUMMARY: The applicant proposes to construct a single family residence and an access road for private use. The access road proposal includes a culvert crossing with stream and §404 wetland impacts. Robert Parsley Page 2 9. PROJECT DESCRIPTION: The project site is located at 7621 Masonboro Sound Road, adjacent to the AIWW Masonboro Sound northeast of Whiskey Creek. To locate the property traveling south on College Road, take a left onto Mohican Trail and travel approximately 1.3 miles. Turn left onto Masonboro Loop Road and travel north approximately I mile. Turn right onto Masonboro Sound Road and travel approximately 0.8 miles. The property of interest will be located on the right just past Maxwell Road. The property is adjacent to residential properties on both sides. The current elevation of the property is approximately 13.5 ft. above normal high water (NHW). The size of the tract is approximately 5.85 acres with 1,442 linear ft. of shoreline. The lot is currently undeveloped and falls entirely within the 575 ft. AEC for the AIWW/Masonboro Sound. Upland vegetation consists primarily of native oak, pine, magnolia and holly trees. The upland area is divided by a small non-tidal unnamed tributary that borders the property to the west and the south and drains into the AIWW/Masonboro Sound. Upland vegetation transitions into high marsh, which includes §404 and coastal wetlands including: Black Needle Rush (Juncus roemarianus) and Smooth Cordgrass (Spartina alterniora). The U.S. Army Corps of Engineers (USACOE) approval of §404 wetlands was issued as Action ID 200702984065 on September 13, 2007. The New Hanover County/City of Wilmington Land Use Plan classifies adjacent waters as Conservation. In the project area, the waters of Masonboro Sound/AIWW are classified as SA-ORW by the NC Division of Water Quality, and they are OPEN to the harvest of shellfish. These waters are designated as a Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. PROPOSED PROJECT: The applicant proposes to develop the upland portions of this lot for private residential use. Development is to be located entirely within the 575 ft. AEC for the AIWW/Masonboro Sound. The application states that the proposed upland development will consist of the construction of an access road measuring approximately 510 ft. in length by 12 ft. in width, installation of water and sewer lines and construction of an approximately 3,300 sq. ft. residence. The proposed residence would be located on the northwestern portion of the property measuring approximately 80 ft. in length and 40 ft. in width. The applicant also proposes a retaining wall, approximately 30 linear feet along the southern edge of the house. The access road would require 900 sq. ft. of stream disturbance and would result in a total of 1,667 sq. ft. of §404 wetland disturbance. The application states that installation of the stream crossing will result in 769 sq. ft. of §404 wetland impact and the construction of the wetland crossing will result in 898 sq. ft. of wetland impact. Dual 48" culverts 25 ft. in length are proposed for the stream crossing with a top height of 1 ft. above normal water level (NWL) of the stream extending to V below the existing bottom contour. The applicant proposes the excavation of 900 sq. ft. of the stream bed for the placement of the culverts. The application states that the resulting 29.6 cubic yards of excavated material would be disposed of in a 15 ft. by 15 ft. area located east of the stream crossing on high ground. One 12" culvert 26 ft. in length is proposed for the wetland crossing with a top height of 1.6 ft. above normal high water (NHW) to be installed at the existing grade. The applicant states that the §404 wetland crossing would not require disposal of excavated material. (See sheets W1-W3). 10. ANTICIPATED IMPACTS: The proposed project would result in a total of 1667 sq. ft. of §404 wetland impacts and 900 sq. ft. of perennial stream impacts for the proposed road crossing. The proposed total area of land disturbance is 23,958 sq. ft. The proposed total impervious area for the entire project within the 575 ft. AEC is 10, 873 sq. ft. or 4.8%. The application states that the City of Wilmington would provide the drinking water supply source and New Hanover County would provide the sanitary sewer for the project. Submitted by: Tara Croft Date: June 5, 2008 Office: Wilmington Project Narrative Mr. Robert Parsley requests a CAMA Major Development Permit for the construction of an access road and a single family residential dwelling on his property which is located entirely within the 575' AEC for the Atlantic Intracoastal Water Way (AIWW). The project is located at 7621 Masonboro Sound Road, in Wilmington, New Hanover County. The project is ±5.11 acres in size, and abuts the marsh adjacent to Masonboro Sound/AIWW. The project is located within the planning jurisdiction of the City of Wilmington. The City of Wilmington will provide the drinking water supply source and New Hanover County will provide the sanitary sewer for the project. The proposed utilities will consist of a 4" sewer line and a 1" water line, which are concurrent with standard single family residential use. The connection to the New Hanover County Sanitary Sewer will be completed upon the removal of the NEI moratorium. Areas of Environmental Concern (AEC) Both the 75' AEC from Huffs Gut and the 575' AEC from the adjacent marsh encroach onto the project. The 75' AEC and 575' AEC were offset from the NHW line from the onsite marsh adjacent to the AIWW. The AIWW is classified as ORW. The NHW line was established by Robb Mairs with the NC Division of Coastal Management (DCM) on January 3, 2008. Approximately 90,614 sq feet (2.08 acres) of the project site is located within the 75' AEC. The entire 222,506 sq feet (5.11 acres) of the project site is located within the 575' AEC. The project will result in 10,873 sq feet (0.25 ac) of impervious area within the 575' AEC needed for construction of the house and access road, resulting in 4.8% impervious area proposed within the 575' AEC. There is no impervious area proposed within the 75' AEC. There is no proposed construction within the 75' AEC or the 30' Coastal Shoreline Buffer. Proposed Wetland Impacts The proposed project will require 74 if of stream impacts and 1,667 sq ft (0.04 ac) of 404 wetland impacts as a result of construction of the entrance road to access the property. The 74 if stream impacts will occur to an unnamed tributary that borders the property to the west and south, and eventually drains into Masonboro Sound/AIWW. Dual 48" culverts will be installed within the stream during construction of the entrance road. The culverts will be installed approximately 1.0 feet below the existing stream bed to allow for passage of water and aquatic life during periods of low flow. A total of 1,667 sq ft of wetland impacts are proposed to construct the access road. The installation of the culvert crossing will result in 769 sq feet of wetland impact, and construction of the wetland crossing will result in 898 sq ft of wetland impacts. Due to the location of the onsite wetlands, the entrance road could not be constructed entirely in uplands. The wetland impacts have been minimized to those necessary for the construction of the access road. There are no wetland impacts associated with construction of the proposed house. Avoidance and Minimization Impacts to onsite wetlands and streams have been avoided and minimized to the greatest extent possible. The proposed wetland/stream impacts have been minimized to those necessary for construction of the access entrance. Wetland impacts were also avoided through the design of a retaining wall on the southern edge of the guest house. The proposed retaining wall will be built into the southern wall of the guest house. Due to the topography of the southeastern portion of the site, the retaining wall was necessary to allow for construction of the guest house without impacting wetlands. Mitigation Due to the small amount of wetland and stream impacts, and the avoidance and minimization exhibited in the site design, there is no mitigation proposed for this project.
