application: The existing conditions consist of forested land and an existing unpaved road infrastructure bisecting
the property. The general land use in the vicinity includes residential development.

Approximately 5,158 linear feet.

The purpose of the project is to construct a residential development and necessary infrastructure such as roads,
utilities and stormwater BMP's.

The overall project consists of the construction of a residential development. Specifically, retaining walls will be -
utilized at the back of residential lots to increase grade. In these areas, Zone 2 of the riparian buffer will be
cleared, regraded and revegetated as it slopes down through the riparian buffer area., Additionally, there are
Zone 2 buffer impacts associated with the construction of stormwater wet ponds.

On May 22, 2006, Crescent Resources received a 404 Nationwide Permit Verification (AID# 200520995 &
200620803) and on July 5, 2006, they received a 401 Water Quality Certification Approval, Isolated Wetlands
Permit Approval and a Tar -Pamlico Buffer Authorization Approval (DWQ #06-0658) for the residential
infrastructure associated with the project, and on September 4, 2007, Crescent Resources received a Tar -
Pamlico Buffer Authorization Approval for the residential piers and boat ramp (DWQ EXP N. 06-06580). In 2012
a General Permit and Water Quality Certification & Buffer Approval was issued for a new boat ramp to Hidden
Lake Crescent, LLC (AID# SAW -202-01457 & DWQ #06-06584).

. We strongly suggest you have this property inspected to determine the extent of Department of the Army (DA)
jurisdiction. To be considered final, a jurisdictional determination must be verified by the Corps. This preliminary
determination is not an appealable action under the Regulatory Program Administrative Appeal Process (Reference 33
CFR Part 331). If you wish, you may request an approved JD (which may be appealed), by contacting the Corps district
for further instruction. Also, you may provide new information for further consideration by the Corps to reevaluate the
JD.

_ There are Navigable Waters of the United States within the above described project area subject to the permit requirements
of Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act. Unless there is a change in the law

(Description of projects area and activity: The proposed project will provide access to waters of the US by constructing a 21' wide
boat ramp on the Amenity site of Hidden Lake. This authorization is for permanent impacts to 0.02 acres of open waters (Hidden
Lake) for the purpose of construction of a boat ramp.

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached
conditions and your submitted application and attached information dated July 24, 2012. Any violation of the attached
conditions or deviation from your submitted plans may subject the permittee to a stop work order, a restoration order and/or
appropriate legal action.
This verification is valid until the NWP is modified, reissued, or revoked. It is incumbent upon you to remain informed of changes,
to the NWPs. We will issue a public notice when the NWPs are reissued. Furthermore, if you commence or are under contract to
commence this activity before the date that the relevant nationwide permit is modified or revoked, you will have twelve (12) months
from the date of the modification or revocation of the NWP to complete the activity under the present terms and conditions of this
nationwide permit.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You
should contact the NC Division of Water Quality (telephone (919) 733-1786) to determine Section 401 requirements.
For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (CAMA),
prior to beginning work you must contact the N.C. Division of Coastal Management .

A. ❑ Based on preliminary information, there appear to be waters of the US including wetlands within the above described project
area. This preliminary determination is not an appealable action under the Regulatory Program Administrative Appeal Process
( Reference 33 CFR Part 331).

Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act. Unless there is a change in the law or our

Basis for (Determination
The site,11idden Lake is an open water of approximately 67 acres and situated in-line with Cedar Creek Cedar Creek flows
into the Tar River: the lower Tar River is a traditional navinable waterway. A jurisdictional determination was issued for this
site in 2005 (SAW -2005-20995), now expired.
Attention USIA Program Participants
This delineation/determination has been conducted to identify the limits of Corps' Clean Water Act jurisdiction for the particular site
identified in this request. The delineation/determination may not be valid for the wetland conservation provisions of the Food Security
Act of 1985. If you or your tenant are USDA Program participants, or anticipate participation in USDA programs, you should request
a certified wetland determination from the local office of the Natural Resources Conservation Service, prior to starting work.
F. Appeals Information (This information applies only to approved jurisdictional determinations as indicated in B and C
above).
This correspondence constitutes an approved jurisdictional determination for the above described site. If you object to this

