BREC has been authorized as the agent for Mr. Miller to assist in responding to this NOV and further to bring the site into full compliance. Attached to this letter is our PCN submittal for a 401 and 404 permit. As you can see we are asking to leave the pipe in place for the parking area. A 2' portion of the pipe will be removed on the downstream end of the stream and restored per the plan. Additionally the client will commit to livestaking the entire length of the stream on is property per the plans to further enhance water quality and wildlife habitat be creating a dense stream side buffer. We believe that the pipe and addition of the parking area is necessary because previously employees parked adjacent and around the facility up the hill. This caused a life safety issue by not having opening and accessible means of fire truck access and ingress egress for evacuation. The only practical alternative to adding the additional space was to add the parking area and the pipe. Mr. Miller was not aware that this was not permitted without a 401/404.
