Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. Describe the overall project in detail, including the type of equipment to be used: The project consists of an 80-unit apartment complex clubhouse and a roundabout with connections to Cox Road and Mt Hebron Church Road as required by the City of Gastonia. The only proposed stream impact is a 36" culvert for a road crossing. 11. Explain the purpose of the proposed work: Multi-family residences IV. VII. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. By the City of Gastonia requiring two means of access and the overall layout of the property, the impact was unavoidable. We reduced impacts to the stream by moving the main entrance as low as possible to achieve as close to a perpendicular crossing as possible compared to the original conceptual plan Page 5 of 9 VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. Mitigation will be purchased as stream credits through the EEP (see the attached acceptance letter) 2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at (919) 715-0476 to determine availability, and written approval from the NCEEP indicating that they are will to accept payment for the mitigation must be attached to this form. Please note that this decision does not assure that the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be approved. This acceptance is valid for six months from the date of this letter and is not transferable. Hebron Church in Gastonia, Gaston County, North Carolina. This report summarizes our findings for the site. BACKGROUND ECS was contracted to identify the locations of waters of the U.S., including wetlands, for the above referenced site. The site contains approximately 10 acres of primarily undeveloped, wooded and cleared land. A utility easement is located in the center of the site, extending from the northwest to the southeast. Wetlands are defined by the U.S. Army Corps of Engineers (USACE) and the United States Environmental Protection Agency (EPA) as "those areas that are inundated or saturated by surface or groundwater at a frequency and duration sufficient to support, and under normal circumstances, do support a prevalence of vegetation typically adapted for life in saturated soil conditions." In order for an area to be classified as wetland, hydrophytic vegetation, hydric soils, and wetland hydrology indicates must be present. LITERATURE REVIEW ECS reviewed the USGS Topographic Map of the Gastonia North quadrangle, the Web Soil Survey of Gaston County, the Geologic Map of North Carolina and the U.S. Fish and Wildlife's National Wetlands Inventory (NWI) to obtain information regarding the site. • The USGS Topographic Map (Figure 1) does not show surface waters on the subject property. Depressions in the topography do indicate that there is a potential for drainage features in the central portion of the site. According to the topographic map, the Smyre Tributary of Duharts Creek is located adjacent to the eastern property boundary. Duharts Creek is approximately 4,000 feet south of the site. The USDA's Natural Resources Conservation Service Web Soil Survey for Gaston County (Figure 2) shows soils on the site are mapped as having three soils in the Tatum Series. The soils in this series include gravelly loams 2 to 8%, 8 to 15% and IS to 25% slopes. The Tatum soils on-site are generally classified as well drained soils with moderate permeability. The Tatum Series is common of broad and narrow ridges in the Kings Mountain Belt. A small area at the southwest corner of the site could potentially contain Cecil-Urban land complex soil. No soils on the North Carolina Hvdric Soils List for Gaston County were identified on the soil survey of the site. The Geologic Map of North Carolina indicates that the site is located in the Kings Mountain Belt of the Piedmont Physiographic Province. The soils encountered in this area are the residual product of in-place chemical weathering of rock presently underlying the site. In general, shallow unconfined groundwater movement within the overlying soils is controlled largely by topographic gradients. Recharge occurs primarily by infiltration along higher elevations and typically discharges into streams or other surface water bodies. The elevation of the shallow water table is transient and can vary with seasonal fluctuations in precipitation. Movement in this water table is generally from higher to lower elevations. As such, shallow groundwater on the site would be expected to flow east to southeast towards Smyre Tributary and Duharts Creek. The NWI database was reviewed to determine if wetlands in this area had been documented. According to the database, no wetlands are documented on the site (Figure 3). SITE RECONNAISSANCE ECS personnel conducted the site reconnaissance on December 12, 2007. The site contains undeveloped, wooded and cleared land. A utility easement is located in the center of the site, extending from the northwest to the southeast. During our reconnaissance, ECS observed the site for evidence of stream channels, wetlands and ponds. Reconnaissance of the southeastern portion of the site revealed a stream having a hydrologic connection to Smyre Tributary, located adjacent to the eastern perimeter of the site. The stream extends to the northwest eventually exiting the site via a culvert located beneath Cox Road. This surface water had an evident ordinary high water mark on both sides of the embankment. The ordinary high water mark varied from one-half foot to one foot high, depending on the width of the stream. Vegetation observed along the stream's embankment included dense greenbrier, red maple and dogwood. The stream had several meanders and a defined bed at the time of ECS' site visit. Standing water was observed in some areas of the stream; however, a majority of this stream remained dry and did not appear to contain features indicative of benthic habitat support. In addition, this stream has been altered by the construction of a utility easement containing a sewer line that extends through the property. It is the opinion of ECS that the stream is intermittent. ECS flagged the centerline of the intermittent stream. Flag locations are identified from the western property boundary, near the Cox Road culvert, to the eastern property boundary. To estimate the average width of the stream, the approximate width of the stream at each location is identified on the flagging (ex: AW 5'). Wetland hydrology indicators (including inundation and saturated soils) and hydric soils (low chroma soils) were not observed adjacent to the stream or within the property boundaries, Vegetation observed is common to uplands and wetlands. Examples of vegetation observed included; red maples, hickory, loblolly pine and greenbrier. A routine wetland determination data form supporting our opinions is included in the attachments. Figure 4 shows the approximate location of the stream within the property boundaries.
