However, since this is in a buffered basin, we are requiring you to consider the following options for diffuse flow provisions as discussed during the last meeting: (1) If site constraints would allow, please design a BMP (preferably a bioretention) to treat the stormwater runoff from the road prior to discharge into the stream. This would require sizing the BMP for whatever road area will drain to it. (2) If option 1 is not feasible, then please consider upgrading the dry pond to a wet pond to achieve a higher treatment as a way of compensating for the lack of diffuse flow. In view of all this, we shall accept it into the express program. Expect an acceptance letter shortly, I thought I should let you know where we stand. Let me know if you have questions. Thanks. It may not be a fight worth fighting, but without seeing the entire permit app, I can't really say. Your call. I would check with Brian Wrenn, David or Rob and get their input since DOT is pushing the piping, just to see how they've dealt with this issue with DOT many times before. I'd feel comfortable with what they say as far as how DOT is treated typically with this issue. Make sense? May not since I'm on sleep deprivation right now. Congrats on married life! Here is the low down... A triangular shaped lot (see ppt) that currently has a 38-ft section of perennial stream running through the corner of it. There is a 72" culvert outlet at Raleigh Beach Rd and a 6x8 box culvert inlet at New Bern Ave. The City of Raleigh is requiring the applicant to widen both Raleigh Beach Rd and New Bern Ave (see red dashed line on ppt). DOT (Reed Elmore, District Engineer) is requiring them to pipe the entire section (38 feet) completely because they will not take over steep headwalls. This would completely pipe the stream (I was thinking this would probably require a major variance). Debbie contends that "this is a road widening project in the red rule book" and should therefore not require a variance. Have you encountered projects similar to this before, if so, what was the verdict. There is an additional issue with this if this project doesn't require a variance - about treating stormwater to compensate for lack of diffuse flow.