Dear Mr. Munday:
You have our approval, in accordance with the attached conditions and those listed below, to place fill within or
otherwise impact 0.02 acre of open water (permanent impacts), 450 square feet of Zone 1 Tar -Pamlico River
riparian protected buffer (permanent impacts), and 300 square feet of Zone 2 Tar -Pamlico River riparian protected
buffer (permanent impacts), as described in your application dated July 24, 2012, and received by the Division of
Water Quality (DWQ) on July 24, 2012, to install a boat ramp. After reviewing your application, we have
decided that the impacts are covered by General Water Quality Certification Number(s) 3883 (GC3883). The
Certification(s) allows you to use Regional Permit 197800125 (GP 125) which, in this case, is automatically issued
by the US Army Corps of Engineers (USACE). This letter shall also act as your approved Authorization
Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0259. In addition, you should obtain
or otherwise comply with any other required federal, state or local permits before you go ahead with your project
including (but not limited to) Erosion and Sediment Control, and Non -discharge regulations. Also, this approval
to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application
shall expire three (3) years from the date of issuance of this approval letter from the Division or on the
same day as the expiration date of the corresponding Regional Permit 197800125.
This approval is for the purpose and design that you described in your application. If you change your project, ,
you must notify us and you may be required to send us a new application. If the property is sold, the new owner
must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of
stream, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). This approval
requires you to follow the conditions listed in the attached certification and any additional conditions listed
below.

2. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the
footprint of the impacts depicted in the Pre -Construction Notification. All construction activities,
including the design, installation, operation, and maintenance of sediment and erosion control Best
Management Practices, shall be performed so that no violations of state water quality standards, statutes,
or rules occur.
3. Erosion and sediment control practices must be in full compliance with all specifications governing the proper
design, installation and operation and maintenance of such Best Management Practices in order to protect
surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and Erosion
Control Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures
must be such that they equal, or exceed, the requirements specified in the most recent version of the
North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all
construction sites, borrow sites, and waste pile (spoil),projects, including contractor -owned or leased
borrow pits associated with the project.
c. Sufficient materials required for stabilization and/or repair of erosion control measures and
stonmwater routing and treatment shall be on site at all times.
4. Sediment and Erosion Control Measures
Sediment and erosion control measures shall not be placed in wetlands or waters without prior approval
from the Division. If placement of sediment and erosion control devices in wetlands and waters is
unavoidable, design and placement of temporary erosion control measures shall not be conducted in a
manner that may result in dis-equilibrium of wetlands or stream beds or banks, adjacent to or upstream
and down stream of the above structures. All sediment and erosion control devices shall be removed and
the natural grade restored within two (2) months of the date that the Division of Land Resources or locally
delegated program has released the project.

5. Diffuse Flow Plan
All stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream
buffers and will not re -concentrate before discharging into the stream as identified within 15A NCAC 2B
.0259(5) or if this is not possible, it is necessary to provide stormwater facilities that are considered to
remove nitrogen.
6. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer
Rules, and any subsequent modifications, the applicant is required to return the attached certificate of
completion to the Wetlands, Buffers, Stormwater, Compliance and Permitting Unit (WeBSCaPe), North
Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct impacts to
waters as depicted in your application and as authorized by this Certification, shall expire upon expiration of the
404 or CAMA Permit.
If you wish to contest any statement in the attached Certification you must file a petition for an administrative
hearing. You may obtain the petition form from the Office of Administrative Hearings. You must file the
petition with the Office of Administrative Hearings within sixty (60) days of receipt of this notice. A petition is
considered filed when it is received in the Office of Administrative Hearings during normal office hours. The
Office of Administrative Hearings accepts filings Monday through Friday between the hours of 8:00am and
5:00pm, except for official state holidays. The original and one (1) copy of the petition must be filed with the
Office of Administrative Hearings.
The petition may be faxed -provided the original and one copy of the document is received by the Office of

Dear Ms. Wood:
We have reviewed the revised package submitted for Hidden Lake Subdivision Phase 11 in accordance
with the Franklin County Stormwater Ordinance and NCDEQ regulations for stormwater development in
the Tar -Pamlico River Basin, and offer the following comments. .
1. Nutrient calculations submitted show that the design will obtain the required nutrient reduction
through the use of on-site stormwater control measures, as required per Franklin County
Stormwater Ordinance Section 5.5B. Six (6) wet detention ponds are proposed for this project.
2. Peak flow attenuation as required in Section 4 of the County Stormwater Ordinance is provided at
this site by the proposed stormwater control measures.
3. Per the NCDEQ the following note shall be placed on the final plat:
The stormwater control measures shown hereon are required on the property to meet County
and state stormwater regulations. Property Owner may be subject to enforcement actions if the
stormwater control measure is removed, relocated or altered without prior County approval.
4. The Applicant is to note that the following items are required prior to approval of the Final Plat:
a. NCDEQ Erosion and Sedimentation Control permit
b. Stormwater control measures shall be located within drainage easements with access to
public right-of-way or within separate lots of record.
c. Operation and Maintenance Plan and Legal O&M Agreement for each BMP. The 0&M
