Please find the attached letter from Mr. Osteen to address comment #1 from your initial email below.
Here's what I already sent you on 8/22/16 to address your comment #2:
Andrew, I'm happy to discuss #2 further, but in general there are a few knowns and corresponding assumptions we are
making, and we are planning the construction in a manner that will allow us to actively adapt to conditions as we
encounter them:
1. There is an upstream pond and we think this is capturing a large quantity of the watershed sediment.
2. We expect that a partially formed channel is already present in the former pond where no restoration is
proposed. We also anticipate from our surveys that the gradient is fairly gentle, around 1%.
3. We anticipate that material that may be clogging any partially formed channel(s), is most likely sand and that we
can get it to settle out at the lower end of the pond during the drawdown process — in that vein, we anticipate
that we will leave or create a sump (or multiple sumps) in the lower end of the pond until a couple of flows flush
some of the initial material down from the upper half (the current outlet structure appears crushed and no
evidence of flow through that structure is present at the outlet so we do not envision this as path for sediment
loss, further the pond elevation is dictated by the debris jammed in the breach)
4. We plan to use a staged drawdown approach to manage sediment and to evaluate while we work. The pond
level will be pumped down, then debris will be removed, and so on and so forth.

Jake,
On July 28, 2016, the Division of Water Resources (Division) received your application dated July 26, 2016, requesting a
401 Water Quality Certification from the Division for the subject project. The Division has determined that your
application is incomplete and cannot be processed. The application is on hold until all of the following items are
addressed:
A portion of the work is proposed on, or may need to be conducted on, property owned by Mitchell Osteen.
Please provide documentation from Mr. Osteen acknowledging and authorizing the proposed work.
The remnant stream channel within the pond footprint has the potential to contain a significant amount of
accumulated fine sediment, which, if present, could mobilize after the first storm event following the dam
removal. How do you plan to address this sediment, particularly in the upper reach of the former pond where no
restoration is proposed?
