Thank you for meeting at the site with Greg. Sorry I couldn't make it.
Attached please find the correct agent authorization form signed by Mark
Hunter. I have also attached the letter from Erickson to the Town of
Matthews indicating their willingness to donate the eastern 20-acres of
the total property to the Town (see item 42). We will address your
concerns with the wetland/groundwater connections in our mitigation plan
we are preparing this week. Please call if you have any other questions

A couple of comments (minor):
--I don't have a proper agent authorization or signature. Item "A" from
the letter.
--The drainage thru the center of the site, may need a "french drain" or
similar structure to facilitate groundwater flow to the wetland that is
to remain undisturbed.
--It would be good to have a note in the file that the undeveloped
section is being turned over to the county.
--Everything else appears to be fine.

Rezoning Petition #514
Dear Mayor and Commissioners,
Erickson Communities is pleased to submit its final rezoning package for Rezoning Petition
#514 which we believe incorporates all of the additional commitments made during the
Matthews Board of Commissioners meeting on August 27, 2007. Examination of this Rezoning
package will reflect that the revised development standards address the following substantive
matters:
1. Erickson Communities, in taking a leadership role in helping mitigate some of the Town
of Matthews' ongoing and growing traffic problem, pledges and commits to a single
payment of $3,000,000 toward the extension of McKee Road, or toward any other
roadway improvement that the Town deems most important and beneficial to Erickson
Communities and other residents in the vicinity of the Erickson project (Development
Standards 1.04)
2. Erickson Communities will deed 20+ acres at the intersection of McKee Road and
Pleasant Plains Road to the Town of Matthews.
3. Erickson Communities for itself and its successors and assigns obligates to pay ad
valorem property taxes on its Continuing Care Retirement Community (including the
assisted living units and the long term skilled nursing care units) in perpetuity to the
Town of Matthews and the County of Mecklenburg even if its successor is a not-for-
profit 501(c)(3) entity and even if the Continuing Care Retirement Community might
otherwise be fully or partially exempted from the payment of any such taxes. This
obligation may be accomplished through use of a Payment in Lieu of Taxes program or
such other method or procedure as Matthews' Town Attorney may recommend.
4. Erickson will increase the masonry on the campus's Residential Buildings to 50% and
on the campus's Community Buildings to 80% of the total elevation area (Development
Standard 6.01).
5. Erickson will make changes to its revised Site Plan that include a commitment to
increase the tree buffer at the west boundary to the existing homes, moving the roadway,

eliminating 2 wings of the building nearest the west boundary of the Site, adding buffer
planting materials along the Village of St. Andrews subdivision, and extending the berm
at McKee Rd and Pleasant Plains Rd. (see Development Standards 7.01 through 7.05)
6. Erickson will reduce the density and number of Independent Living Units (ILUs)
from 1,200 ILUs to 1,100 ILUs (Development Standard 3.01).
7. "Erickson-employed security staff will act as First Responders on behalf of the Town
of Matthews' Emergency Medical Response Team, as it relates to our residents. Our
participation in this program will also be accompanied with annual training and start-up
equipment required for our staff that Petitioner will purchase as outlined in Development
Standard 10.02.
8. Erickson Communities commits to paying a Fire Impact Fee for each residential,
community, and assisted living/ skilled nursing building (RB, CB, and RG) consisting of
13 buildings at $20,000/each for a total commitment of $260,000, due and payable at the
time of the issuance of each project's building permit as additionally outlined in the July
3, 2007 memo (Development Standard 10.03).
9. In an effort to strive to coordinate the development taking place on the Site with
anticipated future roadway improvements, development will be phased. Erickson agrees
to limit the occupancy of independent dwelling units to two hundred fifty (250) units per
calendar year, beginning with the year 2008, with the understanding that to the extent that
less than two hundred fifty (250) such units are occupied in a given year the difference or
shortfall may be carried forward to future years and developed and occupied in addition
to the two hundred fifty (250) units applicable to the particular calendar year involved.
This phasing requirement shall only apply to independent dwelling units and not to the
development of assisted living units, long term skilled nursing care units or community
buildings. (Development Standard 3.01)
10. Erickson Communities commits to a single payment of $1,000,000 to the Town of
Matthews for use by its Parks, Recreation, and Cultural Resource Department for the
construction and/or improvement and/or maintenance of new or existing public parks in
its system. This payment will be made at the time of the issuance of a certificate of
occupancy for the first residential building constructed on the Site. (Development
Standard 1.06)
