Construction Stormwater Permit Inspections

On March 27, 2008, Mr. Chad Coburn from the Wilmington Regional Office of
the Division of Water Quality conducted a site inspection for the tract/project known as
Willowick Phase I, located off of Navaho Trail, Wilmington, North Carolina. The site
visit and file review revealed that the subject project has an approved Erosion and
Sedimentation Control Plan and is covered by Stormwater General Permit NCGO10000.
This project was inspected for compliance with the 401 Water Quality
Certification (WQC) #3402 with Additional Conditions granted on November 29, 2006
for the construction of a residential subdivision known as Willowick Phase I.
The WQC approved the impact of 0.35 acres of wetland and 72 feet of stream to
complete your project as described in your September 19, 2006 application. The impacts
as built, appear to be within the limits of approval with the exception of Impact D. There
was no stormwater flume observed during the inspection at this impact area as described
in the application.
In addition, the project was inspected for compliance with the Construction
Stormwater General Permit (NCGO10000) that is issued upon the approval of an Erosion
and Sedimentation Control Plan. This permit applies to projects that receive a Division
of Land Resources (DLR) (or local delegated program) Erosion and Sedimentation
Control Plan for land disturbance of 1 acre or greater. Specifically, the General Permit
(NCGO10000) authorizes the discharge of stormwater under the National Pollutant
Discharge Elimination System (NPDES) in accordance with Title 15A North Carolina
Administrative Code 2H.0100.

The following observations were noted during the Division of Water Quality
inspection:
1) Approved Plan (Part I, Section A: No. 2.)
During the inspection, a copy of the approved Erosion and Sediment Control Plan was on
site and available for review.
2) Rain GauEe (Part I. Section B. No. 1.)
A rain gauge was observed on site at the time of inspection.
3) Rain Gauge Data (Part I. Section B. No. 1.)
Rain gauge data, measured daily, was on site and available for review.
4) Minimum Monitoring and Record Keeping (Part I. Section B. No. 3)
Inspection records of erosion & sedimentation control measures and stormwater
discharges, collected weekly and after every half-inch or greater rain event, were on site
and available for review.
5) 401 Water Quality Certification
A 401 Water Quality Certification with Additional Conditions covered by certification
number 3402 was granted by the DWQ on November 29, 2006.
Condition 8 of this certification requires: "Deed notifications or similar
mechanisms shall be placed on all retained jurisdictional wetlands, waters and
protective buffers in order to assure compliance for future wetland, water and
buffer impact. These mechanisms shall be put in place at the time of recording of
the property, or of individual lots, whichever is appropriate. A sample deed
notification can be downloaded from the 401/Wetlands Unit web site at
http://h2o.enr.state.nc.us/ncwetlands. The text of the sample deed notification
may be modified as appropriate to suit to this project."
Provide a copy of the recorded deed notifications to this office once these
mechanisms are put in place.
As a reminder, you are limited to the impacts proposed in your application and you must
continue to comply with all additional conditions regarding deed notifications, erosion
and sediment control practices, protective fencing, and culvert placement and installation.
If you change or modify your project you must notify us and you may be required to send
us a new application. If the property is sold, the new owner must be given a copy of the
Certification and approval letter and is thereby responsible for complying with all
conditions. If total fills for this project (now or in the future) exceed one acre of wetland
or 1501inear feet of stream, compensatory mitigation maybe required from DWQ as
described in 15A NCAC 2H .0506(h). Upon completion of all work approved within the
401 WQC, and any subsequent modifications, the applicant is required to return the
enclosed certificate of completion to the 401 Oversight/Express Review Permitting Unit,

Violations of any condition set forth in the Certification and Additional Conditions may
result in revocation of this Certification and may result in criminal and/or civil penalties.
The authorization to proceed with your proposed impacts or to conduct impacts to water
as depicted in your application and as authorized by this Certification shall expire upon
the expiration of the 404 or CAMA Permit.
