Dear Ms. Higgins,
On behalf of the US Department of Health and Human Services (DHHS) National
Institute of Environmental Health Sciences (NIEHS) National Institutes of Health (NIH),
SEPI Engineering (SEPI) submits this Buffer Authorization permit modification and
supplemental information requesting written concurrence from the NC Division of
Water Resources (DWR) that the activities proposed below may proceed under the
Riparian Buffer Rules for Jordan Lake. Provided below is a brief discussion of the project
intended to supplement the attached Riparian Buffer Authorization Form.
Project Summary and Purpose
DHHS intends to construct a warehouse and distribution Center at 111 T.W. Alexander
Drive in Research Triangle Park, NC. The warehouse will be located at in the northern
section of the property which is bordered by TW Alexander to the west, The Triangle
Expressway to the east, and the abandoned Durham Freeway to the north. The subject
property is located in Research Triangle Park, North Carolina. The proposed project also
includes a loading dock area, an access control point with a guardhouse, associated
parking, stormwater control devices, and a utility corridor.
The project site was previously used by NIH and contained several temporary structures
(trailers) which are no longer on the site. The trailers were accessed by a paved
driveway and a concrete parking area which are still in place. The proposed facility will
be placed on and adjacent to the existing impervious footprint.
Proiect History
A 401 & Buffer Compliance permit was issued on March 7, 2016 (DWR #16-0177) for 90
linear feet (LF) of temporary stream impact, 5,390 square feet (sf) of permanent zone 1
buffer impacts ,and 1,202 sf of permanent zone 2 buffer impacts for a utility crossing.
Mitigation was not required as impacts were either temporary in nature or exempt or
allowable according to the table of uses.
A 404 permit for 90 LF of temporary stream impacts was submitted to the US Army
Corps of Engineers (USACE) on February 24, 2016. As of the date of this letter, no
approved permit has been received.

SEPI
A design change was requested in the location of the proposed utility corridor. Instead
of connecting to an existing corridor along T.W. Alexander Dr., the proposed utility
corridor will follow an existing sewerline corridor south of the main parcel. Previously
permitted impacts were not constructed and are no longer proposed in this new utility
corridor alignment.
Project Impacts and Mitigation
The project construction requires temporary impacts to state regulated riparian
buffers (Zone 2 only). The proposed utility corridor will contain multiple utilities and
will be placed within and immediately adjacent to an existing utility corridor in an
effort to minimize impacts to the buffers. No stream impacts are proposed in the new
utility corridor, and the previously permitted stream impacts are no longer being
proposed. No riparian buffer mitigation is proposed since all buffer impacts are
considered "allowable" within the table of uses and the impacts will occur in an
existing sewerline easement with maintained herbaceous cover.

Avoidance and Minimization
Multiple utilities are being placed within the proposed corridor along an existing
sanitary sewer corridor to reduce impacts to riparian buffers and stream crossings.
Trenchless installation will be implemented to eliminate impacts to streams and
reduce impacts to riparian buffers. The utility corridor will be 10 feet wide or less
throughout the project. The previously permitted corridor temporarily impacted 90 LF
of stream. Wetland areas on the property are being completely avoided with impacts.
No permanent impacts to streams or wetlands are proposed.

The project area is partially forested, vacant land with the exception of an approximate 4 acre cleared area in the
center which in the past contained research trailers and associated parking but is now vacant. The general
topography of the site is mildly steep, with elevations ranging from approximately 300' to 260' above mean sea
level. Burdens Creek borders the southern property boundary of the main parcel and flows from east to west. An
unnamed tributary to Burdens Creek flows south to north adjacent to an existing sewerline corridor. There are
several wetlands in the floodplain on the north side of Burden's Creek in the main parcel. Land use in the vicinity
of the project consists of industrial and commercial development.

Dear Sir:
On February 8, 2016, we received a stormwater construction drawing package submittal package for the
Building 110 Net Zero Energy North Warehouse and Distribution Center project located at 105 T.W. Alexander
Drive, Durham, NC. This construction drawing set was approved by this office on March 8, 2016. Enclosed is a
copy of the plans and calculations, stamped approved by this office.
The approved stormwater collection system consists of:
1. Installation of a bioretention facility with a design treatment volume of 954 ft3.
2. Installation of a stormwater wetland with a design storm surface area of 14,931 ft3.
3. Approximately 979 LF of PVC and RCP pipe
Our office will issue a Stormwater Operation and Maintenance Permit for the stormwater control measures after the
following are completed:
1. The stormwater system is constructed and final construction inspected by a registered professional engineer,
a registered land surveyor, or a registered landscape architect. A signed and sealed copy of the inspection
report must be submitted to this office.
2. The final As -Built Plans sealed and signed by a registered professional engineer, a registered land surveyor,
or a registered landscape architect must be submitted.
3. An operation and maintenance plan sealed and signed by a registered professional engineer, a registered land
surveyor, or a registered landscape architect must be submitted.
4. An operation and maintenance agreement signed and notarized by the property owner. This will be drafted
near the end of the project.
5. An improvement security must be provided to our office in accordance with Ordinance Section 14-155(e).
Our calculations indicate a performance bond in the amount of $11,359.95 is necessary to ensure
construction, and continuing operation, maintenance and inspection of the facilities. Performance bond
forms and information can be found on the Durham County Engineering / S&E Webpage. If you believe
this bond amount is incorrect please contact me. See Attached.
