Eric, Monte and Rob,
The Department is applying for a permit modification for this project due to the following: A) Anticipated additional
jurisdictional impacts that are necessary to properly stabilize and complete the project and B) To address additional
recent unpermitted jurisdictional impacts recently conducted by the contractor for this project (note: these have all
been reported to the USACE and NCDENR-DWR). These issues are addressed below:
ISSUE # 1
-The contractor for the project conducted land disturbing activities in the riparian buffer at the Smith-Austin Mitigation
Site near 21+00 Lt. This site is characterized as a former NCDEQ Division of Mitigation Services (DMS) compensatory
mitigation site currently managed by the DEQ Land and Aquatic Resources Stewardship Program. This action resulted in
an additional 508.4 square feet of BZ 1 impacts and an additional 276.4 square feet of BZ 2 impact. The Department has
recently agreed to conduct a reforestation plan proposed by DEQ personnel. See below image:

ISSUE # 2
-Off-site stormwater runoff from adjacent properties near 15+00 to 20+00 Rt has resulted in destabilization of the bridge
embankment along the west streambank. A review of the area indicates recent removal of a stormwater pond by others
(that used to provide some storage of runoff) and installation of a greenway that is diverting and concentrating runoff
to our project. The Design Build hydro engineers have evaluated the area and are proposing to collect stormwater
runoff into a rip rap lined base ditch from near 19+07 to 20+97 Rt. Note that this ditch is in the same location of an old
drainage swale that existed on-site recently until the above-mentioned removal of the stormwater pond by others. This
proposed rip rap lined base ditch has a larger cross sectional footprint than the previously permitted rip rap lined ditch
and will thus require a larger opening along the west streambank. The Department proposes to install additional Class II
rip rap bank stabilization at this location. This action will result in an additional 666.3 square feet of BZ 1 impacts, an
additional 803.2 square feet of BZ 2 impact and 22 linear feet of permanent streambank impact due to installation of
Class II rip rap. Note that Class II rip rap bank stabilization on west bank is located within footprint of previously
permitted Class II rip rap bank stabilization on east streambank. See below images:

ISSUE # 3
-The contractor for the project installed Class II rip rap bank stabilization along the west streambank under the bridge
deck. Note that this activity was not depicted on the plans or most recent permit drawing. This action will result in an
additional 85 linear feet of permanent streambank impact due to installation of Class II rip rap. Note that Class II rip rap
bank stabilization on west bank is located within footprint of previously permitted Class II rip rap bank stabilization on
east streambank. See below image:

ISSUE # 4
-Stormwater runoff from adjacent development has resulted in displacement of previously installed Class I rip rap outlet
protection at the outlet of a 42 inch pipe structure at 27+80 Lt. The Design Build hydro engineers have evaluated the
area and are proposing additional Class II rip rap at the tail end of this ditch and tie this rip rap on the streambanks of
the directly adjacent jurisdictional stream. This action will result in an additional 18 linear feet of permanent streambank
impact due to installation of Class II rip rap bank stabilization and a reduction of 7 linear feet of temporary stream
impact (associated with culvert construction impact). See below image:

ISSUE # 5
-Stormwater runoff from adjacent development has resulted in displacement of previously installed Class II rip rap
installed on the streambank at the outlet of a 42 inch pipe structure at 28+21 Rt. The Design Build hydro engineers have
evaluated the area and are proposing to install a rip rap dissipator basin (i.e. outlet channel improvements) within the
streambed and banks of this jurisdictional stream. This action will result in an additional 4 linear feet of permanent
stream impact and a reduction of 4 linear feet of temporary stream impact. See below image:

Additional riparian buffer impact calculation by Design Build hydro engineers:
-The Design Build hydro engineers re-evaluated riparian buffer impacts at the project and had determined a reduction of
5.5 sq feet of BZ 2 impact at Permit Site 1 (bridge) and an increase of 276.8 sq ft of BZ 2 impact at Permit Site 2
(Aluminum Box Culvert). Note that these impacts are described as allowable road crossing impacts.

The Department has been coordinating with the NCDEQ Division of Mitigation Services to reduce impacts to the
adjacent mitigation site at this project. Michael Ellison (Director of the DMS) has earlier today provided approval of the
required revisions. These revisions have resulted in some significant changes to the hydraulic design at Bridge 910132
near Stations 20+00 to 24+00 Lt/Rt. The attached file: Bridge 910132 and Rogers Road (SR 2052) Drainage Revision
Narrative provides a comprehensive review of these hydraulic design revisions.
Note also attached REVISED FINAL stream and riparian buffer permit drawing package for the entire project. It appears
that there is no increase to jurisdictional impacts previously noted for the project in the February 4, 2016 permit
application.

The Department applied for a permit for this project on February 4, 2016. The NCDENR-DWR issued certifications for
the project on March 4, 2016. Two construction issues have come up at this time. Note the following:
Issue at Site 1 (Bridge near 21+00 -L-)
A portion of the project limits at the bridge is located within the Smith Austin Creek Mitigation Site and this use requires
coordination with the North Carolina Interagency Review Team. An existing rock cross vane installed as part of the
mitigation site is located directly at the outlet of proposed standard v ditches upstream of the bridge. The Department
proposes “field-set and integrate” the ditches to the existing rock cross vane. Specifically, the ditches will be shifted as
necessary to be slightly upstream of the top of the rock cross vane to provide at least 2 feet of separation between the
low point of the proposed ditches and the top of the rock cross vane. This solution will integrate the proposed ditches
and rock vane together, creating the most stable long-term solution.

Issue at Site 2 (Single-barrel culvert near 27+25 -L-)
The fill on the right shoulder of the road (downstream side of the culvert) exceeds the maximum allowable of 5.0 feet
for the aluminum box culvert per AASHTO specifications. We were under the understanding this 5.0’ max cover applied
under the roadway, but according to Pomona Pipes (delegate designer of the culvert) it also applies on the shoulder. As
currently designed there is approximately 5.7’ of fill at the right shoulder point.
To reduce the fill, we are proposing to raise the downstream invert 1 foot to the natural channel bed elevation. The
invert at the outlet will be set to match the adjacent downstream elevation. A mix of Class B and Class I rip rap will be
installed in the a slight blow hole (i.e. countersunk) in the streambed below the outlet. The upstream invert would
remain buried 1 foot and a one foot sill would be placed at the upstream face (slightly inset inside the culvert). A mix of
Class B and Class I rip rap will be installed in the streambed (i.e. countersunk) up to the top of sill. The countersunk rip
rap in the streambed at the inlet and outlet of the culvert is fully within the previously permitted stream improvements.
