Subject: Proposed improvements to Highway 273 in Gaston County, Federal Aid Project No. STP- 273-(1),
Division 12, TIP No. U-3633
Dear Mr. Harris:

The Division of Water Resources has reviewed your submittal for a 401 Water Quality Certification for the
aforementioned project. Review of your application revealed it lacking necessary information required for making
an informed permit decision. The permit application was deficient in the following areas:
• Upgrade all riprap associated with jurisdictional areas to Class II
• Ensure no details referencing jurisdictional streams show geotextile fabric on the bed of the stream
• Add inlet stabilization (bank stabilization with Class II riprap on banks only) to permit sites l, 3, 4,
and 5(and revise impact summary sheet accordingly)
• Include more detailed floodplain bench details for Fites Creek including stream dimensions and
materials (detailed enough for the contractor to construct)
• Permit site #7 rock sill detail (detail 6)
• Concerns regarding 24" drainage line installation next to pond
• All sites will need temporary dewatering impacts
• Any riprap used in stream bed should be embedded.
Therefore, pursuant to ISA NCAC 2H .0507(a)(5), we will have to place the permit application on hold until we are
supplied the necessary information. You have 21 days to respond in writing with the requested information or
notification to this office that the information is forthcoming. If, at the end of the 21 days, this office has not
received this information in writing, we will assume you are withdrawing your application and it will be returned.
Furthermore, until the information is received by the NC Division of Water Resources, we request (by copy of this
letter) that the US Army Corps of Engineers place the permit application on hold.
