Principle Purpose: These laws require permits authorizing activities in, or affecting, navigable waters of the United States, the discharge of dredged or fill material into waters of the United States, and the transportation of dredged material for the purpose of dumping it into ocean waters. Routine Uses: Information provided on this form will be used in evaluating the application for a permit. Disclosure: Disclosure of requested information is voluntary. PROJECT PURPOSE (Describe the reason or purpose of the project, see instructions): SE BLOCKS 20-22 IF DREDGED AND/0R FILL MATERIAL IS TO BE DISCHARGE 20. REASON(S) FOR DISCHARGE Earthen fill of 0.186 acres of Section 404 wetland area will provide highground area the proposed site development that will be required to convert the site into a lumber yard. Limitations will result from the use of large 18 Wheel Delivery Trucks to access the fenced in site, unload, turn around to reverse direction and exit the lumber yard and site. The site has been designed to minimize the disturbance to guests at the adjacent motel, so the delivery trucks will ingress and egress the site onto Whitemon road. The Hampton Inn Motel is an existing use so the proposed use needs to conform as much as possible to recognize the adjacent properties use by the public. The two outparcels adjacent to the motel site will be reserved for uses that more closely match the use of the motel and to provide a buffer (or gradation) between these differing uses. The lumber will be stored within the lumber yard in various manners depending upon the nature of the wood product and its susceptibility to weathering. The eventual sale of the lumber will entail the use of private vehicles, and delivery trucks operated by the applicant. All of these vehicles will be required to be loaded and turned around safely within the graveled area in the lumber yard. Existing wetlands within the proposed gravel lumber yard happens toile located within the area that will most likely be used by the delivery truck for turning around to egress the site. MITIGATION The applicant supplied an In lieu fee request form to the North Carolina Ecological Enhancement Program (NCEEP) on February 15, 2008 for mitigation of the 0.19 acre proposed impacts. The expected amount of mitigation to be purchased will be 0.5 acres exceeding the required 2:1 acre minimum mitigation requirements. Please note that this decision does not assure that the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be approved. This acceptance is valid for six months from the date of this letter and is not transferable. if we have not received a copy of the issued 404 Permit/402 CertificationiCAMA permit within this time frame, this acceptance will expire. It is the applicant's responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In Lieu Fee to be paid to NCEEF by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net. If the regulatory agencies require mitigation credits greater than indicated above, and the applicant wants NCEEP to be responsible for the additional mitigation, the applicant will need to submit a mitigation request to NCEEP for approval prior to permit issuance. The mitigation will be performed in accordance with the Memorandum of Understanding between the N. C. Department of Environment and Natural Resources and the U. S.
