the NCDWR and submit a new application. If the property is sold, the new owner must be given a copy of this
Certification and approval letter, and is thereby responsible for complying with all the conditions. If any additional
wetland impacts, or stream impacts, for this project (now or in the future) exceed one acre ar 150 linear feet,
respectively, additional compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and

1. This me�ification is applicable only to the additional proposed activities. All of the authorized activities and
conditions of certification associated with the original Water Quality Certification daied Ju1y 2, 2013 and
subsequent modifications dated April 15, 2014, June 25, 2015, October 12, 2015, and July 8, 2016 still apply
except where superseded by this certification.
2. The NCDOT Division Environmental Officer or Environmental Assistant will conduct a pre-construction
meeting with all appropriate staff to �nsure that the proj�ct supervisar and essential staff �mderstand the
potentiai issue� with• cne�m and pipe alignment at the permitted site. NCDWR staff shall be invited to the
pre-construction meeting. f 15A NCAC 02H.0506(b)(2) and (b)(3)]
3. Two copies of the final construction drawings shall be furnished to the NCDWR Central Office prior to the
pre-construction meeting. The permittee shall provide written verification that the final construction
drawings comply with the permit drawings contained in the application dated May 12, 2016 and additional
information dated received June 16, 2016. Any deviations from the approved drawings are not authorized
unless approved by the NC Division of Water Resources.
4. Channel relocations shall be completed and stabilized, and approved on site by NCDWR staff, prior to

vegetated huffer on both sides of the relocated channel to the maximum extent nracti�al. Also, rip-rap may
b� aliow�� if it is necsssary to mair�tair_ the physicat i�tegrity ai the str�am, but the applicant must Yrovide
writfen jusiification and any calculations used to determine the extent of rip-rap coverage requested. Once
the stream has been t�irned into tlie new channel, it may be necessary to relocate stranded fish to the new
channel to prevent fish kills. [15A NCAC 02H .0506(b)(3)]
5. No drill slurry or waier that has been in contact with uncured concreie shail be ailowed to enter surface
waters. 1 his water shall be captured, treated, and disposed of properly. [15A NCAC 02H .OSU6(b)(3)]
6. Unless atherwise approved in �his certification, placenzent oi culverts and aiiier srizictutes in opeu waters and
sireams, shail be placed below the elevation of the streambed by one foot for all culveris with a diameter
greater than 48 inches, and 20 percent of the culvert diameter for culverts having a diameter less than 48
inches, te allow low flow passage of water and aquatic life. Design and placement of culverts and other
structures including temporary erosion control measures sl-,all not be conducted in a manner that may result
in dis-equilibrium of wetlands or streambeds or banks, adjacent to or upstream and downstream 3f the above
structures. The applicant is required to provide evidence that the equili�rium is being maintained if requested
in writir.g by the TdCDV�IR. If this condition is unable to be met due to b�drock er ather ?imiting features
encountered during construction, please contact the NCDWR far guidance on how to proceed and to
determine whether or not a permit modification will be required. [1SA NCAC 02H.0506(b)(2)]
7. If multiple pipes or barrels are required, they shall be designed to mimic natural stream cross section as
clasely as possible including pipes or barrels at flood p1'ain elevation and�o: sills where appropriate.

