Division of Water Quality ~' Transportation Permitting Unit o,~Jl~ ~ / ~~ 2321 Crabtree Blvd./Suite 250 Raleigh, NC 27604-2260 Attention: Mr. Rob Riding, NCDOT Project Coordinator Subject: Secondary road improvements to SR 1331 (Shotwell Road) from SR 1328 (Stovall Road) to SR 1332 (Blue Wing Road) in Granville County. WBS element 5C.039037. The North Carolina Department of Transportation (NCDOT) proposes to upgrade and pave SR 1331 (Shotwell Road) from SR 1328 (Stovall Road) to SR 1332 (Blue Wing Road) in Granville County (Figures 1-6). Total project length is 1.81 miles. Transportation and highway laws of North Carolina (G.S. 136-44.6, 136-44.7, 136- 44.7A, 136-44.8, and 136-44.9) require the NCDOT to develop annual work programs for construction and maintenance of secondary roads. These general statutes specifically set forth requirements for annual construction and paving of existing unpaved roads. Paving of these roads is performed in priority order as established by the NCDOT for each unpaved road within a given county. This number is based on characteristics of each road, including number of homes, schools, churches, businesses, industries, recreational facilities, traffic counts, presence of school bus routes, and value as a thoroughfare. SR 1331 is scheduled to be paved as part of the Secondary Roads Construction Program. Impacts to Waters of the United States Site I -Waters of U S Construction at this site will impact an unnamed intermittent tributary to Crooked Fork [NCDENR-DVr'Q Index No. 22-59-1, Best Usage Classification C; HUC 03010104] (Figure 3) in the Roanoke River Basin. The existing stracture conveying the creek is a 36-inch reinforced concrete pipe that is 40 feet long (see Photographs 1 and 2). This pipe will be replaced with a 6.0_ft pipe. Permanent impacts at the site associated with this longer pipe total 20 linear feet of fill in surface water in addition to a total of 20 feet of rip rap along the stream banks. The work zone at this site will be temporarily dewatered for approximately 1 day. This will involve the temporary placement of either sandbags or Division 5, 2612 N. Duke Street, Durham, Nr 27704 Phone: (919) 560-6081 Fas: (919) 560-3371 sheet piling upstream and downstream of construction. Once the stream has been dewatered, the pipe will be replaced. To maintain water flow during construction, water upstream of construction will be temporarily pumped out and conveyed around downstream of the construction, if necessary. Temporary concurrent impacts to the stream from this activity will result in dewatering 40 linear feet of stream. The materials used for dewatering will be removed after construction. Site 2 -Waters of US Construction at this site will impact an unnamed intermittent tributary to Crooked Fork [NCDENR-DWQ Index No. 22-59-1, Best Usage Classification C; HUC 03010104] (Figure 4) in the Roanoke River Basin. The existing structure conveying the creek is a 24-inch reinforced concrete pipe that is 48 feet long (see Photographs 3 and 4). This pipe will: be replaced with. a 64 ft pipe (on an angle). Permanent impacts at the site associated with this longer pipe total 16 linear feet of fill in surface water in addition to a total of 10 feet of rip rap along the stream banks. The work zone at this site will be temporarily dewatered for approximately 1 day. This will involve the temporary placement of sandbags upstream and downstream of construction. Once the stream has been dewatered, the pipe will be replaced. To maintain water flow during construction, water upstream of construction will be temporarily pumped out and conveyed around downstream of the construction, if necessary. Temporary concurrent impacts to the stream from this activity will result in dewatering 26 linear feet of stream. The materials used for dewatering will be removed after construction. Site 3 -Waters of US Construction at this site will impact an unnamed intermittent tributary to Aarons Creek [NCDENR-DWQ Index No. 22-59, Best Usage Classification C; HUC 03010104] (Figure 5) in the Roanoke River Basin. The existing structure conveying the creek is a 12-inch reinforced concrete pipe that is 40 feet long (see Photographs 5 and 6). This pipe will be replaced with a 60 ft pipe. Permanent impacts at the site associated with this longer pipe total 18 linear feet of fill in surface water on the inlet (due to a channel change) and 8_linear feet of fill in surface on the outlet water in addition to a total of 25 feet of rip rap along the stream banks. The work zone at this site will be temporarily watered for approximately 1 day. This will involve the temporary placement of sandbags upstream and downstream of construction. Once the stream has been dewatered, the pipe will be replaced. To maintain water flow during construction, water upstream of construction will be temporarily pumped out and conveyed around downstream of the construction, if necessary. Temporary concurrent impacts to the stream from this activity will result in dewatering 51 linear feet of stream. The materials used for dewatering will be removed after construction. Site 4 -Waters of US Construction at this site will impact an unnamed intermittent tributary to Aarons Creek [NCDENR-DWQ Index No. 22-59-1, Best Usage Classification C; HUC 03010104] (Figure 6) in the Roanoke River Basin. The existing structure conveying