The newspaper published a Public Notice for an application for a 401 Certification for the proposed FERC license renewal on April 17, 2008. Please note that in accordance with 15A NCAC 2H.0503(f), an applicant for an Individual Certification shall pay to the department the costs of advertising public notices required by 15A NCAC 2H .0503 (f) of the 401 Certification Rules. Please remit payment in the amount of $108.24 to the Stanly News and Press at your earliest convenience and provide a copy of your letter and a copy of the check to the DWQ. The activity for this Certifica- tion is sought to issue a 401 Certifica- tion for the Federal Energy Regulatory Commission license for the Yadkin Hy- droelectric Project (FERC No. 2197) in Stanly County for dams at High Rock Reservoir, Tuckertown Reservoir, Nar- rows Reservoir and Falls Reservoir. The application for the project includes plans to address dissolved oxygen is- sues in the Yadkin River downstream of the dams, modify the minimum low flow in the river and conduct flow monitoring in the river. In addition, water quality- related items in the Relicensing Settle- ment Agreement dated February 2007 are also proposed to be incorporated into the 401 Certification as well as a condition related to the removal of sedi- mentation at the City of Salisbury water intake on the Yadkin River. The Divi- sion issued a 401 Certification for this project on November 16, 2007. Howev- er that Certification is hereby revoked because conditions under which the certification was made have changed (15A NCAC 2H. 0507 (d)(2). The Divi- sion plans to reissue a Certification for this project after the public comment period has closed and after we have considered all information submitted to the Division in response to this Public Notice. The public is invited to comment on the above-mentioned application to the Di- vision of Water Quality. Comments shall be in writing and shall be received by the Division no later than May 2, 2008.