8. Riprap shall not be placed in the active thalweg channel or placed in the streambed in a manner that precludes

9. The stream channel shall be excavated no deeper than trie naiural bed material of the stream, to the inaximum
extent practicable. Efforts must be made to minimize imnacts to the stream banks, as well as to vegetation
responsible for maintaining the stream bank stability. Any applicable riparian buffer impact for access to
stream channel shall be temporary and be revegetated with native riparian species. [15A NCAC
02H.0506(b)(2)] ,
10. Compensatory mitigation for 4,751 linear feet of impact to streams at a 1:1 ratio is required. We understand
that yau have c1�.osen to perfoni compensatary mitigation ioi iinpacts to stream's tl,rough the 1�`orth Carolina
Division of Mitigation Service (DMS) (formerly NCEEP), and that the DMS has agreed to implement the
mitigation for the project. The DMS has indicatecl in a letter dated May 9, 2016 that they will assume
resnonsibiliry for satisfying the federa: Clean Water Act compensator� mitigation requirements for the
ab�vz-referznced project, in accordance with �he DMS Niitigation Bankuig Instrument si�rted Jur�e 14, 2016.
11. In accordance with commitments made in your application, all clearir�g of vegetatian for purpose of
relocating overhead power lines within� jurisdictional wetiands shall be performed without the use of
mechanized equipment. [15A NCAC 02H.0506(b)(3)]
12. The permittee shall use Design Standards in Sensizzve Watersheds [15A NCAC 4BA124(b)-(e)] through the
entire project. However, due to the size of the project, the NCDOT shall not be required to meet 15A NCAC
4B .0124(a) regarding the maximum amount of uncovered acres.
13_ 'Che NCDOT shall design, �onstruGt, and operat� and maintain bazar�ous snill catch b�sins (HSCBs) for
cross�ngs in the Lake Brandt Critical Area watershed. The HSCBs shall he Iocated at Station numbers —
RPDY4- STA. 1+70 to STA. 5+00 LT and —L- STA. 443+75 to STA. 446+00 LT.
General Conditions
1. Unless otherwise approved in this certification, placement of culverts and other structures in open waters and

in writing by NCDWR. If this condition is unable to be met due to bedrock or other limiiing featw�es
encoeu►tered during constructi�n, please contact NCD�✓R for guidance �n how to proceed and to detzrir�ine
whether or not a permit modification will be required. [15A NCAC 02H.OSG6(b)(2)]
2. If concrete is used during consfiac±ion, a dry work area shall be maintair.ed to prevent d�rect contact bPtween
curing concrete and stream water. Water that inadvertently contacts uncured concrete shall not be discharged
to surface waters due to the potential for elevated pH and possible aquatic life and fish kills. [15A NCAC
02B.0200]
3. Bu,ring the construction of the project, no staging of equipment of any kind is perniitted in waters of the U.S.,
or protected riparian buffers. [15A NCAC 02H.0506(b)(2)]
4. T'he dimension, pattern and profile of the stream above and below the crossing shall not be modified.
Disturbed floodplains and streams shall be restored to natural geomorphic conditions. [15A NCAC
02H.0505(b)(2)]
5. The use of rip-rap above the Narmal High Water Mark sha11 be minimized. Any rip�rap placed for stream
stabilization shall be placed in stream channels in such a maiuier that it does not impede aquatic life passage.

6. The Permittee shall ensure that the fmal design drawings adhere to the permit and to the permit drawings
submitted for approval. [ 15A NCAC 02H .0507 (c) and 1 SA NGAC 02H .0506 (b)(2) and (c)(2)]
7. All work in or adjacent to strea�ri waters shall be conducted in a clry work area. Approved BMP measures
from the most current versian of NCDOT Construction and Maintenance Activities manual such as sandbags,
rock berms, cofferdams and other diversion structures shali be used to preveni excavation in flowing water.

