PROJECT SUMMARY: The applicant proposes to expand the existing marina basin, install a new bulkhead, two floating docks, boatlift and perform maintenance dredging adjacent to the subject property. Charles Booth Page 2 9. PROJECT DESCRIPTION: The applicant has requested that the subject CAMA Major Permit Application be processed under the Express Review Permitting Program. The project site is located at 1222 Mallard Bay Road, adjacent to Mallard Bay (dredged canal) and the AIWW, near Hampstead, Pender County. The lot is approximately 0.22 acre with roughly 81' of shoreline frontage. The lot averages Y-5'above mean sea level. A deteriorating wooden bulkhead stabilizes the property's shoreline. The property is currently developed (residence) and vegetation consists of lawn grasses and landscape shrubs. There are no Section "404 type" wetlands or coastal wetlands located on the property; however, there is a section of coastal wetlands immediately north of the property. The Pender County Land Use Plan classifies the adjacent waters as Conservation, and the adjacent high ground portion of the project area as Urban Growth. The waters of Mallard Bay, in the vicinity of the project site, are classified SA by the N.C. Division of Water Quality. The N.C. Division of Marine Fisheries designates the waters as a Primary Nursery Area. According to maps provided by the Division of Environmental Health, Shellfish Sanitation Section, the waters adjacent to the project site are OPEN to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to expand the existing marina basin, install a new bulkhead, two floating docks and boatlift, and perform maintenance dredging adjacent to the subject property. The applicant proposes to remove the dilapidated bulkhead and pier structure, and construct a new 81' section of bulkhead approximately 4' landward of the existing bulkhead, resulting in expansion of the existing boat basin. Approximately 276 sq. ft. of high ground would be excavated as a result of the basin expansion and bulkhead installation. A new wing wall would be constructed along the southern side of the basin and extend approximately 10' towards the south. A new "L-shaped" section of floating dock (6' x 24' and 6' x 20') would be constructed immediately waterward of the proposed bulkhead, within the footprint of the basin. The floating docks would span towards the north and east. A 13' x 13' boatlift would be installed just south of the proposed floating dock (also within the basin). Lastly, the applicant proposes to perform maintenance dredging (41' x 60 x -5.5') immediately adjacent to the bulkhead, within the man-made canal. The limits of the dredging activity would extend to the northern and southern riparian boundary and east towards the center of Mallard Bay Canal. Existing water depths vary in the vicinity of the proposed dock and range from +1' to -3', relative to Normal Low Water (NLW). A long arm excavator would be utilized for the dredging operation and would be stationed on high ground, just landward of the bulkhead. The material would be loaded into dump trucks and then transported to the Running Deer Landfill, located off NC HWY 210, near the Martin Marietta quarry, in Pender County. The applicant has received approval from the landfill, allowing disposal of approximately 300 cu. yds. of dredge spoil. Charles Booth Page Three 10. ANTICIPATED IMPACTS The proposed floating dock would incorporate approximately 441 sq. ft. of estuarine waters and public trust area. The proposed bulkhead would result in the disturbance of approximately 1,458 sq. ft. of high ground (81' x 18' of disturbance resulting from tie back installation). The proposed high ground excavation would result in the removal of approximately 276 sq. ft. (+/- 84 cu. yds.) of material. In addition, approximately 276 sq. ft. of public trust and estuarine waters would be created as a result of the excavation activities. The proposed maintenance dredging would disturb approximately 2,400 square feet of previously disturbed bottom area. The project would include the removal of approximately 200 cubic yards of material from the system. Minor increases in turbidity can be expected during construction, however no long impacts are anticipated. The proposed docking system would not extend beyond the existing pier-head line, nor would it extend beyond '/4 of the width of the water body. Furthermore; the applicant is proposing to dredge the bottom of the Mallard Bay Canal adjacent to the above mentioned property. Mallard Bay is located adjacent to the Intracoastal Waterway approximately 2.0 miles west of Topsail Beach, North Carolina. Waters of Mallard Bay are classified as SA Waters by the North Carolina Environmental Commission (EMC). The existing structures include a 20ft X 4ft pier, a 12ft long trapezoidal shaped dock, a hydraulic boat lift and the remnant footer structure of former boat house all of which will be removed. A bulkhead currently extends from the adjacent property to the north across the property and separates the upland portion of the property from the water. The portion of this bulkhead (44ft in length) that extends across the property will be removed. A new bulkhead of the same length will be constructed 4ft inland; therefore excavation of an area of approximately 4ft X 44ft (176s.f.) of upland will be required. Water depths in the vicinity of the proposed floating dock system range from +1.5ft NLW to -3.3ft NLW, therefore, dredging will be required. The proposed dock system construction includes two floating docks positioned in an "L" shape with a triangular transition piece. One dock will extend parallel to the shoreline and will be 20ft long the other will extend perpendicular to the shoreline and will be 24ft long. Each floating dock will be 6ft in width. A hydraulic boat lift will be constructed adjacent to the 24ft floating dock.
