PROJECT SUMMARY: The applicant proposes to install subsurface utilities, boardwalk, boat storage area, pier and platform for residents of the Mill Landing subdivision. LD Atlantic, LLC Page Two 9. PROJECT NARRATIVE: The site is a 16.82-acre tract of land located on the east side of SRI 154 (Mill Creek Road), approximately 1.1 miles east of its intersection with SRI 155 (Old Winberry Road). The land is adjacent to Harlowe Creek near Newport, Carteret County, North Carolina. To find the property, take NC Hwy 70 east from Morehead City and turn left on NC HWY 101(New Bern Road). Travel approximately 10.0 miles and turn left onto SRI 155 (Old Winberry Road) and go 2.0 miles, then turn left onto SRI 154 (Mill Creek Road) and go 1.1 miles, the entrance to the subdivision is on the left. The subdivision is adjacent to Harlowe Creek near Newport, Carteret County. The tract is approximately 6' above NHW on the west side of the property and slopes to meet an area of coastal wetlands on east side of the property where it borders Harlowe Creek. The property has been cleared within the last several years. The majority of the upland area on the property is vegetated with sedge grasses with a few pine, cedar, and sweetgum trees remain on the property. The applicant has installed a paved asphalt road (20' x 700') that originates along Mill Creek Loop Road. The asphalt drive (Mill Landing Point) extends toward the east and terminates in a turn-around cul-de-sac. Utilities are currently in place and run along the right-of-way of Mill Landing Point. A graded drainage Swale and level spreader are located at the terminal end of the cul-de-sac. This stormwater feature directs run-off from the road towards the adjoining "404" and coastal wetlands located on the eastern side of the property. It should be noted that the construction of the 12-lot residential subdivision, including the driveway and utilities, are located outside of the 75' Area of Environmental Concern (AEC), and did not require approval from the Division of Coastal Management (DCM). However, the drainage swale and lever spreader are located within the AEC. The applicant failed to apply for a permit authorizing this development and as such, these activities resulted in the issuance of a Notice of Violation. The violation was resolved and the Case against the applicant has been closed. The tract has 1,805 linear feet of shoreline. An area of smooth marsh cordgrass, black needlerush, and salt meadow grass borders the shoreline to the east. There is a single-family residence on the adjoining waterfront property to the north, while the waterfront property to the south is undeveloped. Harlowe Creek is approximately 1,040' wide in the project vicinity with water depths averaging -0.5' to -3' below NLW range. Harlowe Creek is classified by the EMC as SA; HQW and is classified by the Division of Marine Fisheries as a primary nursery area. The creek has been closed to shellfishing by the Division of Environmental Health. The Carteret County Land Use Plan categorizes this area of the county as Rural, with all AEC's classified as Conservation. The Division of Water Quality has approved Stormwater Management Permits 9SW8051010 and SW6030000 for a low-density residential development on this property. PROPOSED PROJECT: The applicant proposes to install subsurface utilities, boardwalk, and pier for residents of the Mill Landing subdivision. High ground development would include the construction of a gravel community boat storage area, located immediately adjacent to Mill Landing Point, near the entrance of the subdivision. The boat storage area (80' x 175') would consist of a gravel pad, approximately 4" thick that would be encompassed by a 6' privacy fence. The storage area would be located approximately 5' from the northern most property line. Run-off from the storage area would drain towards Mill Landing Point. Addition high ground development would include the installation of a sewer line, located within the 15' septic line easement. The septic line easement would originate adjacent to Mill Landing Point Road (within the right- of-way) and extend from the common property line of Lots 1 and 2, south and west to the proposed septic drain fields (Drainfield 1 and Drainfield 2) located in the southwest corner of the subdivision. The septic easement would measure approximately 1,070 linear feet and would cut through a section of "404" wetlands. The sewer lines would be installed with an open cut trench and cut through 100 linear feet of "404" wetlands and temporarily disturb 1,500 square feet of those areas during the installation process. LD Atlantic, LLC Page Three The applicant also proposes to construct an observation platform for the community. To access the platform, a 6' wide x 280' wooden boardwalk would be constructed just landward of the Coastal Wetlands line. The boardwalk would originate between Lots 3 and 4, within the community access easement, and would be constructed perpendicular to the shoreline. The boardwalk would extend towards the east and span a 140' section of Coastal Marsh. From the outer edge of Coastal Marsh, the pier would extend another 232' before terminating in a 12' x 24' platform. A 12' x 12' section of the platform would be.! 'coerdd and th` remaining i area would be open space. As proposed, the boardwalk and the pier would be elevated 'a minimum of 36" over any wetlands. The entire length of the pier structure would measure 655' from origination to terminus. There are no boat slips proposed as part of this application package. Anticipated Impacts The proposed community boat storage area would disturb 14,000 sq. ft. of high ground, all of which is located outside of the N.C. Division of Coastal Management 75' Estuarine Shoreline AEC. This equates to 0% impervious surface within DCM's 75' Estuarine Shoreline AEC. The proposed sewer line installation would temporarily disturb approximately 1,500 square feet of "404" Wetlands. The elevated walkway to the pier is proposed within the N.C. Division of Water Quality's Neuse River Basin Riparian Buffer Zone and would disturb approximately 1,680 square feet of high ground. Sedimentation and stormwater control techniques have been planned which should minimize any impact from the development of the site. The pier would incorporate 2,292 square feet of estuarine waters and public trust area. The pier would additionally shade 828 square feet of Coastal/"404" Wetlands. No boat slips are proposed as part of this project. The pier would not extend out into the main body of the creek where traditional navigation occurs, nor would the pier extend beyond'/4 of the width of the waterbody. A localized and temporary increase in turbidity can be expected during the in-water portions of the construction of the pier. Water depths in the vicinity of the proposed platform range from 0.12' to 0.56' relative to Normal Low Water. Submitted by: J. Project Narrative The proposed development by LD Atlantic, LLC is located in Carteret County, North Carolina. The project will consist of a community pier that is accessed by private citizens of a new residential subdivision that is being developed in conjunction with the major pier devlopment. The applied for permit will be in a location that is between Morehead City, Beaufort, and Newport. The project is located in the Newport River Basin. Currently the site consists of a sparsely vegetated tract of land that has an asphalt road, utilities, and storm water control devices installed that will support the proposed 12-lot subdivision. LD Atlantic proposes to build a 6-foot wide pier that will project out onto Harlow creek, which is a major tributary for the Newport River. The pier will be of the platform type and have pickets and handrails along each side. The pier will be begin as a community accessed boardwalk that will be elevated above the existing grade until it reaches the marsh. The pier will then begin to take on a traditional shape as it projects out 400 feet from the marsh line. The pier section will end with two platforms one will be covered and one will be uncovered. Both platforms will be 12 feet by 12 feet and will be used as a place of relaxation and for viewing the surrounding waterscape. The proposed major pier permit, if approved, will allow citizens of a 12 lot single- family subdivision to access the pier for their private enjoyment. The 12 lot subdivision will have a permanent boat storage area that residents will be allowed to store private boats in, these boats will be launched and used at other locations. The end users of the pier will only be allowed use of the pier for viewing and fishing. Upon approval LD Atlantic will construct the pier using great care and workmanship to provide the future residences of Mill Landing Subdivision, Carteret County, and the State of North Carolina a unique place to view and enjoy the surrounding nature and wildlife. 1 TT.
