Procopio, Jr. 3200 Wellington Court, Suite 115 Raleigh, NC, 27615 Subject Property: 65 Bethany Lane (Lot #45, Brookfield Subdivision Phase I), Youngsville, NC, 27596 Ut Brandy Creek, 28-29-3-(1), Class B NSW Approval of Tar-Pamlico River Riparian Buffer Protection Rules Major Variance [15A NCAC 2B .0259(9)(c)] Dear Mr. Procopio: You have our approval, in accordance with the conditions listed below, to impact approximately 2181 square feet (ft2) (including 1367 square feet (ft2) of Zone 1 and 814 square feet (ft2) of Zone 2) of the protected buffers to construct asingle-family residence at the subject property. This includes 160 square feet (ft2) and 814 square feet (ft2) within Zones 1 and 2, respectively, of impervious surface associated with the building and infrastructure, along with 1207 square feet (ft) within Zone 1 to be maintained as a grassed side yard adjacent to the house. This Major Variance Request was presented to the Water Quality Committee (WQC) of the Environmental Management Commission (EMC) on January 10, 2007. This letter shall act as your Major Variance approval as decided by the WQC on January 10, 2007 and described within 15A NCAC 2B .0259(9)(c). In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control and Non-Discharge. This approval is for the purpose and design that you described in your Major Variance application. If you change your project, you must notify us and you maybe required to send us a new application. If the property is sold, the new owner(s) must be given a copy of this variance approval and is thereby responsible for complying with all conditions. Procopio, Jr. Page 2 of 3 January 22, 2007 The Additional Conditions of the Approval are: 1. No Zone 1 or 2 Impacts No impacts (except for the specifically approved house footprint and side yard and "exempt" uses as identified within 15A NCAC 2B .0259) shall occur to Zone 1 or 2 of the protected riparian buffers unless otherwise approved by the DWQ. No additional impervious surfaces shall be added to Zone 1 or 2, unless otherwise approved by the DWQ. 2. Buffer Mitigation (On-site Restoration) You are required to mitigate for impacts to the protected riparian buffers. The required area of mitigation to compensate for impacts to the protected riparian buffers is 5322 square feet as required under this Major Variance and 15A NCAC 2B .0259. Within your variance request you proposed to satisfy a portion of this mitigation requirement through restoration of the buffer (by planting native woody trees and shrubs) within the first twenty feet of Zone 1 cleared directly adjacent to the stream. This will include 1791 square feet of the total area required. Trees shall be planted at a density sufficient to provide 320 trees per acre at maturity. This density can be achieved by planting approximately 436 (10x10 feet spacing) to 681 (8x8 feet spacing) bare root seedlings per acre. You must ensure the survival of this vegetation for a period of five (5) years. You are required to replace any of these trees or shrubs that die within this five (5) year period. You are required to provide proof in writing that the trees have been planted within one year of the date of this letter. The proof of plantings shall be submitted to the Wetlands/401 Unit and copied to the Raleigh Regional Office. 3. Buffer Mitigation (EEP) You are required to mitigate the remaining balance of mitigation (5322 square feet minus 1791 square feet leaves a balance of 3531 square feet) that you are unable to accomplish onsite through other measures. We understand that you wish to make a payment into the Riparian Buffer Restoration Fund administered by the NC Ecosystem Enhancement Program (EEP) to meet this mitigation requirement. This has been determined by the DWQ to be a suitable method to meet the remaining mitigation requirement. In accordance with 15A NCAC 2B .0259, this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2B .0259(9)(C). For accounting purposes, this variance approval authorizes payment into the Riparian Buffer Restoration Fund to compensate for 3531 ft2 of required riparian buffer mitigation for impacts to 2181 ft2 of protected riparian buffers; 03-03-O1, 28-29-3-(1) Tar-Pamlico River and subbasin." Certificate of Completion Upon completion of all work approved within the Major Variance approval, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401 Oversight/Express Permitting Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. 5. Rain Garden The final version of the draft rain garden plan included with your Major Variance request shall be submitted to the 401 Oversight and Express Permitting Unit (2321 Crabtree Blvd., Suite 250, Raleigh, NC, 27604) within 60 days of the issuance of this approval. The rain garden (including a signed and notarized Operation and Maintenance Agreement) must be implemented and operational before the house is occupied on the property. The rain garden structure as approved by this Office as well as drainage patterns must be maintained in perpetuity. No changes to the rain garden design shall be made without written authorization from the Division of Water Quality. If you do not accept any of the conditions of this Major Variance Approval, you may ask for the full EMC to review your variance request. You must send us a request for this review in writing within 60 days of the date that you receive this letter. If you do not accept any of the conditions of their review, you may ask for an adjudicatory hearing. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This Major Variance Approval and its conditions are final and binding unless you ask for a hearing. This Major Variance Approval shall expire five (5) years from the date of this letter. This letter completes the review of the Division of Water Quality under the Tar-Pamlico River Riparian Buffer Protection Rules [15A NCAC 2B .0259].
