I wanted to update you on the status of the 401 water quality certificate. The state will receive public
comments through Friday, May 2. No comments had been received as of Monday, April 28, but is
expected to change shortly. As you can see below, Stanly County is distributing an email and sample
letter that encourages residents to ask the state to deny the 401.
Again, I hope you will consider providing your own comments on this issue. When you comment, please refer
to DWQ Project Number 2007-0812 in your response. Comments should be sent to the N.C. Division of Water
Quality, Wetlands and Stormwater Branch, 2321 Crabtree Boulevard, Raleigh, NC 27604, Attn: John

Friends and Supporters:
Many of you have taken time out of your busy schedules to learn more about our state's effort to protect and
save our water rights. I would like to thank each and every one of you for your time, as well as your daily show
of support. Your emails and phone calls have helped bring more awareness and needed attention to this critical
issue of North Carolina water policy. The upcoming federal ruling by the Federal Energy Regulatory
Commission (FERC) whether or not to relicensing The Yadkin Project to the multinational corporation Alcoa will
impact all North Carolinians.

I have listed below important information on a new opportunity to save our North Carolina water rights, as well
as instructions on how you yourself can help make a difference. I have also attached a sample letter to help you
comment to an application for a water quality certificate for the hydroelectric power plant on the Yadkin River
(details are below). If at all possible, please send a comment letter and encourage other friends, family and
co-workers to do the same. All letters must be dated, signed and sent by mail (or email) no later than
Thursday, May 1. This is the most important thing we can do to make a difference for our children.

We Must Act Now To Save Our Water Rights
Concerned citizens of North Carolina, act NOW to save your water rights. The N.C. Division of Water Quality is
seeking public comments regarding an application for a water quality certificate for the hydroelectric power plant
on the Yadkin River. The water quality certificate comment period allows the public to address environmental
concerns related to the waters of the Yadkin that affect plant and animal ecosystems and harm humans due to
exposure or ingestion.
We can seize this opportunity to request a public hearing on the issuance of water quality certificate from the
state's Department of Environmental and Natural Resources, which oversees the division. The question of
water rights already has been raised in opposition to this project by Gov. Mike Easley, the commissioners of
Cabarrus, Davidson, Iredell, Randolph and Stanly counties, the Centralina Council of Governments, and many
other leading officials, governing bodies and citizens of North Carolina. This is our chance as citizens to do the
same.
Your comments should ask for a full public hearing on this matter and request that North Carolina consider all of
the impacts caused by the hydro project, including the contamination at the Badin Works. There is no
guarantee that the request for a public hearing will be granted. However, the stronger opposition shown during
the public comment period, the greater the likelihood will be that a hearing will occur.
Therefore, we urge ALL of you before the deadline of Friday, May 2 to contact John Dorney at the N.C.