8. Heavy equipment shall be operated fram th� b�nks r�ther than in tne sream cr�a�nei ir, orcier to minirlize
sedimentatiorz and reduce the introductioa af other pallutants in�o the stream. [15A NC::�� 02H.Q�06(b)(3)]
9. All mecrianized equipment operated near surface waters must be regularly inspected and maintained to
prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials. [ 15A
NCAC 02H.0506(b)(3)]
10. No rock, sand or other materials shall be dredged from the stream channel except where authorized by this
certification. [15A NCAC 02H.0506(b)(3)]
11. Discharging hydroseed mixt�res and washi:�g eat hy�irosee�ers and other equipr.ler_t in ar adjacent to su:face
waters is prohibiied. [ISA NCl�C 02H.O�Ob(b)(3)]
12. The permittee and its authorized agents shall conduct its activities in a manner consistent with State water
quality standards (including any requirernents resalti.�g from compliance with §303(d) of the Clean Water
Act) and any other approp�iate requirements �f State and Fede;al law. If the NCDWR deternines that such
standards or laws are not being met (including the failure to sustain a designated or achieved use) or that
Sfate or federal law is being violated, ar that further conditions are necessary to assure compliance, the
NCDWR may reevaluate and modify this certification. [15A NCAC 02B.0200]
13. All fill slopes located in jurisdictional wetlands shall be placed at slopes no flatter than 3:1, anless otherwise
authorized by this certification. [15A NCAC 02H.0506(b)(2)]
14. A copy of this Water Quality Certi�cation shall be maintained on the construction site at all times. In
addition, the Water Quality Certificaiion and all subsequent modifications, if any, shall be maintained with
the Division Bngineer and the on-site �nroje�t manager. [15A NCAC 02H .OSU7(cj and I SA NCAC �72H .OS06
(b)(2) and (c)(2)]
15. The outside buffer, wetland or water boundary located within the construction corridor approved by this
authorization, including all non-commercial borrow and waste sites associated with the project, shall be
clearly marked by highly visible fencing prior to any land disturbing activities. Impacts to areas within the
fencing are prohibited unless otherwise authorized by this certification. [15A NCAC 02H.0501 and .0502]
16. The issuance of this certification does not exempt the Permittee from complying with any and all statutes,
rules, regula�ions, or ord'uiances tliat may be im�,osed by other government agencies (i.e. l�cal, state, and
fe�eral) having jur:sdiction, including but not lli•nite� to applicable buffer rules, sto:mwater management ;
rules, soil erosion and sedimentation control requirements, etc.
17. The Per�nitiee shall report any viol�tions of this cer�ifi_cation to the Division of Wate,r Reso�ir•ces within 24
hoiu•s of discovery. [ 13A ?1CAC 02B.0506('a)(2 j]
18. Upon completion oi the project (including any impacts at associated borrow or waste sites), the NCDGT
Division Engineer shall complete and return the enclased "Certificatior. of Completion Form" to notify the
NCDWR when all work included in the 401 Certification has been completed. [15A NCAC 02H.0502( fl]
19. Native riparian eegetation must be reestablished in the riparian areas within the constnction limits of �he
project by the end of the growing season fcllowing completion of construction. [15A NCAC 02B.0506(b)(2)]
20. T'here shall be no excavation from, or waste disposal into, jurisdictional wetlands or waters associated with
this pennit without appropriate modification. Shoul�i waste or boirow sites, or access roads to waste or
borrow sites, be located in wetlands or streams, compensatory mitigation will be required since that is a direct
impact from road construction activities. [15A NCAC 02H.0506(b)(3) and (c)(3)]
21. Erosion and sediment control �ractices must be iri full compliance with all specifications governing the proper
design, installation and operation and maintenance of such Besi Ma.~�agement Practices in order to protect
surface waters standards [15A NCAC 02H.0506(b)(3) and (c)(3)]: �
a. The erosion and sediment control measures f�r the project m��st be designed, installed, operated, and
mauitained in accardance wiih the most i•ecent version of the North Carolina Sediment and Erosion
Control Plan�zing and Design Manual.
b. The design, installation, operatian, and maintenance of the sediment and erosion control measures.must
be such that they equal, or exceed, the requirements specified in the most recent version of the North
Carolina Sediment and Erosion Controi I�Ianual. The devices snail t�e maintained on ail construction
sites, borrow sites, and waste pile �spoil) projects, including contractor-owned or leased borrow pits
associated with the project.
c. For borrow pit sites; the erosien and sediment control measures must be designecl, instalied, ope:aiec�,
and maintained ir, acco�daace w;th tl:e nast recent version of the Nort;z Caralirta Surface Ivliszing
Manual.
d. T'he reclamation measures and implementation must comply with the reclamation in accordance with the
requirements of the Sedimentation Pollution Control Act.
22. Sediment and erosion control measures shall not be placed in wetlands or waters unless otherwise approved
by this Certification. [15A NCAC 02H.0506(b)(3) and (c)(3)]
23. Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. This Certification shall become null and void unless the above conditions are
made conditions of the Federal 404 and/or Coastal Area Management Act Permit. Th;s Certificatian shall
expire upon the expiration of the 404 or CAMA permit.
If you wish to contest any statement in the attached Certification you must file a petition for an administrative hearina.
You may obtain the petition form from the office of �4dministrative nearings. You must file the petition with the
office of Administrative Hearings within sixty (60) days of receipt of this notice. A petition is considered filed when
it is received in the office of Administrative Hearings during normal office hours. The Office of Administrative
Hearings accepts filings Monday through Friday between the hours of 8:OOam and S:OOpm, except for official staie
holidays. The original and one (I) copy of the petition must be filed with the Office of Administrative Hearings.
The petition may be faxed-provided the original and one copy of the document is received by the Ot�ice of
