On Friday we met out on Site 10 to view the sediment loss and discuss how we move forward from here with the
contractor. You asked that I write down essentially the minutes of the meeting. Below I have inserted my Engineer’s
Weekly Summary for Friday 8/5/16. It is long, but I think it accurately goes over every aspect of what was discussed at
the meeting. I figured this was the best way to totally capture what happened that day. I have received the attached
letter from Dragados, but it is mainly an apology letter. I asked on Saturday for their immediate action plan and Angel
stated that they should have it by Monday. I have yet to receive it but once I do I will send it to you as well. They have
not resumed grading and we will make sure they have the quick action plan submitted and implemented before we go
back to earth moving operations.

Friday - The contractor has essentially done no grading this week and only focused on erosion control. They did work on
structures and Mountain Creek worked on the culvert. We met onsite with Phil Amy and Dave W. to look at Site 10. Angel
and Scott Gallman were present for the contractor. We talked about what needs to happen to prevent this from
happening again. I told Angel that he needs to have someone competent in erosion control to work at night since it
appears to be the shift that is lacking. They need to have someone like Scott Gallman, Roger, Shorty or Angel himself on
the night shift to make sure the correct erosion control decisions can be made. I told Angel that they couldn't work on
night shift again until they have someone of the caliber described above out there watching the operations. They stated
that they were trying to hire a new erosion control foreman and they had fired the grading foreman that made the
decision which led to this current loss. I stated that until he was hired that one of the people named above could work at
night to keep the operation moving. They are under a grading shutdown until the urgents and other erosion control items
are completed. This is in accordance with the commitment that NCDOT made to DEQ after the NOV. The job did receive a
massive amount of rain this week. A few of the items are difficult to clean now since the slopes are too wet to take a
track hoe down, however they are still scheduled to be corrected. Phil then rounded up essentially all the Level 2 foremen
on the project. I did not count but there were 15 to 20 people from Dragados and Scott Gallman stated that all the Level
2 foremen were present. Phil then proceeded to go over his entire erosion list that was generated on Tuesday when he
issued his ICA. He went through each item in detail and pointed out specifically what needed to be done to help prevent
this again. He also drew a picture on the ground of how they should install diversions, TSDs, and Type A or B silt checks to
divert the water to the slope drains. He stated that it would be better to have smaller diversions, but more of them since
they would break up the water into smaller sections, plus these could quickly be reinstalled with a dozer if rain was
approaching quickly. We also discussed that at the haul roads that approach Structures 3 & 4 they should have bigger
diversions, which currently they do, however they are not traversable. I stated that they could leave them large, but the
could extend them to make more of a ramp where they could be permanently left in place during work. We also
discussed that they could narrow the haul road since it is way too wide and then the necessary diversion to reinstall
would be smaller and could be installed quicker. They could also, if they left the haul road wide, only remove a smaller
portion of the diversion and there would be less to put back in if rains approached quickly. This was one of the biggest
concerns and requests of Dave was to have a plan that the contractor could follow and know how the
berms/diversions/erosion control could be put back in very quickly if rain was eminent. He also stated that they should

review the forecast and pay attention to the radar more, especially during these summer nights where storms are more
prevalent. The contractor stated that they would come up with this emergency response plan. Dave did recognize, as we
all did, that this work is necessary and sometimes the diversions and berms had to be removed to get the job done but a
plan to get them back in rapidly was needed. We then talked about what work is necessary to complete the fill in this
area. Angel stated that there is about 100,000 CY of soil left to place in this area which would take about 15 days. I
stated that even if this area is completed as described above, the haul roads that are currently installed could not be
removed until either Structure 3 or 4 was complete and construction traffic could travel over them. Angel acknowledged
that fact. I stated that we would still have to give this area a great amount of attention and we would still be vulnerable
to lose sediment until we could get these steep haul roads removed. It will be many months before either of these
structures will be complete. I told Angel he should consider going back up toward Structure 5 and 6 where minimal fill is
needed to get to grade and work their way down to Structure 3 and 4. This way we could get the fill to grade and
temporary seed and mulch it ASAP to limit the erodible surface. We also stated the importance of getting the grade from
US 158 to West Mountain to a state where we could temporary seed it for the winter months. We would then need to
create haul roads and stay off the seeded areas. I told my employees that were present to stay off the seeded areas as
well. If you need to check something, get out of your truck and walk. Near the end of this meeting I addressed all of my
staff present as well as all the Level 2s stated above for the contractor and told them that I was tired of standing up on
this same berm looking Site 10. The contractor stated before that it won't happen again but here we are again on top of
the berm at Site 10. I told them that everyone has a role in erosion control whether they think they do or not. If they are
Level 2 Certified they are directly responsible for erosion control if they are performing a ground disturbing activity. I told
them that their certifications could be revoked and then they would not be as valuable to their employer. I tried to
express the importance of erosion control and that it was not a side task or something that is optional or secondary. I
stated that I have stress the importance of erosion control and instill it into my employees and that Dragados needs to do
the same. The Level 2s were attentive and appreciative of the meeting in my opinion and some asked a few subsequent
questions. I think it was helpful as I have not been able to address all of their employees in front of their management as
a total group before. I told Angel in front of his employees that he needs to give his Level 2s the power to question or stop
work when erosion control issues arise. I told his employees that they should not be afraid to ask NCDOT questions if they
see an erosion control issue. We then dismissed and Dave stated that he wanted to return sometime late next week to
see the progress and if the erosion control measures stated above were implemented.

We appreciate you taking the time to meet with us today and review the recent environmental
compliance issues on this project. Based on the recent erosion control deficiencies, Dragaaos-USA
intends to overcome tRe supervisory and leadership problems which resulted in the tailure to install and
maintain adequate erosion and sedimentation controls on this project.
Atter determining the cause of the recent pro6lem, the Assistant Grading Superintendent Ras neen
terminated. We are in the process of Riring his replacement who will be fully qualitied to supervise the
grading and erosion control operations for the night operations. In order to extend our commitment to
compliance with erosion and sedimentation control, we will have an Erosion Control Foreman monitor
operations and assist the night Grading Superintendent on a temporary 6asis and as-needed. Dragados-
USA is also hiring a second Erosion Control Superintendent (NCDOT E&SC Level II Certifieq) to direct
operations and manage the workload.
We have developed an action plan for quick response at specific areas ot the project wFien maintenance
for erosion is required. We will also continue to maintain the appropriate certitications for employees
and we will seek additional assistance and training from Phil Suggs with the NCDOT Roadsiae
Environmental Unit. We will request training anytime it is determined that there is a deticiency in
fcnowledge or skill in the implementation ot erosion control measures.
