The road shotilder is very narrow and has a severe drop down to the stream upstr•eam of the bridge. Vehicles have slipped-off the road here since construction of the bridge wmmenced. Therefore, we are requesting modification of the petmit for a culvert extension that would allow for enough shoulder width to install guaidrail and improve safery. The stream through the culvert is small witl� a steep gradient and cobble step pool morphology. It is probably too small to support trout, but it does suppoi4 insects and other aquatic life. Woodfin Creek downstr•eam of the culvert supports wild rainbow trout The existing culvert has a low outlet perch. After extending the culvert by 10 feet, 2-3 boulder steps would be constructed below the new outlet to eliminate the perch and promote aquatic life passage. The steps should also help promote the retention of some bedload in the culvert. Enclosed are a PCN application, Preliminaty Jurisdictional Foim, an annotated photo showing the proposed work, a USGS quad map, photographs of existing conditions, and other pertinent project information. The North Carolina Natural Heritage Program database was checked for records of threatened and endangered species. There ate 63 species with federal status that are known in Jackson County fi�om current or historical records. Of these, eight species, Carolina Northern Flying Squirrel (Glnarconrys sabr•ini�s colornnis), Indiana bat (1Llyotis sodnlis), Appalachian elktoe - - — — ---- - - ---- - -- Pourteenth Division Office Telephone: (828) 586-2141 253 Nebster Road, Syh•a, North Carolina 28779 Far: (828) 586-A043 B 164 Modification 2 September 29, 2016 SR 1462 Culve�t Extension (Alnsmidonta rnvenelinnn), spruce-fir moss spider (Microhesurn n�ontivaga), small whorled pogonia (Isotrrn medeoloides), swamp pink (Helonins bullaia), rock gnome lichen (Gymnoderma lineare), and northern long-eared bat (Myolis seplenh�ionulis, NLEB), are listed as either tlu�eatened or endangered. Jackson County is considered occupied summer and winter habitat for Indiana bats and the project falls within a HiJC where there are known NLEB hibernacula or maternity roosts. Appalachian elktoe are found in some well-osygenated sh•eams with moderate to fast flowing water and stable, mixed substrates of silt, sand, gravel, andlor cobble. Streams that support this mussel are typically much larger and warmer than Woodfin Creek. The only records in Jackson County are from the Tuckasegee River. The culvert is over 12 miles upstream of the Tuckasegee River. NLEBs and Indiana bats winter in caves or mines with stable, but not freezing cold temperatures. This project only involves a small culvert extension without the need for blasting or pile-driving. There are no caves or mines visible near the bridge. And, according to USGS data, the nearest underground mine is over 1.1 miles away. In summer, NLEBs and Indiana bats generally roost under the loose bark of trees, either dead with peeling bark or cavities, or live trees with shaggy bark such as white oak, maples, sycamore and hickories. There are S large trees near the esisting culvert outlet that must be cleared for the work, including a hickoiy and black cheriy, but none of the trees have extensive peeling bark or knot holes that would be ideal for roosting. And, the project area is on the cool, north side of a steep, heavily shaded, and naii•ow valley where bat roosting would seem unlikely. Nonetheless, the tree removal will be completed from October 15 to April 15 to avoid the seasons when either species of bat may be roosting in trees. With �vinter tree clearing, we recommend a"may affect, not likely to adversely affecY' deteirnination for Indiana bat and NLEB. Swamp pink will not be affected by the project because of a lack of wetlands in the work area. Habitat is too shaded and too damp near the culvert to suppoit small whorled pagonia. The Carolina northern flying squirrel, rock gnome lichen, and spiuce-fir moss spider aze found in spruce-fir forests and other isolated high elevation locations in western Noi4h Carolina. However, rock gnome lichen is an exception because it can occasionally be found at lower elevations in deep river gorges with high humidity or on some vertical rock faces that are periodically wet. These species have been found witliln a few miles of the bridge, but at much higher elevations. The culvert site is at an elevation of only 3,040 feet and lacks rock faces and other habitat conditions required by these species. The project is limited in scope to a small culvert extension. Erosion and sedimentation control measures will be used to protect aquatic habitats. Habitats for listed species appear lacking at the project site and none of these species were observed during the field visit. For these reasons and those discussed above, we recommend that, escept for NLEB and Indiana bat, a determination of "no effect" on listed species apply to this project. B 164 Modification 3 September 29, 2016 SR 1462 Culvert Estension This project will not affect archeological resources or historic architecture propeities because all work will be conducted in road fill and shoulders and in an active stream channel. The bridge project was reviewed by the NCDOT Human Environment Unit and surveys for cultural resources were not required. Impacts to Waters of the United States The UT to Woodfin Creek (DWQ Class: C Tr) is shown on the USGS topographic map as a perennial stream. The channel is approximately 2 feet in width and well defined with a subshate of sand, gravel, and rock. The stream is probably too small to support trout, but it supports insects and other aquatic life. Woodfin Creek, which is about 600 feet downstream of the culvert, supports wild rainbow h�out and flows to Scott Creek, which the flows to the Tuckasegee River River. The Tuckasegee River meets the definition of a Traditional Navigable Water (TNW). For these reasons, we believe Woodfin Creek is a Relatively Permanent Water (RPVI� and is under the jurisdiction of the U.S. Army Corps of Engineers. In order to construct the project, it will be necessaiy to impact waters of the United States in the Little Tennessee River Basin (HCU 06010203). Specifically, NCDOT is requesting to extend a culvert in a UT to Woodfin Creek. The culvert extension is the minimum amount needed to obtain enough shoulder width for new guardrail. Moreover, the rock step design should address an existing perched culvert outlet condition and facilitate aquatic life passage. 1 b.