the creek is a 12-inch reinforced concrete pipe that is 32 feet long (see Photographs 7 and 8). This pipe will be replaced with a 32 ft pipe. Permanent impacts at the site associated with this 3 longer pipe total 12 linear feet of fill in surface water on the inlet (due to a chanpel change) and_$_Jinear feet of fill in surface on the outlet water in addition to a total of 20 feet of rip rap along the stream banks. The work zone at this site will be temporarily -"dewatered for approximately 1 day. This will involve the temporary placement of sandbags upstream and downstream of construction. Once the stream has been dewatered, the pipe will be replaced. To maintain water flow during construction, water upstream of construction will be temporarily pumped out and conveyed around downstream of the construction, if necessary. Temporary concurrent impacts to the stream from this activity will result in dewatering 401inear feet of stream. The materials used for dewatering will be removed after construction. Riparian Buffer Impacts The project is located in the Roanoke River Basin. Therefore, construction will be completed without impacts to protected riparian buffers. Waters of the U.S./Riparian Buffer Mitigation Avoidance: All wetlands and surface waters not affected by the project will be protected from unnecessary encroachment. No staging of construction equipment or storage of construction supplies will be allowed in wetlands or near surface waters. Minimization: The side slopes have been steepened to the extent possible at jurisdictional sites. Strict enforcement of sedimentation and erosion control Best Management Practices for the protection of wetlands and surface waters will be enforced during project construction. Continued coordination will occur with maintenance forces and the Environmental Officer during construction to minimize impacts to these sites. Compensatory 1~1iti ag tion: Due to the minimal impacts proposed, no mitigation requirements are expected. Therefore, NCDOT proposes no compensatory mitigation. Protected Species Plants and animals with federal classifications of Endangered, Threatened, Proposed Endangered and Proposed Threatened are protected under provisions of Section 7 and Section 9 of the Endangered Species Act. As of February 2008, the dwarf wedgemussel (Alasnaidonta heterodon), smooth coneflower (Echinacea laevigata), and harperella (Ptilirrtnium. nodoszim) are listed as federally protected species in Granville County. Please note that the bald eagle (Haliaeetics leucocephalus) was recently delisted. SR 1331 offers nc streams for habitat for dwarf wedge mussel or harperella. SR 1331 is not adjacent to nor is it surrounded by open water suitable of supporting foraging habitat for the bald eagle. The roadway shoulders along SR 1331 are regularly maintained frcm the gravel to the woods line, eliminating the possibility fcr smooth coneflower to exist in this area. Additionally, a review of the Natural Heritage Program database (last updated November 2007) revealed no occurrences of protected species within the project area. Therefore, based on lack of suitable habitat observed during the 01;09/08 site visit and 4 the NHP database review, biological conclusions of No Effect have been rendered for each of these species. Historical Compliance This project has been screened by all pertinent parties to ensure historic compliance. A no comment-no historic properties clearance was received from Renee Gledhill-Earley with the NCSHPO, dated 02/05/08. Summary Application is hereby made for a NCDENR-DWQ Section 401 Water Quality Certification (WQC) No. 3627 and riparian buffer authorization for above-described activities. An automated payment procedure has been implemented between the NCDOT and NCDWQ. This procedure will enable the Division to apply for the 401 WQC without submitting a check for this permit application. This procedure will provide payment to the NCDWQ by charging the permit application fee of $200.00 directly to the appropriate NCDOT WBS element 5C.039037. Apre-construction notification is attached with this request. Per General Condition 27 [Notification provision], the USAGE is not copied on this permit request. The proposed activities meet the conditions of the Department of the Army Section 404 Nationwide Permit (NWP) 14 and the proposed impacts do not exceed the 1/10 acre of loss of Waters of the United States. Additionally this project does not involve impacts to a special aquatic site. Therefore we intend to comply with all applicable NWP conditions during construction of this project, working under NWP 14 with no notification required to the USAGE. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion, so long as the property is clearly defined. For administrative and distribution purposes, the USAGE requires information to be submitted on sheets no larger than 11 by 17-inch format; however, DWQ may accept paperwork of any size. DWQ prefers full-size construction drawings rather than a sequential sheet version of the full-size plans. If full-size plans are reduced to a small scale such that the final version is illegible, the applicant will be informed that the project has been placed on hold until decipherable maps are provided. 1. USAGE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USAGE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
