(Yadkin Hydroelectric Project) DWQ # 2007-0812, FERC Project No. 2197 The purpose of this memo is to inform you of a Public Notice that was published in the Stanly News and Press on April 17, 2008 concerning a proposed 401 Certification for the Yadkin Hydroelectric Project in Stanly County as proposed by Alcoa Power Generating, Inc. (APGI). NORTH CAROLINA DIVISION OF WATER QUALITY 401 Certification for High Rock Reservoir, Tuckertown Reservoir, Narrows Reservoir and Falls Reservoir for FERC relicensing PUBLIC NOTICE is hereby given that Alcoa Power Generating, Inc. has applied to the North Carolina Division of Water Quality for a Water Quality Certification pursuant to Section 401 of the Federal Clean Water Act and Water Quality Commission rules in 15A NCAC 2H .0500. The activity for this Certification is sought to issue a 401 Certification for the Federal Energy Regulatory Commission license for the Yadkin Hydroelectric Project (FERC No. 2197) in Stanly County for dams at High Rock Reservoir, Tuckertown Reservoir, Narrows Reservoir and Falls Reservoir. The application for the project includes plans to address dissolved oxygen issues in the Yadkin River downstream of the dams, modify the minimum low flow in the river and conduct flow monitoring in the river. In addition, water quality-related items in the Relicensing Settlement Agreement dated February 2007 are also proposed to be incorporated into the 401 Certification as well as a condition related to the removal of sedimentation at the City of Salisbury water intake on the Yadkin River. Further, the 401 Certification issued by the Division on November 16, 2007 is hereby revoked in accordance with 15A NCAC 2H .0507(d)(2) because of a change of the conditions under which that 401 Certification was issued. The change of conditions is a determination by the Division that the prior public notice of this 401 Certification apparently did not conform with the public notice provisions of 15A NCAC 2H .0503. The Division plans to reissue a Certification for this project after the public comment period has closed and after we have considered all information submitted to the Division in response to this Public Notice. The public is invited to comment on the above-mentioned application to the Division of Water Quality. Comments shall be in writing and shall be received by the Division no later than May 2, 2008.
