SUBJECT: Nationwide 14 Permit Application for Secondary Road Construction on SR
1513 (Pearlie Watkins Rd.), Pender County Project Number: 3C.071042 (DWQ
Permit Fee: $240)
Please find enclosed a PCN application from the North Carolina Department of Transportation
for a Nationwide 14 permit from the Army Corps of Engineers for the secondary road
improvement project on SR 1513 (Pearlie Watkins Rd) in Pender County. The scope of the
project will be to widen, grade, drain and base the 1.27 miles of existing unpaved road to current
NCDOT secondary road standards of 20 ft of travel lanes and 6 ft of earthen shoulders to improve
roadway safety and stability.
IMPACTS TO WATERS OF THE UNITED STATES
This project is located in the Cape Fear River Basin within USGS hydrologic unit 03030007
(subbasin 030623). The proposed project will include 0.091 acre of wetlands impacts for fill at
Wetland A and also 0.035 acre of wetlands for fill at Wetland B which was determined to be
isolated by USACE. Impacts to isolated Wetland B is authorized under the DWQ isolated
wetland GP 10,000. A total of 25 ft to an intermittent tributary to Northeast Cape Fear River (C
Sw) will be permanently impacted for the replacement of Pipe A located at Sta. 11+95. The
existing pipe at this location is a 24" x 37' RCP and will be replaced with a 30" x 50' CMP.
There will be an additional 11 ft of temporary impacts to this same tributary for the removal of
the existing pipe within the existing maintenance limits. The pipe location will be shifted to be
entirely within the right of way as depicted on the permit drawing.
A field meeting was held at this site with USACE representative Jennifer Frye and Ken Averitte
(DWQ) on May 31, 2007 to discuss these impacts. A jurisdictional determination was issued by
Jennifer Frye on October 22, 2007. There are no permanent or temporary utility impacts
proposed with this project.

COMPENSATORY MITIGATION
The Department has avoided and minimized impacts to jurisdictional resources to the greatest
extent possible. The project was evaluated for on-site mitigation and it was determined that no
potential mitigation existed within the project limits. The unavoidable impacts to 0.091 acres of
of wetland at Wetland A and 25 ft of impacts to the intermittent stream at Pipe A will be offset by
compensatory mitigation provided by the Ecosystem Enhancement Program (EEP). The
Department will submit this compensatory mitigation request to EEP for acceptance in a quarterly
report and will provide a copy to the Wilmington District office for verification and accounting
purposes as requested.
NATURAL AND HISTORIC RESOURCES
FEDERALLY PROTECTED SPECIES
Species with the federal classification of Endangered, Threatened, Proposed Endangered and
Proposed Threatened are protected under provisions of Section 7 and Section 9 of the Endangered
Species Act of 1973 as amended (16 U.S.C. 1531 et seq.). The United States Fish and Wildlife
Service lists _ twelve federally protected species for Pender County which include American
alligator (Alligator missxssippiensis), Red-cockaded woodpecker (Picoides borealis), Cooley's
meadowrue (Thalictrum cooleyi), Golden sedge (Carex lutea), Rough-leaved loosestrife
(Lysimachia asperulaefolia) and American chaffseed (Schwalbea americana). A GIS and field
review has been conducted for these species and their habitat for this project and a determination
of "No Effect" for the listed species is recommended.
HISTORICAL RESOURCES
Pursuant to Section 106 of the National Historic Preservation Act and the Advisory Council on
Historic Preservations Regulations for Compliance with Section 106 codified at 296 CFR Part
800, this project has been reviewed and cleared for effects on historical and archeological
resources (see attachment).
REGULATORY APPROVAL
Section 404 Permit: The Department of Transportation is requesting to proceed under Nationwide
14 in accordance with 72 FR 11092, March 12, 2007.
Section 401 Permit: We are also requesting by copy of this letter issuance of the 401 Water
Quality Certification 3704 from the DWQ. We have provided a method of debiting $240 to be
submitted to the DWQ for processing the WQC permit request, as noted in the subject line of this
application.

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
ftnancial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
Draft Technical Guide for Stream Work in .North Carolina, available at
http: //h2o. enr.state. nc.us/ncwetlands/strmgide. html.

constitute a violation of Section 301 of the Clean Water Act (33 USC § 1311). If you have any questions regarding this

C. Basis For Determination
This site exhibits wetland criteria as described in the 1987 Corps Wetland Delineation Manual and is adjacent to an
unnamed tributarv to the Northeast Cape Fear River, a Navigable Water of the U.S. This site also contains a
waterbody that exhibits an ordinary high water mark and is a tributarv to the Northeast Cape Fear River, This
determination is based on information submitted by NCDOT/Division 3 and a site visit by Jennifer Frve on 5/31/2007 .
D. Remarks
Please be aware that this property contains non-jurisdictional, isolated wetlands. Please contact the North Carolina
Division of Water Quality at (919) 733-1786 to discuss the State's regulations and requirements for these waters. It was
determined that these wetlands are not bordering, neighboring or contiguous with any Section 404 jurisdictional
waters.
