We are also requesting a 401 WQC and Riparian Buffer Authorization from NCDWR for 15,613 SF (Zone 1: 7,143 SF; Zone 2: 8,470) of permanent impacts and 7,321 SF (Zone 1: 5,603 SF; Zone 2: 1,718 SF) of temporary impacts to riparian buffers. The project is ±8,784 linear feet in length, extending north from Lakewood Park (35.239722°N; - 81.889582°W) located on Greenwood Place, to an existing greenway trail at the South Fork Village Apartments on US Hwy 29/74 (35.249444°N; -81.071667°W), in the Town of Cramerton, Gaston County, NC. The project is located in the Catawba River basin and onsite waters drain to the South Fork Catawba River. The Water Quality Classification for this section of the South Fork Catawba River is WS-V, and the Stream Index Number is 11-129-(15.5). The cataloging unit for the site is 03050102. Proposed Project The purpose of the proposed project is to construct a greenway trail which will connect the existing greenway at the South Fork Village Apartments, located north of US Hwy 29/74, to the existing Lakewood Park to the south. Project Historx Onsite streams and wetlands were delineated by WithersRavenel on January 27, 2015 and July 1, 2015. We have included a Preliminary JD Request Packet with this submittal in support of the delineation. Please note that the PJD Request is specific to the proposed impact areas only. WR is requesting issuance of the PJD in conjunction with the issuance of the NWP 14. The proposed project is located within the Catawba River basin, and therefore is subject to Catawba River Riparian Buffer Rules. In conversations with Alan Johnston with NCDWR in July 2015, the 50' Catawba riparian buffers are offset from the 569' contour, which is reflected in the attached Buffer Impact Exhibits. The Town of Cramerton has obtained dedication of the easement associated with the greenwax trail for the portions of the greenway not entirely within the property owned by the Town of Cramerton. Proposed Impacts The proposed impacts consist of 0.010 acres of permanent wetland impacts, 0.117 acres of temporary wetland impacts, 15,613 SF (Zone 1: 7,143 SF; Zone 2: 8,470) of permanent riparian buffer impacts, and 7,321 SF (Zone 1: 5,603 SF; Zone 2: 1,718 SF) of temporary buffer impacts. No stream impacts are proposed. The proposed 0.010 acres of permanent wetland impacts and 15,613 If of temporary riparian buffer impacts will occur from fill associated with construction of the greenway trail. The proposed 0.117 acres of temporary wetland impacts and 7,321 If of temporary buffer impacts are necessary for the temporary construction access during construction of the proposed greenway. Avoidance and Minimization Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and waters could be minimized. Page2of4 Lakewood ParkTrail - NWP 14 PCN September 9, 2016 1 The project has been designed to avoid existing streams and wetlands to the maximum extent possible, while providing connection from the existing greenway to the north to Lakewood Park. The greenway alignment has been designed to utilize an existing sewer easement to minimize impacts. However, due to the natural topography associated with the alignment, additional fill must be placed on the existing slope in order to support the greenway. The four proposed permanent wetland impacts (Impacts #2, #3, #5 &#6) are required to provide stabilizing fill for the greenway, which is necessary due to the relatively steep topography in this specific area. The four temporary impacts (Impacts #1, #4, #7, #8) are required for construction purposes only, and will be restored to natural grade and seeded with a wetland seed mix to restore wetland vegetation. The greenway trail has been designed to utilize an elevated pedestrian boardwalk to cross the intermittent stream and wetlands in order to avoid impacts at this crossing, as detailed in Exhibits 4, 4A & 5. The proposed boardwalk will cross the stream perpendicular to the channel. Mitigation There are no stream impacts associated with the project, and permanent wetland impacts total less than 0.10 acres; therefore, there is no proposed mitigation. Additionally, greenways are categorized as `Allowable' within the Catawba River Riparian Buffer Table of Uses, and therefore, no buffer mitigation is proposed. Stormwater Management Based on low impact and established vegetation throughout the project area, it is not anticipated that a SWMP is required for the project; however, WR is currently working with the Gaston County Department of Natural Resources, Stormwater Control Division to determine if a Stormwater Management Plan is required for the project. If a determination is made requiring stormwater control measures, WR will submit a stormwater management plan to Gaston County for delegated local government approval. The current request is for 0.010 acres of permanent wetland impacts, 0.117 acres of temporary wetland impacts, 15,613 SF (Zone 1: 7,143 SF; Zone 2: 8,470) of permanent buffer impacts & 7,321 SF (Zone 1: 5,603 SF; Zone 2:1,718 SF) of temporary buffer impacts. The site review identified potential habitat for three federally protected species: Schweinitz's sunflower, the dwarf- flowered heartleaf, and the Northern long-eared bat. On August 18, 2015, WR conducted a pedestrian survey for the Schweinitz's sunflower, which is during the USFWS optimal survey window. The pedestrian survey was conducted within the review area and immediately adjacent areas. Prior to conducting the survey, WR reviewed a reference population of Schweinitz's sunflower at the NC Botanical Gardens in Chapel Hill to determine the stage of growth to expect during the survey. One species of sunflower was identified during the survey, however, through coordination with Dale Suiter with USFWS this species was identified as Helianthus decapetalus and not Helianthus schweinitzii. The pedestrian survey did not identify the presence of any Schweinitz's sunflower. Therefore, the proposed project will have No Effect on Schweinitz's sunflower. In addition, WR conducted a pedestrian survey for the dwarf-flowered heartleaf. This survey was conducted outside the optimal survey window; however, the perennial herb is present in non-flowering form year-round. The pedestrian survey was conducted within the review area and immediately adjacent areas. Prior to conducting the survey, WR reviewed a reference population of dwarf-flowered heartleaf at the NC Botanical Gardens in Chapel Hill to determine the stage of growth to expect during the survey. The pedestrian survey did not identify the presence of any dwarf-flowered heartleaf. Therefore, the proposed project will have No Effect on dwarf-flowered heartleaf. Potential habitat for the northern Long-eared bat (NLEB) is listed as mature forest with trees over 3" dbh, which is used for roosting during the day. The proposed project area contains forested areas with trees over 3" DBH, and therefore is considered potential northern long eared bat habitat. The USFWS Final 4(d) rule for the Northern Long-Eared bat specifies that tree removal within the White Nose Syndrome (WNS) Zone is not prohibited as long as it occurs more than 0.25 miles from known hibernacula and does not result in destroying known occupied maternity roost trees, or any other trees within a 150 ft-radius from the maternity tree, during the pup season (June 1— July 31). The proposed project is not located within 0.25 miles of any known hibernacula, nor is there any known maternity roost trees present on the project. Additionally, clearing of mature forest between June 1S� and July 315t is not anticipated for construction of the proposed project. Therefore, WR concludes that the project "may affect, but is not likely to adversely affecY' the northern long- eared bat. 6. Essential Fish Habitat (Corps Requirement) 6a.
